Traditional natural law theories are, however, flawed and outdated. To truly modernize natural law, we propose a new concept, “political natural law” (<span style=\"font-variant: small-caps;\">PNL</span>), which has the capacity of curing these flaws. We then substantiate the <span style=\"font-variant: small-caps;\">PNL </span>s from the result of analyzing the institutional causes of civil wars since 1800, and link them to human dignity. These figures highlight philosophical activity as benefitting from a wide variety of heterogenous sources, styles, and models, and suggest that philosophy be understood as a response to lived needs. Though the Pure Land notion of “easy practice” (Jp. <em>igyō</em> <styled-content lang=\"zh-Hans\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:ifp=\"http://www.ifactory.com/press\">易行</styled-content>) may be seen as Zen’s less rigorous counterpart, Shinran’s turn toward “other-power” (<em>tariki</em> <styled-content lang=\"zh-Hans\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:ifp=\"http://www.ifactory.com/press\">他力</styled-content>) is driven by the same philosophical debates over practice and liberation that occupied contemporaries such as Dōgen. She maintained that naturalism as materialism misses the spiritual component of human existence, which is captured in her theory of realism. The confusion about the different meanings of using the same words in the history of philosophy from Kant to Heidegger causes not only problems in understanding but also problems in the translation of the philosophical classics, especially in a non-Indo-European language such as Chinese. Through examination of Kant’s conception of the ‘transcendental’ and a critical textual analysis of Heidegger’s reinterpretation of ‘transcendence’ as a temporal ecstatic Dasein’s existence, this essay attempts to show that the problem of transcendence, along with the debates over the Chinese translation of the relevant terms, is not merely a problem in a traditional theory of knowledge or epistemology. Forster","doi":"10.1163/15406253-12340109","DOIUrl":"https://doi.org/10.1163/15406253-12340109","url":null,"abstract":"This article explains a new ‘foreignizing’ approach to translation that was invented in the late 18th and early 19th centuries, especially by Herder and Schleiermacher, and that has since become the predominant approach in translation theory. The article argues that despite the great virtues of this approach, it was based on an unduly narrow restriction to Indo-European languages, which leaves considerable room for further improvement. Greater attention to Hebrew has since made up this deficit to a certain extent. But Chinese holds the potential for even more important refinements of the original theory. The article explains the original theorists’ failure to exploit this case in terms of a certain prejudice against Chinese language and culture that had arisen at the time, and for which these theorists were themselves partly responsible.
