{"title":"O wpływie integracji europejskiej na proces ponownej centralizacji włoskiej administracji samorządów lokalnych","authors":"Gian Candido De Martin","doi":"10.12775/TSP-W.2018.001","DOIUrl":"https://doi.org/10.12775/TSP-W.2018.001","url":null,"abstract":"This article examines how European integration has impacted the Italian Public Administration. The author points out that there are some striking similarities between the administrative unification of the country in 1865 and current administrative consolidation triggered by the European integration process. Under the influence of European policies there has been a clear transformation of the Italian regional and local self-government. The Constitution of the Italian Republic, approved in 1947, guarantees both local self-government and the subsidiarity principle and for a long time European integration has long been conducive to the implementation of these principles. This process was discontinued, however, after the adoption of a new fiscal compact in 2011, which forced Italy to introduce a number of structural reforms. The power vested in them is in fact closely connected to such universal values as justice, freedom or equality. The public interest in maintaining citizens' trust in the institutions of the judiciary obliges the legislator to establish certain ethical requirements for the judges. They are to ensure that the judiciary is in the hand of people with appropriate knowledge, high ethical standards and proper dose of life experience. Though later framed as ‘an authentic American genius’, his early books were rejected by major US publishing houses and his whole literary career followed a strange destiny. {"title":"Nadal sami? Europejskie zobowiązania praw człowieka Włoch w konfrontacji z kryzysem migracyjnym","authors":"Bożena Gronowska, P. Sadowski","doi":"10.12775/TSP-W.2018.009","DOIUrl":"https://doi.org/10.12775/TSP-W.2018.009","url":null,"abstract":"This article explores legal consequences arising from Italy’s European human rights legal commitments in confrontation with the migration crisis. The so-called Arab Spring resulted in a great influx of illegal migrants who, from obvious reasons, chose mainly the territory of Italy as the first safe space for their living or as a transit country. At the beginning the process did not seem to become such a disaster and human rights drama. The main purpose of the Authors’ analysis is to present the attitude of two main human rights organs of the Council of Europe, namely the European Court of Human Rights as well as the Committee on the Prevention of Torture, Inhuman or Degrading Treatment or Punishment. Against the background of the analysed documents the Authors try not only to present the above-mentioned legal consequences, but also discuss the further role of Italy in the ongoing migration crisis.
