{"title":"REFORMULASI KONSTRUKSI PIDANA DALAM MENJERAT PELAKU TINDAK PIDANA KORPORASI","authors":"Yatini, Hari Purwadi, Hartiwiningsih","doi":"10.20961/hpe.v7i1.29208","DOIUrl":"https://doi.org/10.20961/hpe.v7i1.29208","url":null,"abstract":"AbstractThis article aims to analyze the reformulation of corporate criminal responsibility in Indonesia by reviewing the legislation and court rulings as a reference, in a corporate crime not yet the custom of the public prosecutor or court to explore aspects of corporate crime and or ensnare the intellectual perpetrator in corporate crime, in the principle of a criminal act involving a corporation of criminal prosecution can be done, but it is almost never done, so that the process of law enforcement in a corporate crime is committed by committing a general crime, even though the crime of the company is a special crime which must also be dealt with in a special way. The results of this study have not implemented the concept of corporate crime by law enforcement, so that the perpetrators of the corporation avoid the deterrent effect, especially the perpetrators of intellectuals and corporations. This study uses the normative method by reviewing the Law with the help of secondary legal materials in the form of court decisions and other legal doctrines, using deductive and prescriptive analysis. The results show that law enforcers have not been able to enforce the law in relation to criminal offenses involving corporations, corporations that should be trapped with corporate crime are rarely snared because of incomprehension of public prosecutors in the construction of criminal law theory in corporate criminal concepts which has become prevalent in many countries today in both common law and civil law countries.Keywords: Reformulation; Criminal liability; Corporations.AbstrakArtikel ini bertujuan menganalisis reformulasi pertanggungjawaban pidana perusahaan di Indonesia dengan meninjau kembali aturan Perundang-undangan dan Putusan pengadilan sebagai acuan, dalam tindak pidana korporasi belum menjadi kebiasaan jaksa penuntut umum atau pengadilan untuk mengeksplorasi aspek kejahatan perusahaan dan atau menjerat pelaku intelektual dalam kejahatan korporasi, meski dalam prinsip tindak pidana yang melibatkan korporasi penindakan secara pidana dapat dilakukan, namun hampir tidak pernah dilakukan, sehingga proses penegakan hukum dalam tindak pidana korporasi dilakukan dengan melakukan tindak pidana umum, walaupun kejahatan perusahaan adalah kejahatan khusus yang mana juga harus ditangani dengan cara yang khusus. Hasil penelitian ini belum diimplementasikan konsep kejahatan korporasi yang benar oleh penegakan hukum, sehingga para pelaku korporasi terhindar dari efek jera, terutama pelaku intelektual dan korporasinya. Penelitian ini memakai metode normatif dengan mengkaji Undang-undang dengan dibantu bahan-bahan hukum sekunder berupa putusan-putusan pengadilan dan doktrin-doktrin hukum lainnya, dengan memakai analisis deduktif dan preskriptif. This research is a type of normative / doctrinal research using legislation approach and conceptual approach. The problem of this research is the lack of legal norms in Law Number 8 Year 2010 on Prevention and Eradication of Money Laundering Crime so that the recovery of crime victims’ assets can not be fulfilled maximally, although the explanation of the law aims to trace assets and return to the victims . The results of this study indicate that the victim of money laundering crime must take another mechanism in the form of a lawsuit to obtain compensation from the perpetrator, this is different if the predicate offence is corruption, then the assets of the perpetrator can be confiscated and burdened with replacement money. Penelitian ini merupakan jenis penelitian normatif/doktrinal yang menggunakan metode pendekatan perundang-undangan dan pendekatan konseptual. Permasalahan dari penelitian ini adalah adanya kekurangan norma hukum pada Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang sehingga pemulihan aset korban tindak pidana belum dapat dipenuhi secacara maksimal, meskipun penjelasan undang-undang tersebut bertujuan menelusuriaset dan mengembalikan kepada korban. Hasil penelitian ini menunjukan bahwa korban tindak pidana pencucian uang harus menempuh mekanisme lain berupa gugatan ganti kerugian untuk mendapatkan ganti kerugian dari pelaku, hal ini berbeda jika tindak pidana asal adalah korupsi, maka aset pelaku dapat disita dan dibebani uang pengganti. Yang menjadi permasalahan dalam penelitian ini adalah apa saja faktor-faktor yang mempengaruhi proses pengembalian uang pengganti dalam tindak pidana korupsidi Pengadilan Negeri Poso. Penelitian ini merupakan penelitian Soicio Legal. Penelitian ini menggunakan pendekatan kasus dan