The right to drinking water is enshrined in the Constitution of the Republic of Slovenia. Individual by-laws in the field of water management are not coordinated with higher-level laws, the Constitution of the Republic of Slovenia, nor with EU regulations (directives, regulations). There are no relevant provisions in laws and by-laws that would enforce the right to drinking water enshrined in the Constitution. A major problem exists in the field of wastewater disposal and treatment, water protection, flood safety, etc. An even bigger problem, such as inconsistencies in regulations, is their poor implementation. This paper examines its rationale, purpose and scope under common law, with a focus on the cause of action estoppel and issue estoppel, before looking at its application in the legal system of the Republic of Cyprus. The legitimacy and transparency of the collection and spending of public finances is a sine qua non of democratic governance. To ensure this, it is necessary to take legal action and find specialized mechanisms that have the authority to exercise control and prevent possible abuse of power. These mechanisms are an integral part of the architecture of economic governance and most countries have designed the institution of the Auditor General as the best way to achieve this goal. This institutional mechanism ensures financial and legal control as well as a performance appraisal of the government. They often impose various restrictions on commercial partners (e.g. distributors) by preventing them from using certain sales channels. However, it is difficult to delimit the legality of such sales restrictions. It is very difficult to find an answer to the question of where the appropriate demarcation line should be drawn that determines the violation of competition rules, especially in online sales. Regulation 330/2010 seems not to be tailored to the assessment of restrictions in online distribution channels. The aim of the article is to point out the lack of appropriate tools to assess the restrictions of internet sales. The article shows that there is currently no uniform approach by antitrust authorities, which in turn results in legal uncertainty. Now, the COVID-19 pandemic has made it even more important for many companies and consumers to conduct marketing, buying and selling activities through social media. Like companies, consumers are changing their buying behaviors by focusing more on social media, from which they are providing the necessary and sufficient information about all the products and services that are marketed online. This paper is of particular importance because it addresses the issue of digital marketing activities in the Western Balkans region, specifically the behavior of consumers from countries of this region on social media. Kovač, Marcela Neves Bezerra","doi":"10.18690/lexonomica.12.2.211-242.2020","DOIUrl":"https://doi.org/10.18690/lexonomica.12.2.211-242.2020","url":null,"abstract":"Modern Brazil is plagued by social and economic inequalities, endemic violence, crime, and a weak rule of law. Once these narratives become dependent on each other, all aspects must be worked on to change the scenario the country is facing: insecurity, fear and a lack of opportunities. This paper argues that the unprecedented rise of social injustice in Brazil is not the result of short-term measures but is part of its history marked by economic and social inequalities extending from its colonial past until today and the deficient policies on crime that emerged in the mid-1990s. Moreover, the current massive incarceration, overcrowding of prisons combined with the absence of human living conditions is turning the prison system in Brazil into a gigantic, perpetual school of crime. Investment in education that directly helps to lower the crime rate must be aligned with a new, less repressive and more inclusive punitive policy so as to induce criminals not to return to their unlawful ways. The purpose of the article has been to form a model of management coaching and of the influence of its activities on employee satisfaction based on theory review and field study results. We have confirmed the main hypothesis (H1: Implementing management coaching model positively influences employee satisfaction) and all of the secondary hypotheses (Hi,j: Implementing activity »i« of the management coaching model positively influences factor »j« of employee satisfaction; i = 1, 2, 3, 4, 5; j = 1, 2, 3, 4, 5) with our empirical study, focused on the employees. The topic is of practical value and it will help managers in Slovenia and abroad understand the effect of the activities of coaching on employee satisfaction. Managementski model coachinga in vpliv njegovih aktivnosti na zadovoljstvo zaposlenih V clanku smo poskusali odgovoriti na temeljno raziskovalno vprasanje: Kaksen je potencialni dodatni ucinek na zadovoljstvo zaposlenih z uporabo managementskega modela coachinga in aktivnosti, ki jih zajema model? Namen nasega clanka je na temelju teorije s tega podrocja in spoznanj iz terenske raziskave oblikovati managementski model coachinga in vpliva njegovih aktivnosti na zadovoljstvo zaposlenih. Z empiricno raziskavo smo potrdili glavno hipotezo (H1: Izvajanje managementskega modela coachinga pozitivno vpliva na zadovoljstvo zaposlenih.) in vse pomožne hipoteze (Hi,j – izvajanje i–te aktivnosti managementskega modela coachinga pozitivno vpliva na j–ti dejavnik zadovoljstva zaposlenih; i = 1, 2, 3, 4, 5; j = 1, 2, 3, 4, 5.). The aim of the Brussels I bis Regulation is to ensure creditors a simpler but mostly quicker access to enforcement in case a judgment must be enforced in a state other than the Member State of origin. The new regulatory framework will certainly facilitate quicker access to enforcement for creditors. However, this can only be ensured categorically in the first phase of enforcement, i.e. the seizure of assets (distraint). In subsequent enforcement phases successful enforcement in favour of the creditor could be stayed if the debtor decides to enforce grounds used to challenge the enforceability of a foreign judgment. A major distinction is that the control of enforceability will only proceed if and when the debtor so requests. Razmerje med Uredbo Bruselj I in pravnimi sredstvi, ki jih predvidevajo nacionalne ureditve izvrsilnega prava Prispevek obravnava vpliv Uredb BU I in BU I bis na slovenski izvrsilni postopek. Namen BU I bis je upniku zagotoviti lažji, predvsem pa hitrejsi dostop do izvrsbe v primeru, da je treba sodbo izvrsiti v drugi državi kot v državi izvora. Gotovo bo nova ureditev upniku zagotovila hitrejsi dostop do izvrsbe, vendar to lahko kategoricno zagotovimo le za prvo fazo izvrsbe, to je rubež premoženja. V kasnejsih fazah izvrsitve pa se utegne upniku uspesna izvrsba odložiti, ce se dolžnik odloci uveljavljati razloge, s katerimi bo nasprotoval izvrsljivosti tuje sodne odlocbe.
