One of the instruments of Islamic estate planning is trust instrument which is based on Civil Law. The effect of not implementing the trust at an early stage can be seen in the property acquired as it is not managed effectively and indirectly harms the beneficiary. Therefore, this study will try to identify what are the challenges in the implementation of trust, which is not implemented efficiently and looking at the effects of late Islamic estate planning during a lifetime. This study is a qualitative study by analyzing previous articles, related statutes, and looking at the application of trust instrument in trust institutions in Malaysia. To achieve the objectives of this study, the authors conducted interviews with officers at Amanah Raya Berhad (ARB), which is the largest Public Trustee in Malaysia and this year has reached the 100th anniversary of its establishment. The finding of the study found that the trust instrument has significant effects in assisting Islamic estate planning. Indonesia employs deeds registration which refers to the Basic Agrarian Law (BAL) and Malaysia uses a title registration system called the National Land Code (NLC). Indonesia has yet to complete its land registration mandate throughout the country since the mandate was officially introduced in the BAL 1960. While Malaysia has adopted a Torrens system concerning land matters, recognising that land registration is everything. The first part of the paper focuses on beneficial ownership, confidential land ownership data, identifying land registration constraints and strengthening land administration abilities, while the second part focuses on land registration as a legal instrument and land rights ownership affirmation. The main question in this research is to analyse whether the quantity, quality and legal certainty guarantees of land registration are strongly influenced by a well-organised land registration system. Indonesia and Malaysia are still addressing weaknesses in their respective land registration systems based on issues. There is a need for improvement of roles from two main stakeholders, namely the government’s role in streamlining administration and the role of community participation in supporting successful land registration. Charitable trusts and waqfs are methods of facilitating the intergenerational management of family wealth. Both are thought of as estate-planning vehicles, ensuring that assets of the testate go to certain individuals or organizations. However, whereas the trust has expanded its scope to cover the economic field, the waqf in Morocco is still considered a religious exercise. While there are shared features between the Moroccan waqf and the trust, they are conceptually and practically different in many aspects, most importantly in their perception of ownership and their contrasting stances regarding endowment duration. Despite the importance of the trust. The comparative legal methodology has been adopted to study the spirit of the different legal systems. The DVA 1994 uses the term “domestic violence†rather than “intimate partner violence†(IPV). Definition of domestic violence not only describe the types of domestic violence are, it also identifies the victims of domestic violence. Those who fall under the category of domestic violence victims may seek legal protection under the DVA 1994 namely protection orders, compensation and access to a rehabilitation programme. Unlike domestic violence, the term ‘IPV’ is not defined by the DVA 1994. This may raise a question regarding the status of IPV victims on whether they are protected under the said Act. The research examines the definitions of domestic violence and IPV, how the DVA 1994 protects domestic violence victims, and to what extent legal protection is given to IPV victims. This article adopts the doctrinal legal research involving a detailed analysis of the DVA 1994, the Penal Code (Act 574), the Criminal Procedure Code (Act 593) and case law. This research found that the definition of IPV within the DVA 1994 arguably cover only spouses and former spouses, leaving other unmentioned intimate relationships such as cohabitation and dating partner outside of the application of the Act. Sungguhpun begitu, terdapat kajian yang mencukupi bahawa Orang Asli masih dibelenggu dengan isu ekonomi, dihimpit kemiskinan, ketiadaan pengiktirafan hak tanah Orang Asli dan terpinggir dari pembangunan arus perdana. Antara faktornya ialah kelompangan undang-undang dalam Akta Orang Asli 1954 (AOA) dan polisi pembangunan ekonomi Orang Asli sedia ada tidak sepadan dengan keperluan mereka. Oleh yang demikian, objektif utama artikel ini ialah untuk menerangkan isu berkaitan pembangunan ekonomi Orang Asli dan hak ekonomi orang asal di bawah DHOA seterusnya menganalisis pembangunan ekonomi masyarakat Maori di New Zealand dengan merujuk kepada piawaian di bawah DHOA dan undang-undang antarabangsa dengan menggunakan metodologi sosio-perundangan dan menganalisis data secara kualitatif. Artikel ini mendedahkan bahawa kedudukan pengiktirafan hak ekonomi Maori adalah lebih baik dan maju berbanding Orang Asli. Justeru, artikel ini mengemukakan tiga perkara yang wajar dipelajari daripada pengiktirafan hak ekonomi Maori seterusnya mengemukakan empat cadangan dari segi perundangan untuk penambahbaikan pembangunan ekonomi Orang Asli seperti cadangan pindaan AOA, memperkasakan peranan JAKOA dan