Ita, Ayu Trisna Dewi, Rina Melati Sitompul","doi":"10.46576/lj.v3i1.2296","DOIUrl":"https://doi.org/10.46576/lj.v3i1.2296","url":null,"abstract":"ABSTRACTThe thing which is the most disadvantaged party is the debtor, but it is possible that the bank as the creditor will also suffer losses from these problems.The problem in this research is how to regulate the law regardingthe debtor in the working capital credit agreement, how is the settlement process if the debtor is in default and how is the Judge's Consideration in Decision No. 466/Pdt/2020/PT MDN. This research method uses normative legal research and analytical descriptive research.The results of this study, legal arrangements regarding debtors in credit agreementsworking capital based on the provisions of Article 1338 of the Civil Code. The process of settling debtors with outstanding performance in a credit agreement can be carried out by saving credit through rescheduling, reconditioning and restructuring. Furthermore,settlement of credit by means of the execution of the executive title by the creditor, sale of objects to be objects of collateral through auctions, sales of collateral in underhand. Data analysis to be carried out in this study is a qualitative analysis.The purpose of the legal implications of the debtor is to transfer the object of collateral fiduciary to a third party in a financing agreement, resulting in the fiduciary agreement becomes null because in the fiduciary agreement the object Fiduciary guarantee is one of the important elements of a fiduciary agreement there is a legal consequence if an object of the fiduciary guarantee is lose their property rights.Legal protection for creditors in a fiduciary guarantee agreement born from the making of a deed of imposition of a fiduciary guarantee made notarial, and continues to be confirmed by registration with the Fiduciary Registration Officein order to obtain a fiduciary certificate. This research method uses empirical legal research and descriptive analytical research.If the customer has exceeded the promised time limit, the customer will get (bad RO) and the customer will also be blacklisted from the company and will not be able to apply for credit withdrawal at any leasing company or dealer he wants to take credit for. If the customer makes payments smoothly and there are no obstacles, the customer will have a good position. Settlement of disputes in leasing contracts can be done in two ways, namely through court and out of court. Implementation of the trial based on court decisions or the decision of the Constitutional Court no. 18/PUU-XVII-2019 there has been no confiscation by PT. FIF. Determination of court confiscation to withdraw the object of leasing as determined by the Constitutional Court (MK). Secara khusus, tujuan penelitian adalah mendeskripsikan dan menganalisis materi muatan draf Peraturan Gubernur Sumatera Utara tentang Pedoman, Pembinaan dan Pengawasan BUM Desa berdasarkan kondisi eksisting dan permasalahan BUM Desa di Sumatera Utara. Kajian merupakan penelitian kualitatif yang menggabungkan penelitian hukum dan sosial. Kajian dilakukan di Deli Serdang, Serdang Bedagai, Dairi, Langkat, Asahan, dan Karo. Draf Peraturan Gubernur Sumatera Utara tentang Pedoman, Pembinaan, dan Pengawasan BUM Desa di Sumatera Utara dirancang menjadi 10 BAB, dengan rincian: 1 BAB tentang Ketentuan Umum; 1 BAB tentang Maksud, Tujuan, dan Ruang Lingkup Peraturan Gubernur; 7 BAB tentang materi muatan Peraturan Gubernur; dan 1 BAB tentang Ketentuan Penutup. Adapun ruang lingkup materi muatan Peraturan Gubernur ini adalah: 1) pendirian Bum Desa/Bum Desa Bersama; 2) pembinaan dan pengawasan Bum Desa/Bum Desa Bersama; 3) kepemilikan, modal, aset, dan pinjaman Bum Desa/Bum Desa Bersama; 4) tanggung jawab sosial dan pembagian hasil usaha Bum Desa/Bum Desa Bersama; 5) pertanggungjawaban Bum Desa/Bum Desa Bersama; 6) klasifikasi perkembangan Bum Desa/Bum Desa Bersama; dan 7) bentuk badan hukum dan kerjasama Bum Desa/Bum Desa Bersama. Sebagaimana contoh kasus dalam penelitian ini, pencabulan yang dilakukan oleh Ayah Kandung terhadap anaknya, dimana saudara kandungnya ikut dalam pencabulan. Mengangkat topik penelitian terhadap Laporan Polisi No. 222/XI/SU/2019/Res.Tapteng tentang tindak pidana pencabulan dengan permasalahan yang dikaji pengaturan hukum tentang perlindungan hukum bagi Anak Korban tindak pidana pencabulan dalam tahap penyelidikan dan penyidikannya; Proses penyelidikan dan penyidikan Laporan Polisi tersebut; dan upaya yang dilakukan Penyidik Satreskrim Polres Tapteng dan instansi-instansi terkait. Penelitian merupakan penelitian hukum normatif bersifat deskriptif, selanjutnya dianalisis dengan metode analisis kualitatif. Disimpulkan dalam penyelidikan dan penyidikan terhadap tindak pidana pencabulan terhadap Anak Korban oleh keluarga kerap mengalami kendala, salah