Firstly, it refers to the provisions of various international human rights instruments relevant in the context of combating hate speech, providing general legal framework for the proper assessment of this issue. Then it discusses the legal concept of hate speech and certain controversies and difficulties involved. In particular, it points to the specific distinction that must be established and preserved between hate speech and other forms of hateful speech. Finally, the jurisprudence of the European Court of Human Rights concerning hate speech is analyzed by providing relevant examples from its case-law. {"title":"Historical Events in Symbols and the Freedom of Expression: The Contemporary Constitutional Debate in Croatia","authors":"Đorđe Gardašević","doi":"10.20901/PM.55.4.06","DOIUrl":"https://doi.org/10.20901/PM.55.4.06","url":null,"abstract":"In the last few years, the Croatian Constitutional Court delivered several important decisions that significantly shaped interpretative approaches to constitutional guarantee on the freedom of expression in the specific context of the public use of some symbols with contested meanings. Such developments undoubtedly deserve attention, especially in terms of particular tools that the Court used in defining limits to free speech. The primary focus of this article is directed to the issue of whether the use of contested symbols in public may be covered by constitutional free expression guarantees, and be therefore treated as the case of balancing process between them and some opposed interests, or it should be subjected to stricter prohibitions, including their complete ban. For those purposes, I am first presenting the relevant case-law of the Croatian Constitutional Court and then the cases already decided in a similar fashion by the European Court for Human Rights. {"title":"Još uvijek teorijska fantazija: egalitarni sindrom Josipa Županova","authors":"Danijela Dolenec, Daniela Širinić","doi":"10.20901/pm.55.3.01","DOIUrl":"https://doi.org/10.20901/pm.55.3.01","url":null,"abstract":"U ovom tekstu analiziramo empirijski hommage Štulhofera i Burića (2015, 2016) Županovljevoj teoriji o egalitarnom sindromu (TES). Pokazujemo da autori preskaču neke fundamentalne korake u dizajnu istraživanja, kao što je zahtjev da propozicije vlastite teze uklope u postojeće znanje o nekoj temi. Nadalje, autori ne vode dovoljno računa o implikacijama višedimenzionalnosti konstrukta TES za svoju konceptualizaciju, a ni prilikom odabira statističkih analiza. Pokazujemo zašto podatke koje imaju ne bi trebali koristiti za analize koje poduzimaju. Nasuprot tome, naša analiza percepcije legitimne razine dohodovne nejednakosti sugerira da smo u europskim i globalnim okvirima sasvim prosječno egalitarno orijentirani. Dapače, stanovnici Njemačke ili Švicarske više teže uravnilovci nego stanovnici Hrvatske. Ovaj nalaz dovodi u pitanje interpretacije prema kojima je zahtjev za smanjenjem dohodovne nejednakosti atavizam socijalističke prošlosti, kao i one koje tvrde da takvi zahtjevi koče razvoj društva. Uzevši u obzir sve navedeno, zaključujemo da egalitarni sindrom i dalje ostaje teorijska fantazija. {"title":"Bosnia-Herzegovina and the Cultural Memory of Bleiburg","authors":"A. Custo","doi":"10.20901/PM.55.2.06","DOIUrl":"https://doi.org/10.20901/PM.55.2.06","url":null,"abstract":"This article provides a preliminary overview of the perceptions of Bleiburg among Croats and Bosniaks in Bosnia-Herzegovina, as well as its role in the overall construction of cultural memory in this deeply divided post-Yugoslav state. The author explores how the remembrance of the Second World War in socialist Yugoslavia fragmented and was replaced by new, nationalist narratives among Serbs, Croats, and Bosniaks. The memory of Bleiburg plays a central role in the victimization narrative among Bosnian Croats, and their political leadership has been deeply involved in the commemorative practices related to the events in May 1945. Bosniaks, while primarily focusing on the continuity with the antifascist Partisan tradition, have increasingly opened up the question of communist crimes such as Bleiburg, albeit through the media and memoirs and not yet systematic academic analysis.