konsep, sedangkan teknik pengumpulan data dilakukan dengan cara inventarisasi cara meneliti studi kasus dan studi pustaka atau data sekunder belaka. Hasil penelitian menunjukan bahwa dilakukannya pemberantasan tindak tidana korupsi seharusnyatidak semata-mata bertujuan untukmenghukum pelaku korupsi dengan pidana penjara, tetapi yang tidak kalah pentingnya adalah penghukuman kepada pelaku untuk pengembalian keuangan negara akibat kerugian negara yang ditimbulkan dalam tindak pidana korupsi. Dalam beberapa kasus, pengembalian keuangan negara tidak dapat dilakukan secara efektiv, hal ini disebabkan oleh beberapa faktor, diantaramya faktor undang-undangnya, faktor penegak hukum, faktor fasilitas dan faktor masyarakat. Since the first world of law science has been colored by contemplation of legal thought. One of the most influential streams in the development of the Indonesian legal system is the flow of positivism or analytical positivism or rechtsdogmatiek. This research is normative law research. This research is approaching case and concept while its data collecting technique is done by researching case study and literature study or secondary data only. . If the result of research done by writer with inductive, deductive, analogy, paroductive method is that it can be concluded that judge in Indonesia is a posistivisme adherent. It is proved that judges in Indonesia make decisions only by law. And do not see any other legal eyes. In general criminal cases 55% of Supreme Court judges use Deductive methods and 30% use Analogy, 25% use parduksi and 5% using other methods. And in Special Crimes 80% of judges use deductive, 15% using Analogy and 5% using other methods. Thus, if combined between Special and Criminal Crimes, the Judges in the Supreme Court 70% use deductive and the rest use analogies, deductions and other methods. Awriter concludes that the judge in the Supreme Court in pursuing a criminal case during 2017 embraces a positivist paradigm.Keywords: Paradigm; Judge; Deciding Criminal Case.AbstrakPenelitian ini bertujuan untuk menilai cara berpikir hakim dalam memutuskan perkara-perkara pidana di Indonesia. Sejak dahulu dunia ilmu hukum telah diwarnai oleh kontestasi pemikiran hukum. Salah satu aliran yang sangat berpengaruh dalam perkembangan sistem hukum Indonesia adalah aliran positivisme atau analyticalpositivism atau rechtsdogmatiek. Penelitian ini merupakan penelitian hukum normatif. Penelitian ini melakukan pendekatan kasus dan konsep sedangkan Teknik pengumpulan datanya dengan dilakukan dengan cara meneliti studi kasus dan studi pustaka atau data sekunder belaka. .Jika dilihat hasil peneilitian yang dilakukan penulis dengan metode Induktif, deduktif, analogi, paroduktif adalah bahwa bisa disimpulkan bahwa hakim di Indonesia adalah penganut posistivisme. Dengan dibuktikan bahwa hakim di Indonesia melakukan putusan hanya berdasarkan undang-undang. Dan tidak melihat kaca mata hukum lain. Dalam perkara pidana umum 55% hakim Mahkamah Agung menggunakan metode Deduktif dan 30% menggunakan Analogi, 25% menggunakan parduksi dan 5% menggunakan metode lain. Dan didalam pidana Khusus 80% hakim menggunakan deduktif, 15% menggunakan Analogi dan 5% menggunakan metode lain. Sehingga jika digabungkan antara pidana Khusus dan pidana Umum Hakim di Mahkamah Agung 70% menggunakan deduktif dan sebagagian lainnya menggunakan analogi, deduktif dan metode lain. Sehinggga penulis menyimpulkan bahwa hakim di Mahkamah Agung dalam meutuskan perkara pidana selama tahun 2017 menganut paradigma positivisme. Metode pengumpulan data melalui Wawancara dan metode Studi Pustaka. Analisis data dengan model analisis interaktif. Penelitian menunjukkan bahwa Kebijakan yang dilakukan oleh Polres Boyolali dalam Pengendalian Peredaran Minuman Beralkohol dalam mencegah meningkatnya tindak Pidana Kriminal berupa kebijakan kepolsian bersifat preventif maupun represif. Aspek preventif yaitu melakukan upaya pencegahan agar tindak kejahatan tidak terjadi dengan adanya dukungan serta partisipasi aktif dari masyarakat. Berdasarkan bentuknya penelitian ini termasuk dalam evaluatif, yaitu “suatu bentuk penelitian yang dimaksudkan untuk menilai suatu program kerja. Teori yang dipakai untuk analisis dalam penelitian ini adalah teori dari Lawrence M. Friedman dengan tiga struktur hukumnya, dari analisis diketahui bahwa kinerja para pegawai di lingkungan sekretariat daerah Dewan perwakilan daerah kabupaten ngawi cukup baik namun perlu banyak inovasi baru dan peningkatan dibeberapa aspek, di kedua aspek hukum dalam teori struktur hukum dari friedman didapatkan bahwa hanya dalam aspek dari unsur kultur hukum saja yang tidak sesuai implementasi Peraturan Pemerintah Nomor 18 Tahun 2016 tentang Perangkat Daerah di Kabupaten Ngawi kurang mampu meningkatkan