Bah","doi":"10.7202/1078506AR","DOIUrl":"https://doi.org/10.7202/1078506AR","url":null,"abstract":"L’objectif de cet article est d’analyser les facteurs influencant l’effectivite d’un accord-cadre international (ACI). L’effectivite est analysee a l’aune de la mise en conformite des pratiques locales de gestion du travail avec les engagements pris dans l’ACI. Considerant la negociation comme un processus, compose de trois phases (avant-negociation, negociation stricto sensu, apres-negociation) et ancre dans un contexte, nous elaborons un modele d’analyse inspire des etudes de processus strategiques (process studies). Ce modele met en lumiere l’influence des positionnements, des comportements et des interactions des protagonistes de la negociation et de l’application d’un ACI sur son effectivite. Nous detaillons les processus de negociation de quatre ACI, conclus au cours des annees 2010, par deux firmes multinationales (FMN) francaises et deux federations syndicales internationales (FSI). Ces ACI portent sur des thematiques de gestion du travail (sante et securite au travail, egalite femmes-hommes, emploi durable). Cette recherche repose sur une analyse de documents, d’observations et de 38 entretiens, menes aupres de syndicalistes internationaux, europeens, nationaux, locaux et de membres des directions generales (DG) de ces FMN. Elle porte une attention particuliere a la phase de l’avant-negociation et met en exergue les interactions entre les acteurs manageriaux et syndicaux, tout au long du processus de negociation. Nous montrons que le positionnement de la DG de la FMN (« social » ou « managerial ») est un facteur decisif du deroulement de la negociation d’un ACI, de son resultat (accord « substantif ») et de son effectivite. Le positionnement « qualitatif » de la FSI peut etre un element essentiel du deroulement de la negociation (par le choix de la thematique de l’ACI) et de son resultat (dispositions portant sur des sujets sensibles). Enfin, la mobilisation des syndicats locaux, soutenue par la FSI, est essentielle a l’effectivite d’un ACI. Degryse","doi":"10.7202/1074559AR","DOIUrl":"https://doi.org/10.7202/1074559AR","url":null,"abstract":"Le modele social historique que connaissent la plupart des pays industrialises s’est bâti sur des fondations solides qui, a l’instar du theâtre classique, repose sur ces trois unites : unite de lieu de travail (l’atelier, la fabrique, l’usine, le bureau), unite de temps de travail (les horaires de travail hebdomadaires, les periodes de repos) et unite d’action (l’organisation collective du travail). Or, apres avoir connu, vers la fin du 20e siecle, des « fissurations » dans l’unite de lieu avec le developpement de la sous-traitance, des chaines de valeur mondiales et la coordination d’entreprises subordonnees, l’economie de plateforme et les nouvelles formes d’externalisation du travail qu’elle permet contribuent, aujourd’hui, a eroder l’ensemble de ces fondements, a tout le moins dans certains segments de l’economie, ce qui a pour effet de «liquefier» le travail et de fragiliser ce modele social historique.Le travail dans l’economie de plateforme echappe aux regulations de lieux, de temps et de l’organisation collective. Autrement dit, pour les travailleurs de plateforme, il n’y a pas de locaux d’entreprise, pas de collegues, pas d’horaires, pas de representants du personnel, pas non plus de reglements en matiere de sante et de securite, pas de prevention des accidents du travail, pas de conges payes, pas de negociation collective, pas d’assurance-maladie… Cette nouvelle forme de fragilisation et de precarisation des travailleurs donne lieu, depuis quelques annees, a l’experimentation de pratiques innovantes, parmi lesquelles la creation de collectifs autonomes, l’organisation d’actions collectives, la construction de cahiers de revendications, mais aussi le repertoire d’action plus traditionnel du mouvement syndical : sensibilisation, organisation, negociation. Certes, ces strategies sont confrontees a des obstacles inedits tels que la difficulte a identifier le responsable de la relation de travail, l’absence de lieu de dialogue social, la confusion concernant le statut du travailleur, la difficulte a organiser ces ilots de travailleurs eparpilles en l’absence de lieux d’echange entre eux. The Court has grappled with the tension between the role of, and relationship between, courts and tribunals. The author, who has been both a judge and a tribunal member, argues for an attitude of humility towards these administrative bodies. With this approach, the author argues, even those most skeptical of tribunals might recognize their value as less formal, more expeditious, more expert, and binding dispute resolution mechanisms that complement—rather than detract from or compete with—courts.
