The article considers the directions of prisoner of war personality transformation for resocialization, necessary under conditions of a special military operation. In the historical context, these problems are relevant during any military operations, which is confirmed by the materials of the Great Patriotic War: the resocialization of foreign prisoners of war was accompanied by these persons’ worldview and political attitudes formation affected the public opinion of other citizens. Due to the importance for the prisoner of war’s personality and taking into account modern realities, it is advisable to use this positive experience in the resocialization of Ukrainian prisoners of war in the conditions of the ongoing special military operation. \u0000The purpose of the article is to outline the directions of the prisoner of war personality transformation in the field of resocialization, necessary for the formation of a positive worldview in the conditions of a special military operation. \u0000Methodology, methods and techniques. Scientific tools of the research include a set of general and private scientific methods applied comprehensively: dialectical method, historical, comparative-legal, deductive and inductive, analysis, other methods of scientific knowledge. \u0000Results. The article substantiates the need to improve the paths to transformation of the prisoner of war personality towards resocialization in the conditions of a special military operation by means of 1) creating new psychological methods of influencing the prisoner of war personality, allowing to form a positive worldview, to rethink the necessity of participation in a special military operation; 2) introducing a new position of the Presidential Commissioner for Human Rights on Military Issues with a set of powers related to the resocialization of prisoners of war; 3) recruiting military psychologists with skills for applying these techniques in the department of the Deputy Presidential Commissioner for Human Rights on Military Issues; 4) improving penal enforcement legislation in the area of preventing deviant behavior of prisoners of war, taking into account the individual characteristics of the prisoner of war personality. \u0000Scientific novelty of the article is to form the author’s vision of specific directions of transformation of the prisoner of war personality towards resocialization. \u0000Practical significance. It develops at the meeting point of social and legal psychology. The main scientific problem in studying legal relations is associated with understanding the essence of law. Two leading directions have emerged in legal science: the doctrine of the natural and the social nature of law. In psychological terms, these doctrines reflect one of the main issues of psychology about the relationship between the biological and the social in the human psyche. The concept of the natural origin of law gives psychologists the opportunity to study law from the perspective of the biological foundations of the human psyche. The concept of the social nature of law (positive law) is linked to social psychology and orients psychologists towards the study of legal relations. In legal reality, there is a close relationship between natural law and positive law, which emphasises the unity of the biological and social essence of human beings. \u0000Theoretical analysis of the aspects of legal relations is determined by actual problems. Interest in the problems of legal relations is caused by the need to form a state governed by the rule of law and to establish a new system of legal relations in the global community. The Western legal and social psychology pays not much attention to the legal relations. The article analyses the concept of «legal relations» on the basis of national legal and socio-psychological literature. There is no consensus in jurisprudence regarding the definition of «legal relations». Legal relations are a form of social relations. Problems in the formation of consolidated legal relations are linked to insufficient knowledge in the field of law, especially among young people. When studying legal relations it is necessary to take into account psychological peculiarities of legal behavior. The article examines two socio-psychological aspects of the formation of legal relations. The first aspect is the interrelation of psyche and law, the second aspect is the connection of law with morality and ethics. The unity of law, morality and ethics is determined by the necessity of not only legal but also moral regulation of behavior. Philosophical and legal literature has comprehensively analysed the relationship between law and the human psyche. G. W. F. Hegel emphasised the psychological nature of law, since the phenomenon of law emerges as a result of the spiritual activity of a person. On this basis public legal relations originate. In Russian science, the doctrine of natural law and the relationship between psyche and law was developed by L. I. Petrazhitsky who focused his attention on the study of motives of legal behavior and developed the classification of human emotions. Positive law is psychologically expressed in the concepts of duty, responsibility and obligation. {"title":"Deviantological aspects of the prevention of sexual offences related to sexual coercion and harassment","authors":"E. The author believes that the criminalisation of sexual abuse (including harassment) does not meet the genesis of criminal law regulation, namely the social need for it to be prohibited specifically by criminal law, which is the state’s final argument in combating anti-social behavior. \u0000Introduction. The moral and cultural assessment of sexual relations outside of marriage, as well as of non-traditional forms of sexual relations, has changed over time and has had a significant impact on state-legal approaches to ensuring the security of sexual freedom and sexual inviolability of the individual. In this regard, on the modern socio-cultural platform new directions of formation of the state policy in the field of permissible and prohibited in the sexual sphere, the nature of freedom of actions of sexual nature and the degree of public danger of such deviations as coercion to actions of sexual nature and accompanying acts - sexual harassment are born. \u0000Aim of the criminological and sociological study was to outline the boundaries of the criminal law prevention of sexual deviations related to compulsion to sexual acts and harassment. \u0000Research Methodology, Methods and Techniques. The methodological basis of the study consists of general scientific and particular scientific methods of scientific knowledge, methods of empirical and theoretical research. Dialectics is accepted as a philosophical theory about the universal laws of motion and development of nature, human society and thinking, and in its original sense - as a logic and debatable search for truth related to the object of research. The anthropological approach allows us to reveal the ways in which the perpetrator’s personality is formed, as well as the motives and motivation behind deviant behavior. The axiological approach