institusi berkaitan Orang Asli, mengiktiraf nilai, adat dan budaya serta aktiviti ekonomi Orang Asli. Electronic arbitration (e-arbitration) is one of the main online dispute resolution mechanisms, and it should be implemented in Malaysia because of its significant advantages. Unfortunately, the future of e-arbitration in Malaysia is still hazy. Therefore, it is important to examine whether existing Malaysian laws are sufficient to legalise the e-arbitral agreement and e-arbitral proceedings. This article is based on a research carried out for a doctoral degree. Primary and secondary sources were consulted. The novelty of the contribution has provided legal evidence and arguments that the relevant laws in Malaysia were to some extent, modern and advanced to recognise e-arbitration. Karim","doi":"10.32890/uumjls2022.13.1.3","DOIUrl":"https://doi.org/10.32890/uumjls2022.13.1.3","url":null,"abstract":"Emerging as a buzzword, the General Data Protection Regulation (GDPR) has had immense implications on global data protection regimes. The GDPR appears as a worldwide standard for protecting personal data based on the omnibus legal substance, extensive extraterritorial scope, and influential market of the European Union (EU). It resulted in a global wave where countries are either adopting new legislation or modifying existing data privacy laws to comply with the GDPR. Historically, the South Asian region, abode to one-fifth of the world’s people, has strong trade and economic ties with Europe. As reflected in current bilateral or multilateral trade agreements, the EU tends to be one of the largest trading partners of most South Asian countries. Therefore, it is understandable that the EU’s norms, laws, policies, particularly the GDPR, would have far-reaching impacts on South Asian countries. However, the issue has not been yet evaluated in legal academic settings that require an analysis of GDPR’s overview and its impacts on South Asian privacy regimes. The findings of this doctrinal legal study, together with the sharing of a brief overview of the GDPR and South Asian privacy regimes, reiterate the influence of GDPR in this region. The findings of this research also have the prospects to enlighten the stakeholders in understanding the GDPR and its implications on global as well as South Asian privacy regimes. Unfortunately, there are some Muslim countries in the world, including Malaysia, that has legalised this practice. Laws such as the Islamic family laws in all Malaysian states stipulate legal avenues for underage children to get married, provided they obtain permission from the Sharia court. Therefore, in order to end this harmful practice in Malaysian Muslim society, this article will discuss child marriage under Malaysian Islamic family law and propose a legal reform for Islamic family law regarding marriageable age and court procedure. This article examined international law instruments related to child marriage, Malaysian civil and Islamic laws, and reported cases to understand the legal complexities of child marriage in Malaysia. During the emergency period, the government relied heavily on executive-based measures, which operated as a primary instrument to execute the “Winning Hearts and Minds” agenda. The state executive body and its agents had a wide range of powers at its disposal, including indefinite detention without trial and the restriction of residence against terrorist suspects. A similar approach was maintained through various legislations, even after the country gained independence in 1957. However, recent developments indicate a significant change in the attitude of the government. The criminal justice approach begins to gain greater prominence, this being evident from the growing number of prosecutions against terror suspects and the creation of new terrorism-related offences. This paper first examines whether the apparent change is genuine and sustainable in the long term. This concern is connected with the nature and limits of the criminal law and justice system, along with other challenges derived from the existing structure, culture, and practices within the country. By adopting a socio-legal approach, this research also investigates the factors favouring and hindering the criminal justice approach empirically and theoretically as a primary legal response to countering terrorism in Malaysia. The rules imposed by the Financial Services Authority (FSA/ Otoritas Jasa Keuangan/OJK) have aspects of riba that contradict sharia compliance principles. This study determines alternative solutions to unfair practices in conventional Fintech, especially peer-to-peer lending (P2P lending) in Indonesian banking practices. The research uses normative and empirical methods with statutory and empirical data from library research and interviews. The study shows the presence of economic immorality in conventional P2P loan practices, such as maisyir, gharar, riba, dzalim, and haram, which are contrary to Islamic principles. This necessitates the application of primary sharia principles in sharia fintech. Thus, Islamic P2P Lending is an alternative solution to Islamic banking’s financial technology practices for customers using conventional fintech services. This is due to challenges in conventional fintech, including illegal fintech, intimidation in debt financing, high-interest rates, and the use of unlawful personal data.