efektivitas kinerja pegawai Sekretariat DPRD Kabupaten Ngawi. The purpose of this paper is to know the legal protection of shipping companies contained in sea transport agreements. Data collection technique is literature study with statute approach method, the instrument of this research is the Book of Trade Law Act, Law Number 17 Year 2008 concerning Shipping and related legislation, as well as sea transport documents. The result of the research shows that every sea freight shipping company (EMKL) has procedures and requirements in transporting goods by sea, legal protection against shipping companies contained in sea transport agreement there are 2 (two) properties that is preventive and repressive. Hasil penelitian menunjukan bahwa setiap perusahaan ekspedisi muatan kapal laut (EMKL) memiliki prosedur dan persyaratan dalam mengangkut barang melalui laut, perlindungan hukum terhadap perusahaan ekspeditur yang dimuat dalam perjanjian pengangkutan laut terdapat 2(dua) sifat yaitu preventif dan represif. This research is an empirical legal research supported by approach of law and case approach. The results showed that the total area of mangrove forest based on the function in Pohuwato Regency are 15,600,81 ha while the mangrove forest area that has been converted into dyke is 7,679.64 ha. In Local Regulation No. 13 of 2013 on Mangrove Ecosystem Management determines the area that can be used as a pond business, namely limited protected area of no more than 5 percent of the total area and fishery cultivation area contained in other areas of use. From the data obtained all the ponds in the mangrove forest area does not have the environmental permit required by Law Number 32 Year 2009 on Environmental Protection and Management.Keywords: The Law Enforcement Administration, Mangrove Forest Function Transfer, Environmentally Friendly Development AbstrakTulisan ini bertujuan untuk mengetahui penegakan hukum administrasi terhadap alih fungsi hutan mangrove di Kabupaten Pohuwato dengan mengacu pada ketentuan Pasal 36 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, Peraturan Pemerintah Nomor 27 Tahun 2012 tentang Izin Lingkungan dan Peraturan Daerah Nomor 13 Tahun 2013 tentang Pengelolaan Ekosistem Mangrove. Penelitian ini merupakan penelitian hukum empiris didukung pendekatan perudang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan dari total luas kawasan hutan mangrove berdasarkan fungsi di Kabupaten Pohuwato yaitu 15.600,81 Ha sedangkan kawasan hutan mangrove yang sudah beralih fungsi menjadi usaha tambak yaitu 7.679,64 ha. Dalam Perda Nomor 13 Tahun 2013 tentang Pengelolaan Ekosistem Mangrove menentukan kawasan yang bisa dijadikan usaha tambak yaitu kawasan lindung terbatas tidak lebih dari 5 persen total kawasan dan kawasan budidaya perikanan yang terdapat di areal penggunaan lain. The method employed in this research was normative one, the method using primary law materials including legislations and secondary law materials or literature including legal principles, legal procedure, vertical and horizontal synchronization (interrelated legislations). This research employed statute approach with comparative analysis on law concepts. The statute approach was carried put by studying regulation or legislation related to legal issues, in this case, the role of TNI in eradicating terrorism in the State Defense and Security perspective to be analyzed. The result of research showed that the identification of legislation about terrorism eradication by TNI (Indonesian Army) still had relevance to the following law: Article 30 of UUD 1945 (1945 Constitution), Republic of Indonesia Police’s Law No. 22 of 2002, Law about Terrorism Crime No.15 of 2003, TNI (Indonesian Army) Law No.34 of 2004 and State Defense Law No.3 of 2002. The politics of law built by government should be able to create a responsive law product corresponding to t he ideals of Indonesian law as included in the 4th paragraph of Preamble of 1945 Constitution.Keywords: TNI, politics of law, terrorism, defense and security AbstrakPenelitian ini bertujuan untuk menganalisis identifikasi peraturan perundang-undangan tentang pemberantasan terorisme oleh TNI,kemudian mengkaji bagaimana politik hukum yangdibangun pemerintah tentang kebijakan pemberantasan terorisme oleh TNI ditinjau dari aspek pertahanan dan keamanan Negara.Metode yang digunakan dalam penelitian ini adalah metode penelitian normatif,yaitu metode yang menggunakan bahan bahan hukum primer seperti peraturan perundang- undangan dan bahan hukum sekunder atau kepustakaan,mencakup asas-asas hukum, sistematik hukum, sinkronisasi vertical dan horizontal(peraturan perundang-undangan yang berkaitan).Penelitian ini menggunakan metode pendekatan perundang-undangan,analisa konsep hukum,perbandingan hukum.
