One invokes fellow playwrights of the same generation with somewhat similar ethnic and cultural backgrounds because the artistic differences, as well as affinities, are worth attention. All three, initially responsive to the importance of family ties, responsibilities to a particular community, and to that larger entity that might be called the socially disadvantaged (a huge and multifarious group of victims in the Depression of the 1930's whose plight was brought home forcefully to each of the three writers at a crucial period in their lives), became politically conscious urban playwrights. Each in their youth absorbed from their environment the conviction that society not only could, but must be changed and that art, particularly drama, could be a significant agent of that change. The idealistic, predominantly leftleaning ethos of the Group Theater in the late-1930's probably comes closest to embodying the shared desire of all three to realize the exciting aesthetic as well as political hope of creating a new kind of \"prophetic\" theater. Subsequently, there has been a wide divergence, ideologically and biographically. Odets, turning his back on an earlier revolutionary optimism, wrote more cynically for a mostly commercial market in later years. Miller, disillusioned politically but still guardedly optimistic, has remained a socially responsive dramatist who continues to believe (as does Stavis) that human beings are inescapably social and that it is impossible to understand an individual without understanding his or her social context. Unlike Stavis, however, Miller appears to have lost the belief that he once possessed in the prophetic possibilities of the modern theater. Alone of the three writers, Stavis has remained a reformer writing primarily about reformers. Like Bertolt Brecht in this respect, he not only wants to alert spectators to the continuing need for change but to attune his art to the processes that make for its perpetual operation. The dissatisfaction growing throughout society has finally succeeded in mobilizing the Party membership, in stirring the apparatus out of its quiescence, and in reaching the summit of power. Within the week, new elections to the top leadership of the Hungarian Socialist Workers' Party will be held. Today there exists no mechanism in this country for the people to elect or recall its leaders. The people won't be voting next week, yet it is the people who have forced next week's special election. They have voted no confidence in government by a leadership which has not been elected. We must not expect rapid far-reaching change. Democracy will not simply drop into our laps; we will have to struggle long and hard to achieve it, step by step. For this reason I consider it of the utmost importance to look objectively at the situation and at ourselves before the struggle begins. Frankly, I find such past efforts to be woefully inadequate. Hitler and Stalin habitually murdered writers who offended them, the Gang of Four went after the writers and poets of China, and of course, Latin American generals, to this moment, take turns outdoing each other in the peculiar sport. Iran itself under the rule of detested Shah Palavi, who was installed in a coup staged and funded by the CIA, committed writers and other Islamic intellectuals to prison without trial and then routinely tortured and murdered them. In fact, such excesses of secular dictatorship led to the Iranian revolution under the leadership of the Ayatollah Khomeini. So in this century at least, we in the West tend not to think of the killing of writers as a particularly religious thing to do. Islam is a great worldwide faith. An Outsider can imagine a writer's blasphemy against it as a profound sacrilege, and at the same time wonder why the blasphemer cannot be recovered for the faith under the instruction of the clergy. We have to wonder why the blasphemy must be the occasion for the writer's contract murder rather than his enlightenment by means of serene spiritual counsel that would lead him through his penitence and remorse to true piety and possibly redemption. Even if such a course were not possible, one thinks surely the mechanism of excommunication, the most extreme punishment in the language of religion, would be the preferred theological version of the death sentence without trial, which has been established in this century as the technique of the profane tyrannies. The great religions endure by their magnanimity of embrace. This is part of their truth, their embrace of the wretched fallibility of each of us, so that we may hope to live in some state of worshipful reconciliation with our maker. To go with God, to apprehend what is sacred, to live in clear spiritual resolution, is the desire of every human being of whatever faith. Though unofficial activity did, of course, take place before 1977, there is no denying that the formation of Charter 77 had a decisive influence on the entire independent realm. In 1977, after nearly 30 years of communist rule, after the \"normalization\" that followed the 1968 invasion, Czechoslovak society was paralyzed. The creation of Charter reestablished a public domain independent of the government and beyond the reach of government manipulation; within the confines of a totalitarian system, a \"parallel polis\" was founded. To the surprise of nay-sayers and skeptics, the parallel polis has proved to be extremely resilient. Recent events suggest that communist ideologues intent on crushing independent movements will themselves be consigned to the garbage dump of history they had envisioned for the opposition. Human rights, a theoretical cornerstone of Eastern Europe's independent initiatives, are no longer the concern of a minority at the fringes of society, but are now at the very center of domestic and international politics. Across Eastern Europe, the holders of power face the prospect of having to abandon their totalitarian principles or watch the foundations of their power slowly crumble beneath them. Tritter","doi":"10.2307/27670185","DOIUrl":"https://doi.org/10.2307/27670185","url":null,"abstract":"Less than a score of years ago, my welcoming toast would have semed an impudent conceit both in the world of the law and in the world of literature. Law school curriculum committees viewed a course in Law and Literature as a frill in the rigor of traditional legal studies; likewise, literature departments found much to contemplate as to the interrelation but did not yet consider it a true sub-specialty. Now, such courses are offered in the majority of American law schools (and no small number abroad), and literary critics and theoreticians are heavily involved in the discourse. So the world moves swiftly. With the inspiration of J. Allen Smith, then of the Rutgers Law faculty, and with the energy of Richard H. Weisberg of the fledgling Benjamin N. Cardozo School, the Law and Humanities Institute was born in 1979. In its first salvo, LHI announced as an early goal the publication of a scholarly journal dedi cated to the cross-fertilization of those twin disciplines, law and litera ture. In subsequent years, LHI has staged annual international sympo sia and frequent local gatherings on topics of interest not only to scholars, but to bar, bench, artists, and the laity as well. To offer a journal has been somewhat more arduous and dis tant in accomplishment than first imagined. From the earliest days of LHI, the Cardozo family has been friendly and generous in offering its support, particularly from the office of Dean Monroe E. Price and the Jacob Burns Institute. The fruit of this collaboration is now in your hands, the new and long awaited Cardozo Studies in Law and Litera ture, edited by members of LHI, by Cardozo Law School faculty, by prominent writers, and by other distinguished academics and lawyers. One of LHI's liveliest gatherings was the October 1987 sym posium under the able direction of Professor L.H. LaRue, at the law school of Washington and Lee University, in Lexington, Virginia. For the first time, an LHI conference focused on one author, one work: Herman Melville's final creation, the enigmatic and complex Billy Budd, Sailor.
