Having a look at the classic texts in the Islamic tradition, the article offers some critical reflection on the role and position of the executive, parliament and judiciary under Islamic constitutionalism. Is this liability related to the physician’s derelict or is it contractual? To what extent is the physician responsible in accordance with the legal status of the medical liability? The researchers arrived at the fact that the physician’s liability according to the Islamic regulations is contractual and derelict as well. Accordingly, the physician who has not obtained a certificate of practicing the profession, which is issued by the relevant authorities, or neglect, and encroach will be responsible for any harm he causes, and he, or the health insurance, will be responsible for compensating any damage caused by the physician. The French and Egyptian laws in addition to most of the world’s laws also adopt this view. The researchers have realized the failure of the laws in the third world as to physicians’ errors and the need for regulating this issue by special laws. This current study aimed to investigate qualities of metacognitive knowledge in the proses of memorization of Quran using Flavell’s components of metacognitive knowledge which are task, strategy, and person. This qualitative case study took place in one university in Malaysia used interview and think after journal to investigate the metacognitive knowledge of two young huffazs as they memorized and revised the Qur’an. As the result, the study identified the six attributes of metacognitive knowledge: understanding the nature of task, understanding the influence, applying memorization strategies, monitoring the process, utilizing resources, and practicing immediate coping. The results contribute to the understanding of adolescent huffadhs memorization technique and suggest the benefit of teaching metacognitive strategy in the Quran memorization. It aims to show that the Salafi concept of WB has its roots in Wahhabism and highlight the main factors that have contributed to the development of the concept in Wahhabism in the modern period (twentieth century and beyond). Essentially, the paper attempts to show that WB which started in early Wahhabism as a tool to fight apostasy and innovations in Islam has developed into an important element used by both the Saudi establishment scholars and those who oppose the kingdom to support their religious inclination and political agenda. Providing benefits for people and protecting them from harm them is one of the higher objectives of Islam, and jurists have tried to actualize this in their ijtihāds through various methods. Balwā al-ām is an Islamic concept which refers to public affliction that is encountered often in society and is therefore difficult to avoid. Muslim jurists take balwā al-ām into consideration when producing legal verdicts to secure benefits and avoid harm. In this essay, balwā al-ām and its relevance to other juristic concepts such as istiḫsān, maslaḫah mursala, sadd aldharā‟ī and istihlāk will be discussed. [approximately] three-quarters of U.S. Muslims are immigrants or the children of immigrants‖; a religious expansion that draws much needed race, religion, culture and ethnicity attention upon the discrete ―color line‖ saturating Muslim identity and membership. To play their roles and functions, mosques have faced challenges in Muslim majority and minority countries. This article examined Indonesian mosques in Indonesia and the United States, taking samples of eight prominent mosques in Indonesia (located in two areas of Jakarta and Depok) and two mosques in the United States. Data was collected by conducting observations, interviews, and focus group discussions (FGDs) involving 150 participants in Indonesia, and 75 participants in the United States. They are from managements and congregations of the mosques.
