Autentica norma vanguardista, incluso “revolucionaria”; en cuanto no solo restablece el tradicional concepto de libertad de prensa (libertad del emisor); sino que en adelante se exige como derecho constitucional: “A comunicar o recibir libremente informacion veraz por cualquier medio de difusion” (art. 20.1.d). Asi el sujeto del derecho fundamental pasa del emisor al receptor (ciudadano). Este vuelco conceptual abre un nuevo camino, a la vez que exigencia, a los sujetos emisores tradicionales: empresas y redacciones. Dado el peso y la herencia del franquismo, los cambios seran lentos y hasta traumaticos. Desmontaje de las viejas estructuras, a la vez que creacion de nuevas empresas. Indefiniciones, falta de capitales e incluso pervivencia de mentalidades tradicionales estan el fondo del dificil nacimiento de los nuevos medios democraticos, especialmente en la prensa escrita y television. Muchas empresas se ven abocadas al fracaso. Alternativas: concentrarse y/o morir. La gran crisis, que estalla en 2008, afecta a las empresas de comunicacion posiblemente como a ningunas otras. A ello hay que sumar la profunda crisis de transformacion de mano de internet. Todo ello, repercute de forma brutal en las cuentas de las empresas a partir del 2010. Empresas editoras, sin excepcion, que terminan por ser controladas bien grandes bancos y/o multinacionales del sector. Proceso en marcha sin que se le vea aun un horizonte de estabilidad. La posesion en manos especulativas y/o con intereses de tipo politico-ideologico, representa un gran peligro no solo para la independencia de esta especial industria, sino para la misma democracia espanola EnglishThe Spanish democratic media is based on the framework established by the 1978 Constitution. It is an authentic avant-garde norm even “revolutionary”. It does not only restore the traditional concept of freedom press (freedom of the issuer) but from now on it is required as a constitutional right. Given the weight and heritage of Franco, the changes will be slow and even traumatic. The great crisis which broke out in 2008 affected the communication companies possibly like no others. They are also impacted by the profound transformation crisis due to the internet. Introduced in 2000, LPFM contains lessons for the wider media landscape in the second century of broadcasting.
