Penetapan awal bulan Qamariyah memang merupakan masalah ijtihadiyah karena tidak adanya satu dalilpun baik dari al-Qur’an maupun as-Sunnah yang menjelaskan secara terperinci mengenai cara atau metode penentapan awal bulan Qamariyah tersebut, sehingga banyak para ulama yang berbeda pendapat dalam menafsirkan cara untuk menetapkan tanggal satu pada bulan Qamariyah. Pun juga hasil perhitungan astronomi yang oleh sebagian ahli dikatakan sebagai sesuatu yang pasti atau qoth’i, juga menuai banyak versi sehingga tidak bisa meyakinkan umat untuk menjadikannya sebagai satu-satunya mentode penetapan. According to the author's analysis, the actual themes in it are approaches from various dimensions; from the history, the mechanism of the text, the I'jaz system and the bayan method. Segala aktivitas yang dilakukan oleh Rasulullah saw, sebagian ulama memandang sebagai suatu perbuatan hukum yang harus diamalkan oleh umatnya. tetapi sebagian ulama lainnya berpendapat bahwa yang mempunyai kaitan hukumlah yang ditetapkan sebagai hukum yang harus diamalkan. Sedangkan yang tidak berkaitan dengan hukum dipandang sebagai perbuatan sunnah. Hadis merupakan sumber hukum Islam kedua setelah Alquran yang dijadikan pegangan atau hujjah bagi umat Islam. Oleh karena itu, hadis menjadi pegangan atau hujjah dalam menetapkan suatu hukum yang tidak ada di dalam nash Alquran. Hadis yang dijadikan sumber hukum, para ulama sepakat memberikan kreteria yang ketat, hal ini karena hadis merupakan pedoman bagi umat Islam untuk menjalani dan melaksanakan perintah-perintah Allah baik yang berhubungan dengan ibadah ritual maupun ibadah sosial. Pengetatan yang dilakukan oleh para ulama ini bermaksud agar terhindar dari hadis-hadis palsu yang bertebaran di masyarakat yang dilakukan oleh orang-orang demi kepentingan dirinya dan golongannya. Karena itu para ulama mengklasifikasikan hadis menjadi tiga macam yaitu : hadis shahih, hadis hasan dan hadis dhaif. This is a form of actualizing the values of Islamic teachings so that they can be accepted by humans as a whole. Maintain the sustainability of Islam itself and take greater benefit. \u0000As in Indonesia, with a different context from the east in various aspects such as geography, culture and social psychology of society, demanding that Islamic law be taught must have an elasticity value by leaving a form of inductive and conservative thinking structure. With a historical and philosophical understanding of Islamic law, it will bring progressive changes to the accommodative Islamic law by lokal people without going through opposition and rejection. \u0000Therefore, Indonesia has codified Indonesian-style Islamic law in the form of the Compilation of Islamic Law (KHI) and Law No. 1 of 1974, which are also used by the Religious Courts to decide cases including divorce. Especially if there is a movement to conduct an extension to the community and socialization of Islamic law products that are updated in Indonesia, it will certainly reduce the level of misunderstanding of the community towards divorce status. While the rights and obligations of children as described in Article 4 of the Constitution of child protection are every child has the right to grow and develop and to participate fairly according to the dignity and dignity of humanity and to get protection from violence and discrimination. According to the positive law, rights and obligations of children have been reviewed and determined. The writing of this article examines the rights and obligations of the child's Islamic perspective. The author concludes that child protection can be done by fulfilling the rights of the child that includes the right to live, grow and develop; the right to worship, to think and to express; right to education; the right to express and hear his opinion; and the right to protection from violence and discrimination. The person responsible for the protection of the child is the parents, the school, the community and the state in the guidance of the child during the puberty of religious worship. Worship is a manifestation of faith.
