Zirnstein","doi":"10.18690/LEXONOMICA.10.2.119-132.2018","DOIUrl":"https://doi.org/10.18690/LEXONOMICA.10.2.119-132.2018","url":null,"abstract":"Building on research focusing on the impact of digital technologies on the labour market, this paper provides an interpretation of major findings by reference to labour law in Slovenia. It is argued that the existing labour law in Slovenia does a reasonable job in dealing with the changes we are witnessing in digital economy. However, the problem is in the implementation of workers« rights in practice. The workers are not taking action to enforce their legal rights as much as one could expect. In addition to this, employers do not put enough attention to the challenges that digitalisation brings in the field of health at work and in the field of workers« skills. Therefore, the Slovene government should embark upon a system of reforms to improve the promptness of courts in labour disputes. It should also appoint more labour inspectors. At the same time, employers should adopt practical solutions regarding the organisation of working process with aim to diminish the negative impacts of digitalisation on health at work. Furthermore, the employers should put more attention to the development of workers« skills, especially those which, according to theory, will be crucial in the future. Vpliv digitalnih tehnologij in digitalizacije na delovno pravo – primer Slovenije Izhajajoc iz raziskav o vplivu digitalnih tehnologij se prispevek osredotoca na delovno-pravne vidike, ki jih digitalizacija prinasa v svet dela na splosno in se posebej v Sloveniji. Avtorja poudarjata, da ucinek in posledice tehnoloskih inovacij presegajo dileme o izginjanju dosedanjih delovnih mest in nastanku novih: nanasajo se na vprasanje kvalitete zaposlitve, varnosti zaposlitve, placila za delo in delovnih pogojev. Avtorja menita, da slovensko delovno pravo nudi primerne odgovore na izzive, ki jih digitalno gospodarstvo prinasa v svet dela. Zato se ne zavzemata za spremembe zakonodaje, pac pa poudarjata, da je v Sloveniji problem predvsem implementacija te zakonodaje v praksi. Delavci v praksi ne uveljavljajo svojih pravic, delodajalci pa posvecajo premalo pozornosti vplivu digitalizacije na zdravje pri delu in razvijanju kompetenc delavcev. Resitve obstojecih izzivov so zato nujno vecplastne. Slovenska vlada bi morala pristopit k oblikovanju reform za se vecjo hitrost sodnih postopkov, prav tako bi morala povecati stevilo inspektorjev za delo. Obenem bi delodajalci morali razmisliti o prakticnih resitvah na podrocju organizacije delovnih procesov ter na ta nacin omiliti negativne ucinke digitalizacije na zdravje delavcev. {"title":"Online Gambling under EU Law: Strolling Between Controlled Expansion and Genuine Diminution of Gambling Opportunities","authors":"Janja Hojnik","doi":"10.18690/LEXONOMICA.10.2.67-102.2018","DOIUrl":"https://doi.org/10.18690/LEXONOMICA.10.2.67-102.2018","url":null,"abstract":"This article outlines some of the ambiguities arising from the endeavours of the EU Court to offer the national courts sufficiently clear interpretation of EU rules on free movement of services in respect of various national restrictions of online gambling that would enable them to make rulings in increasingly high numbers of cases in which foreign providers are restricted from accessing markets of EU Member States. It is submitted that this casuistic approach by the Court should not be considered as satisfying and that harmonising instruments should be adopted by the EU legislators, instead. Yet however, this is less realistic than ever before, as the Commission in situation of a total lack of the Member States« consensus stepped away from its efforts to pave the way to at least minimum standards of gambling offerings and provision of customers« protection, leaving it further to the EU and national courts to balance between controlled expansion and genuine diminution of gambling opportunities so as to weigh between free movement of services and opposing legitimate aims of the Member States. Spletne igre na sreco po pravu EU: vijuganje med nadzorovanim sirjenjem in pristnim omejevanjem priložnosti za igranje na sreco Clanek izpostavlja nekatere nejasnosti, ki izhajajo iz prizadevanj Sodisca EU, da nacionalnim sodiscem ponudi dovolj jasno razlago pravil EU o prostem pretoku storitev v povezavi z razlicnimi nacionalnimi omejitvami spletnega igranja na sreco, kar naj jim omogoci odlocanje v vse vecjem stevilu zadev, v katerih so tuji prireditelji iger na sreco omejevani pri dostopanju na trg držav clanic EU. Avtorica izpostavlja, da kazuisticni pristop Sodisca ne bi smel veljati kot zadovoljujoc in da bi bilo namesto tega potrebno sprejeti harmonizacijski akt na ravni EU. Legal scholars enumerated and assessed in depth the advantages and disadvantages of any type of outsourced dispute resolution. However, a number of legal writers still fail to enumerate the exact differences in course of events and all of the trade-offs that a party will have when deciding to resolve the dispute using an outsourced dispute resolution. Clearly the costs, the celerity and the flexibility are important issues. However, the decision is not influenced solely by legal arguments. This paper will mention some typical Slovenian issues in an assessment of the choice of dispute resolution. If parties want to continue to remain in good terms after the dispute, then an outsourced dispute resolution is highly recommended. This basic proposition, which is true as far as it goes, is based on the so-called American Rule, which provides that in the United States each side in a litigated case is responsible for paying their own attorney, regardless of the outcome of the case. On its face this proposition seems simple. On the contrary, however, the laws in the United States governing attorney’s fees are surprising quite complex. This article provides a general survey of the patchwork of laws, federal and to a lesser extent state, and the author will demonstrate that rules and laws governing attorney’s fees are often grounded in important public policy and fundamentally shape important issues, such as access to the courts and the legal system more generally.
