An essential feature of a third party’s participation in legal proceedings is the need for that person to protect his or her legal interests and to intervene in the dispute between the parties on his or her own initiative. A judge is not entitled to summon a party to a civil case on his or her own initiative, if the party to the dispute has not made such a request. The third party, without his or her independent claims, is one of the parties to the dispute in support of the case. When deciding on the admission or summoning of a third party, the judge must assess whether the boundaries of the subject of the claim and the claim allow the protection of the legal interest of the third party concerned. This principle and the right not to incriminate oneself are recognised as an international standard which lies at the heart of the notion of a fair procedure. The right not to incriminate oneself is significant with regard to the evidence, which is obtained through methods of coercion or oppression in defiance of the will of the accused. It is the view of the author that the private autonomy is derived from the fundamental norm of a democratic state and of the rule of law (Rechtsstaat). The principle of private autonomy is recognised to not only have a material aspect, but also a procedural aspect, and therefore it contains the rights of a person to enforce substantive claim also in part only. Firstly, the author analyses the prevailing view in Latvian legal doctrine and case law that cession transfers only the cedents’ rights to cessionary, but not the cedents’ obligations, in which respect the author provides a critique of this approach. Secondly, the author discusses the question of the permissibility of cession of non-monetary claims, noting that typically in practice cession serves monetary claims. Thirdly, the author addresses the issue of the legal consequences in cases where a contractual prohibition on assignment is breached or where the cedent alienates the same claim more than once. As recognised by European Commission, the digital transition should work for all, putting people first and opening new opportunities for business. According to latest Open Data Institute research, Latvia is placed in the middle amongst the EU countries regarding policy for secondary use of health data. Finish Act on the Secondary Use of Health and Social Data and FinData practical experience constitutes a good role model regarding secondary use of health and social data. A criminal offence may be directed at the victim’s property and therefore actions must be taken in criminal proceedings to ensure the protection of the victim’s rights. In carrying out this task, the right of the bona fide owner may be infringed. The article analyses the situation, identifies problems and offers solutions to them. The other circle of persons whose rights to property may be limited during criminal proceedings can be the affected owner of the property – the person whose property may be arrested or confiscated. The Constitution is a real and enforceable legal act with the highest legal force, which is binding for everyone in the legal system. The principle of the direct application of the Constitution is reflected in the Central and Eastern Europe after the collapse of socialistic and Soviet regimes. Here, it was necessary to even formulate it as a written constitutional provision for ensuring of supremacy of the Constitution and rule of law. In case of Latvia, the direct application of the Constitution is self-evident and respected in the legal system.
