It focuses on the 74 volumes of The Case on the Transformation of the Judiciary in Russia compiled by Sergei Zarudny, one of the reform developers. The author analyzed the role of individual participants in the development and implementation of the reform. The subjective factor proved to be the main criterion in drafting the reform of the Judicial Statutes in 1864. The preparatory process included two stages and combined the focus on domestic experience and traditions with foreign innovations. Together, these two approaches made it possible to accumulate the domestic legal experience with some useful trends from abroad, which resulted in effective new courts and a perfect judicial system. The reform of 1864 owed its success to the universal principles and institutions introduced into the Russian legal system in the second half of the XIX century. {"title":"Lay Participation in Modern Slavic States","authors":"A. The methodological basis included general methods of cognition, as well as comparative the legal method (micro-comparison, diachronic, synchronic), the problem-chronological method, and the formal-legal method. The comparison was based on two main models of lay participation. The Shöffen model presupposes a collegium of a professional judge and non-professional assessors. The jury are independent from the judge and resolve issues of the fact of guilt or innocence, thereby formulating an acquittal or accusatory verdict. The study determined the widespread refusal of lay participation in justice in civil proceedings and its preservation as part of criminal trials in a special category of major crimes. Most Slavic states maintained the pattern of a judge and people’s assessors, which was established in the XX century in the countries of people's democracy. It also contains a diachronic review of related scientific publications. The author defined the phenomenon of attention, the factors that affect school performance, and the specifics of attention span in boys and girls. A new diagnostic toolkit with a set of techniques made it possible to assess such indicators as volume, stability, selectivity, distribution, and set-shifting. {"title":"Culture, History, and Inheritance Law: a Comparative Legal Analysis","authors":"V. As a result, it reflects the cultural and historical type of the society and is very conservative. In fact, it contains a lot of archaic norms that express out-of-date social relations. However, inheritance law is extremely reluctant to get rid of these legal anachronisms, probably, because their rigorism reflects the national identity of the people. The present research used the civilizational classification of legal systems developed by N. Ya. Danilevsky and applied it to the inheritance law as the most conservative sub-branch of civil law. After comparing Russian and Anglo-American inheritance laws, the author proved that each state adheres to its cultural and historical type by preserving some archaic institutions. These institutions lost their social relevance long ago but survived as a formal reflection of a once-relevant rigorous moral code. This study involved 57 university students from the Pacific National University. They worked with methodological texts to determine the topic, write a secondary text, create a cinquain, formulate hypotheses, and project the new material onto their own academic experience. The article introduces a new subjective approach to teaching text comprehension to university students. The approach is based on psychological foundations and the interaction between teaching staff and students. It develops the ability to generate new meaning and relations, as well as to classify various phenomena. The article also reveals the ways of understanding a text as a sign complex and offers some new diagnostic methods that treat text comprehension both as a process and a result. The authors also identified empirical indicators to control the dynamics of comprehension development. This article focuses on the concept of digitalization in court. The author analyzed the documents that regulate the digitalization in the Russian judicial system and assessed its result, e.g., in the sphere of interaction with trial participants. The article clarifies the correlation between automation, informatization, and digitalization and describes the trends, stages, and achievements in the digital development of the judicial system in the light of federal targeted programs. The author believes that the terms related to the digitalization of the legal system still have a vague status because they exist at the intersection of the procedural branches of general law and information law. Automation makes it possible to monitor trials and prevent violations of deadlines. Digital information about courts and trials may encourage citizens for a more active interaction with the judicial system. Unfortunately, the digital transformation of Russian courts is at its earliest stage and has a long way to go. The author used the comparative legal method, e.g., the method of normative comparison, to compare the education laws in East Germany and the USSR. The state regulation of education started in East Germany in the pre-republic period. The period of 1945–1949 saw a ban of private schools, a single structure for all comprehensive schools, and a stipulation of equal rights to education. The constitution of the German Democratic Republic, which appeared in 1949, enshrined these norms at the statutory level. However, the new Constitution inherited a lot from the Weimar Constitution. The consolidation of education rights in the Constitution of 1968 differed from the variant of 1949. The Constitution of 1968 did not follow the education model of the Soviet Constitutions of 1936 and 1977, which were almost identical in structure and content. A controlled future is a phenomenon at the intersection of internality and emotional response. The relationship between the level of internality and emotional response was analyzed at two levels. The first level featured stable personality traits. They were identified using standard personality questionnaires, namely the Standard Personality Traits Questionnaire modified by E. G. Ksenofontov and C. Izard’s Differential Emotions Scale adapted by A. V. Leonov and M. S. Kapitsa. The second level featured situational personal traits manifested in particular situations as a general state of emotional comfort or discomfort. The authors developed a questionnaire that included six types of situations, each of which had three response options. The first option presupposed a passive (external) position, i.e., waiting for help from others. The second option described an active (internal) position. The third option was intermediate (50/50). Each behavioral option required an assessment of emotional comfort. At the level of subjective-personal traits, the general level of personal internality determined the readiness for action and overcoming difficulties, often associated with negative emotional experiences. A lower readiness for action and transformation triggered stronger negative emotions. The level of situational behavior demonstrated a similar trend: a lower control over the situation was associated with a greater emotional discomfort. However, the relationship between control and emotional comfort was not linear. The idea of kin is embedded in many concepts of Russian culture, directly or indirectly indicating the mental schemes they have in common. However, the macro-concept of kin has received no comprehensive analysis of its associative-figurative layer. The author described the signs behind the motivation of the macro-concept kin using the proverbs from V. I. Dahl’s dictionary that contain the national-cultural layer of its figurative transformation. The methodology involved an analysis of dictionary definitions, as well as descriptive and interpretive methods. The proverbs described the idea of kin by highlighting such signs as origin, heredity, and kinship as belonging to a community of people with some permanent and distinctive features. The analysis revealed a group of proverbs about kin and tribe with three motivating features: heredity, human nature, and social characteristics. The macro-concept of kin was described through a figurative comparison of images: a person (father, mother, children), religious symbols (god), animals, symbols of nature, fairy-tale characters (fool), parts of body (palm, fist). In the national collective consciousness, the macro-concept obtained various motivating signs that actualize the following schemes: native place, native environment, kinship, family, tribe, people, generation; intra-family or intra-tribal relationships; rules, customs, traditions of the kin; attitude to the motherland; attitude to faith, God, the power of kin; military community. This article provides a theoretical substantiation of the place that emotional readiness occupies in the structure of psychological readiness. Professional emotional readiness includes emotional awareness, coping with one’s own emotions and with those of others, empathy, and self-motivation. The research revealed various emotional manifestations of psychological readiness in university students that majored in journalism at different years of study. The study included an experiment that proved the beneficial impact of student journalism as part of academic and extracurricular media projects, especially those connected with filming. The undergraduates that participated in such activities proved able to cope with emotions and demonstrated a better emotional awareness and empathy. However, they proved unable to cope with other people’s emotions and had a low self-motivation. These problems might be associated with insufficient life and professional experience. Therefore, the emotional development of future journalists requires a comprehensive program of psychological and pedagogical support at different stages of university education.
