Based on an online survey study of over 800 individuals engaged in illegal small-scale cannabis cultivation in Denmark, this article focuses on the online recruitment methods used to access this allegedly »hidden« population. In the article, we critically reflect about the concepts of »hidden-« and »hard to reach« populations, and argue that small-scale cannabis growers are best understood as a group that is »accessible when approached with the right means«. More specifically, we outline the challenges involved in recruiting participants for an online survey that focuses on their criminal activities, and we provide insights into the different recruitment- and trust-building strategies used in this process. Møller","doi":"10.7146/ntfk.v109i3.134402","DOIUrl":"https://doi.org/10.7146/ntfk.v109i3.134402","url":null,"abstract":"AbstractOn 1 September 2021, the Danish Supreme Court banned the gang Loyal to Familia (LTF) because it had an illegal aim and was therefore classified as an illegal association. This sentence marks a new understanding of the material limits to the constitutional freedom of association. It was the third ban of a Danish association, and the first ban of an association that did not have the aim of overthrowing democracy.\u0000Using court transcripts, this article describes the contents and major themes in the evidence presented by the prosecutor. The gang’s organisation was structured and hierarchical as based on recovered documents described as containing membership lists, titles, fees and collective economic resources. Members committed a broad range of serious violent and drug-related offenses. Incarrcerated members of the gang violently attacked prison guards. In two instances, these attacks occurred outside of prisons on the behest of the gang.\u0000The courts agreed that the gang itself facilitated some of the violence and drug offending. While their motivations differed, all three courts agreed that Danish society had a constitutional right. This unique situation can be perceived as a natural experiment. What happens to the number of burglaries in private residences, businesses/companies, institutions, and holiday homes when many employees work from home and children receive online education? What are we to expect based on criminological theories and what happened in practice? Theory would predict a decrease in the number of burglaries in private homes and an increase in the number of burglaries in companies and institutions. In reality – at least in Denmark – there was a decline in all forms of burglary. A law against degrading and coercive behavior among close relations was introduced to the Danish Penal Code under § 243 in 2019 to protect victims of this form of violence.\u0000This article investigates the application of the new law and discusses its possibilities and limitations. Using mixed methods, we examine 631 police reports and 29 court transcripts. Our analysis allows us to characterize the most frequent types of cases that arise within the criminal justice system. This is possible due to our collaboration with the Danish police, who have provided us with information on every reported case of psychological violence in Denmark.\u0000The analysis shows that the new law is difficult to apply and that it has resulted in very few convictions this far. Furthermore, the convictions obtained reflect only a narrow range of the behaviours the new law is designed to address. All 10 convictions concern a male perpetrator battering a female partner. Cases that did not result in conviction concern a much broader range of psychological violence.\u0000The criminal justice approach to the problem of psychological violence has been unsuccessful so far in meeting its objective of protecting victims. The main challenge is the many legal requirements of the law which leave significant discretion to the police, prosecution and the courts.