assists in verifying ways of strengthening the perceptions of sexual freedom as a moral and legal value, both at the level of mass, collective and individual consciousness and at the level of law-making and law enforcement processes systematically related to countering sexual offences. The use of the above approaches and methods ensured the study of sexual deviations, connected with coercion to actions of sexual nature and harassment, as an independent criminological phenomenon. \u0000The study found that general and special prevention mechanisms to prevent sexual harassment exist in our country, but are poorly used for various reasons, including the immoral behavior of the victim. The existence of organisational and legal problems for law enforcement agencies in proving reports of sexual offences should be recognised, but this cannot change the social nature of the acts and the degree of their public danger. Attention to formation of young citizens’ worldview involves socio-psychological analysis of numerous factors determining their attitude to themselves, the people around them and society as a whole. The well-timed recognition and prevention of the destructive transformation of natural forms of deviant behavior inherent in teenage and adolescent age is a condition of personal and social well-being. The article is devoted to the study of socio-psychological and personal markers of extremist activity of representatives of the near-football movement. The author solves the research tasks related to the identification and system analysis of factors-indicators that make it possible to characterise extremism as a social and legal-psychological phenomenon; the individual-psychological analysis of the extremist personality in the context of a certain type of his activity - the near-football movement; the definition of the attitude of young generation representatives to the football fans movement, their activity and world view; the identification of optimal social-psychological and organisational-legal ways of counteracting this type of extremist activity. Scientific materials contain theoretical analysis of problems arising at different stages of professional psychological selection (screening) and empirical data of revealed risk factors of deviant behavior of candidates for service in the internal affairs bodies. The basis of the philosophy of policing in Kazakhstan today is the idea of a helpful police officer who fully meets the needs of society and the requirements of the state. One of the main requirements for police in modern Kazakhstan is resistance to corruption. The author’s idea is that the formation of moral values in cadets during their training in a departmental university can become a qualitative basis for the prevention of corruption offences of police officers in the future. The author considers some shortcomings of departmental education that hinder the process of developing moral values, and describes the conditions under which this process can take place more effectively. In addition, the author describes a model for the formation of moral values in cadets, which can be used in the educational process of the university. One of the actual issues of preventive pedagogy is the analysis of the challenges and mistakes that teachers face with in the process of preventing deviant behavior. \u0000The aim of the research: institutional, descriptive-analytical and concretising presentation of scientific data on the main challenges and mistakes made by teachers when preventing deviant behavior among children and young people in a general education school. \u0000The main method for collecting empirical information involved a survey of 200 teachers across all the federal regions of the Russian Federation. \u0000The novelty of the research lies in the systematisation of challenges and mistakes of teachers in preventing deviant behavior of school students; in obtaining new factual material significant for the optimisation of deviant behavior prevention. \u0000The practical significance of the research results consists in clarifying the scientific categories and concepts that develop the idea of the conditions of effectiveness of deviant behavior prevention; specification of deviantological competence of teachers. Smartphones have changed the way people interact with each other in modern society. However, while they are becoming increasingly ubiquitous in human life, there is growing concern that they are often used at inappropriate times during social interactions. The article presents the results of a study of the phenomenon of «phubbing» as a dismissive attitude towards someone in a social environment, when the partner focuses on their mobile phone. Phubbing also significantly reduces the perceived quality of communication and satisfaction with relationships in a dyadic conversation. The article examines an attractive, although still limited, field of research that studies the phenomenon of phubbing in educational organizations of the Ministry of Internal Affairs of Russia. \u0000The purpose of the study was to determine the gender characteristics of the manifestation of phubbing in cadets of educational institutions of higher education of the Ministry of Internal Affairs of Russia. \u0000Methodology, methods and techniques. A complex of empirical and mathematicalstatistical methods was used to analyze the manifestation of phubbing. Empirical data were obtained using the following methods: Phubbing Scale, consisting of 10 questions (Phubbing Scale, E. Karadağ, et al, 2015); four-factor Generic Scale of Phubbing (GSP), consisting of 15 questions, aimed at assessing the experience of exposure to phubbing. The following factors were identified as important: nomophobia, interpersonal conflict, self-isolation, recognition of the problem; Internet Addiction Test by Kimberly Young (Internet Addiction Test, IAT), translated and modified by V.A. Loskutova (Burova). \u0000Statistical processing of the research materials was performed using standard statistical procedures. Specialized application software packages «Excel» and «IBM SPSS Statistics 22.0» were used, providing the calculation of univariate statistics and comparative analysis. The study was \u0000conducted at the St. Petersburg University of the Ministry of Internal Affairs of Russia in 2023, among the 1st – 4th year cadets. The sample consisted of 1,054 respondents aged from 17 to 26, the average age was 19.99 ± 1,495, of which 561 were male (53.2%) and 493 were female (46.8%). \u0000The results of the study. A comparative analysis of the manifestation of phubbing in male and female cadets showed significant gender differences in the factors «nomophobia» and «recognition of the problem». Based on the negative averages, it can be concluded that there is no phubbing among cadets, which is confirmed by the results of the empirical study. It was also found that male cadets are less prone to phone addiction and recognition of the problem of addiction than female cadets. When studying the gender characteristics of Internet addiction, no significant differences between the sexes were found. \u0000Scientific novelty.
