An overall question is whether the regulation is clear as to what should be achieved when it comes to participation for children and what weight children’s wishes and views should be given. Based on a critical legal analysis it is shown that the Swedish system, although having a clear ‘child-friendly image’, is problematic in both these aspects. At present, child participation in the Swedish system is emphasised in theory and in goal-oriented statutes, while at the same time, children to a large extent are ‘legally protected’ from involvement, not the least from influencing decisions made. At the same time, these principles both safeguard and imperil dignity, voice, and story, centrepieces of our service mission. Within each principle, dignity, voice and story collide with and contradict each other. Centres of greatest hope and promise for developing the necessary knowledge and shared practical action include schools, and many young people show their interest and commitment in varying ways including lively protest movements. A set of conditions in Article 12 turns rights into highly qualified permissions that can transfer agency and control from children onto adults. These are further complicated by reports by the UN Committee on the Rights of the Child and others that position children’s best interests against their expressed views, and by contrasting standards set by national laws and guidance. Theories about children’s rights in medical law differ from actual practice in reported cases, which are influenced by long-standing theories about childhood in philosophy and psychology that disregard realities in children’s lives. Yet, because of their vulnerability and assumed incompetence to take part in decision-making, children have often been excluded from taking part in medical research, so as to prevent them from harm. Empirical data on children’s competence to consent to such research used to be rare, but recent developments in this field have created more insights in the myths and realities concerning minor patients’ capacities to decide on medical research participation. Against the background of relevant international, European and domestic legal frameworks concerning the rights of children as participants in medical research, this article goes into instruments such as MacCAT-CR, a semi-structured interview format useable as a competence assessment tool for clinical research involving children. That assumption is based on what are considered child-centred principles, which are enshrined in legislation in England and Wales in the Children Act 1989, mainly the principle of paramountcy of the child’s welfare in Section 1(1) and the principle of no delay in Section 1(2), in relation to the completion of proceedings ( HM Government, 1989). However, comprehensive reviews of both the child protection system (Munro, 2011) and the family justice system (Family Justice Review Panel, 2011), along with research findings (Cappleman et al ., 2013) present a picture that challenges this assumption. Increasingly, the focus on the child’s life and welfare is hampered by a lack of time and resources available to professionals such as Guardians to enable them establish a meaningful and trusting relationship with the child in order to gain insight into and an understanding of the child’s world from the child’s perspective. The child appears to be very much on the periphery of a system that lacks real connectedness with the child and their view of their situation and circumstances. It specifically considers processes of formal and informal exclusion and the manner in which “stigmatised” children are treated within a system where attendance to children’s rights is, at best, sketchy and at worst – downright discriminatory. The paper poses a number of critical questions concerning the extent to which the views of children are given due weight in decision-making processes in schools, whether the background a child comes from affects the way school staff listen to them and whether school rules act as a barrier or enabler for children’s rights. In turn, these questions are related to what educational processes might look like that place due weight on the views of children, what cultures create barriers to listening in practice, and what we can learn from children’s overall experiences. The paper presents findings from a participatory empirical peer research project (funded by a Carnegie Research Incentive Grant and the University of Edinburgh Challenge Investment Fund), conducted with and by young people in schools in Scotland and the north of England. Colonialist-settlers continue in their efforts to modernise the Aboriginal people by imposing their imagined ideas of proper childhood on indigenous children, the age group most easily colonised and subdued. To the colonialists-settlers, the native children were innocent and impressionable blank slates, to be recruited into projects to control and manage their knowledge in boarding schools, orphanages or as slaves in settler households. Similar policies now displace refugee children seeking asylum in Australia out to offshore detention centres.