satunya kendala biaya dan sulitnya mengumpulkan bukti-bukti dan saksi-saksi karena keluarga sulit untuk dimintai keteranga. Upaya yang dilakukan oleh penyidik yakni Polres Tapteng berdasarkan kebijakan kriminal dengan pendekatan represif jugan mempercepat pemberkasan perkara guna mampu dilimpahkan ke Kejaksaan Negeri Sibolga. Pemerintah berencana tidak hanya untuk pembagian tanah tetapi juga untuk memajukan kondisi ekonomi masyarakat. Arah kebijakan tersebut tertuang dalam Perpres No. 2/2015 tentang RPJMN (Rencana Pembangunan Jangka Menengah Nasional) 2015-2019. Permasalahannya adalah: bagaimana pelaksanaan program Nawacita menuju redistribusi sembilan juta tanah di SUMUT (Sumatera Utara), mengapa program ini tidak sesuai dengan target di SUMUT, dan bagaimana upaya yang dilakukan oleh BPN (Badan Pertanahan Nasional) SUMUT untuk menangani program redistribusi sembilan juta hektar lahan yang tidak sesuai dengan target di SUMUT.Penelitian ini menggunakan metode yuridis nomiatif dengan pendekatan deskriptif analitik. Pengumpulan data sekunder dilakukan dengan melakukan wawancara dengan Bapak Marulam Siahaan sebagai narasumber dan dari data redistribusi tanah periode 2015-2018 di BPN SUMUT. Teori yang digunakan dalam penelitian ini adalah teori kepastian hukum dan teori keadilan.Hasil menunjukkan bahwa program tersebut belum terlaksana karena pemerintah hanya mendaftarkan tanah yang telah dimiliki oleh masyarakat tanpa sertifikat kepemilikan. Faktor penghambatnya adalah: kurangnya sumber daya manusia, kurangnya peta lahan, deforestasi, kurangnya koordinasi antar kementerian terkait, keterlambatan dalam mengeluarkan peraturan, dan konflik agraria. BPN SUMUT berupaya melakukan verifikasi data, peningkatan SDM, dan penyediaan peralatan untuk praktek teknis di lapangan. Disarankan agar substansi pelaksanaannya disesuaikan dengan kemampuan pemerintah dan kondisi di lapangan dibiasakan dengan pelaksanaan program Nawacita tentang redistribusi tanah. This problem is certainly an important legal issue to be researched. Based on this, this study aims to examine and analyze the humanitarian law arrangements against Russia's armed attack on Ukraine. The research conducted in this paper is a type of doctrinal research. The conclusion is that based on international humanitarian law arrangements such as the Geneva Conventions, Additional Protocol I 1997 provides protection for civilians and civilian objects in times of war. Russia's act of armed attack is a violation of international humanitarian law. It is hoped that proactive actions from the United Nations will be neutral by carrying out a peaceful settlement. The law stipulates the principle of equality before the law. There are various problems in law enforcement. These problems have led to the failure to observe the principle of equality before the law. Just as the persecution suffered by Sarpan, the police admitted that they were the perpetrators of the murder. This is different from the case of Napoleón Bonarparte and Prasetijo Utomo, the suspect of bribery to remove red notice warrant of Djoko Tjandra. In this case, Djoko Tjandra had lunch with the head of the prosecutor's office. This research is significant considering the widespread practice of law enforcement that underestimates the principle of equality before the law, so it will not discriminate against everyone when applying the law in the future. This study uses the non-doctrinal reaserch because it examines laws and regulations and their implementation to the people. From this research, it is found that due to the problems of laws and regulations that are unsuitable for the people, lacked of ethics, beliefs, resources, and transparency in the screening of order agents, the principle of equality before the law has not been implemented, and there is inconsistency in the application of the law Integration leading to the decline in public trust to the law . It is necessary to find a way that can bring together the parties involved to peacefully resolve environmental disputes. The purpose of this study is to strengthen rembugan as a mediation model for resolving pollution disputes in the old industrial area. This research is qualitative research with a socio-legal approach, by conceptualizing law as non-doctrinal. The results showed that rembugan is a community culture in dispute resolution that reflects the values of local wisdom possessed by the Purbalingga community, namely the attitude of the parties to accept and use consensus methods in dispute resolution. The purpose of rembugan is to achieve harmony and togetherness. The mediator is the Environment Agency (DLH) and Village Head (Kepala Desa). Strengthening rembugan position in the dispute resolution model is supported by Purbalingga community culture, whose characters are honest, free, open, egalitarian, and accepting of consensus.
