Many of the justice-issues here are about the observed benefits or harms of the faith-component involved, others concern more the collaboration models that integrate the faith-based or faith-inspired non-governmental sector to the public sector schemes. Between the options of “justice as impartiality” and the “specificity of the faith-based sector, ” the author argues for a “justice with understanding” option that integrates formal equality into a contextually rooted approach. Eventually, through a critical and benevolent analysis of cases in a range of contexts, he comes up with ten more specific options for the just advancement of health, showing also how reasonable balancing among the contextually most relevant of them can point out hopeful avenues for the future.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"264-278"},"PeriodicalIF":0.0,"publicationDate":"2024-08-02","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147921364","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Using moral philosopher Kate Manne’s feminist philosophical framework about the nature of misogyny, this chapter embraces multidisciplinary perspectives to examine engagement with and resistance to the Australian state. Women’s liberationists began to address the problem of violence against women and children during the 1970s, yet sexism, misogyny, and gender violence persist in the twenty-first century. This chapter considers state, media, and activist responses, including grassroots campaigns, online misogyny, the prestigious Australian of the Year Awards, and contemporary law reform. Conceptualisations of these problems reveal significant divergences in perspective: not only does divergence exist between the Australian state, the media, and activists, but also between activists themselves, especially regarding the question of criminalisation. Ongoing debates highlight the dynamics of whose voices gain precedence and how this affects politics, the media, activism, policing, and the law today.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"159-191"},"PeriodicalIF":0.0,"publicationDate":"2024-05-14","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147887388","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This chapter surveys the contours of such developments as well as the activities of 12 key far-right extremist groups and the anti-Muslim populist, ethno-nationalist, masculinist and anti-globalist narratives that they currently propagate - with a keen focus on the propensity of these narratives to present a threat and even spill over into further violence. Added to this, the chapter also surveys guidance for - and examples of - counter narratives that can be posed in relation to these dominant frames and therefore combat the further rise of far-right violence in the future.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"75-110"},"PeriodicalIF":0.0,"publicationDate":"2024-04-11","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147901318","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

An increasing number of incidents were reported in which anti-immigration and Islamophobic violence occurred, together with anti-government attacks and assaults on political opponents, ethnic minorities, and the LGBTQ community. The presence of far-right-inspired political violence is obviously not a novel phenomenon. It may be of greater interest that there are noteworthy novelties in the modus operandi of these worrisome groups and in functionalities of their fundraising, recruitment and communication. This Research Agenda has attempted to take account of the most relevant underlying circumstances that operate as driving key risk factors in the examined countries. The conclusion delineates the complexity of the threat landscape and summarizes the key findings. In sum, we aim to better understand the key features of the scrutinized threat picture. With all this in mind, we have identified five threat indicators that should be considered to characterize the nature of the associated threat.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"227-240"},"PeriodicalIF":0.0,"publicationDate":"2024-04-11","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147915368","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

With the aim of addressing this research gap, this chapter develops a theoretical framework that is useful for analysing the dynamics of the diffusion and global circulation of populist discourse. Considering the literature on the diffusion of public policies, collective action frames and the theory of circulation of ideas, this chapter conceives populism as a global, multi-scalar political phenomenon beyond contextually situated cases. To demonstrate the utility of the proposed framework, we provide empirical illustrations of the dynamics of diffusion and global circulation of populist discourse from the Global South to the Global North and vice versa. We are thus interested in advancing a research agenda on the transnational dimension of populism and its diffusion across the globe.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"540-550"},"PeriodicalIF":0.0,"publicationDate":"2024-03-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147912667","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It begins by discussing the emergence of the self-determination discourse and how it has influenced domestic policymaking. The chapter raises the question of whether UNDRIP, despite its significance, impedes the implementation of Indigenous self-determination and sovereignty. The second part of the chapter examines two policy frameworks for implementing Indigenous self-determination: the Canadian Inherent right to self-government policy and the Greenland Self-government Act of 2009. It argues that the state’s involvement in policymaking can hinder Indigenous self-determination and that policies placing marginalized groups at the centre of policymaking are more effective in promoting and protecting Indigenous self-determination. The chapter concludes with a brief discussion of traditional Indigenous governance models that prioritize community involvement and decision-making in policymaking.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"53-69"},"PeriodicalIF":0.0,"publicationDate":"2024-02-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147905996","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
