Law 24 of 2013 concerning Population Administration. The Constitutional Court ruled that Article 61 paragraph (1), (2) and Article 64 paragraph (1), (2) of the Population Admnistration Law contradicts the 1945 Constitution of the Republic of Indonesia. This paper aims to identify and analyze the Constitutional Court's considerations in issuing the decision, and the legal consequences of that ruling. This normative legal research uses a case approach. The results found that the decision of the Constitutional Court had a significant legal effect on the followers of the flow of trust and had implications that impact not only in terms of the law but also sub-systems in pluralistic Indonesian society. Abstrak Melaksanakan amanat UUD 1945 yang menjamin hak kebebasan beragama dan berkeyakinan, Mahkamah Konstitusi mengeluarkan Putusan Nomor 97/PUU-XIV/2016 yang mengabulkan gugatan judicial review atas UU 23 Tahun 2005 jo. UU 24 Tahun 2013 tentang Administrasi Kependudukan. Mahkamah Konstitusi memutuskan bahwa Pasal 61 ayat (1), (2) dan Pasal 64 ayat (1), (2) UU Adminduk bertentangan dengan UUD NRI Tahun 1945. Tulisan ini bertujuan untuk mengetahui dan menganalisis pertimbangan Mahkamah Konstitusi dalam mengeluarkan putusan tersebut, serta akibat hukum dari putusan itu. Penelitian hukum normatif menggunakan pendekatan kasus ( case approach ). Therefore it is important to analyse the authority of curator in executing bankruptcy boedel abroad. This normative legal research uses s tatutes and comparative approach . The results shows that first, Indonesia adheres the principle of universality against bankruptcy property outside of the jurisdiction of the country so the curator has authority to execute the bankruptcy boedel abroad. However, curators have difficulty in executing bankruptcy boedel in other jurisdictios. Second, Law Number 37 Year 2004 on Bankruptcy and Suspension of Payment does not regulate the authority of curator in executing the bankrupt boedel outside of Indonesian jurisdiction, especially when it is collided with the jurisdiction of other countries. Therefore the Bankcruptcy law needs to be revised. Third, Singapore has similarity with Indonesia related to the principle of universality in executing bankruptcy boedel beyond its jurisdiction. However, when it comes to jurisdiction of other countries, Singapore has bilateral agreements with Malaysia and has ratified UNCITRAL Model Law on Cross Border Insolvency with Guide to Enactment. Abstrak Undang-Undang Nomor 37 Tahun 2004 Tentang Kepailitan dan PKPU tidak mengatur kewenangan kurator dalam mengeksekusi boedel pailit di luar batas yurisdiksi Indonesia, sehingga penting untuk meneliti bagaimanakah kewenangan kurator dalam mengeksekui boedel pailit yang berada diluar batas yurisdiksi Indonesia. Penelitian hukum normatif ini menggunakan metode pendekatan perundang-undangan, dan pendekatan perbandingan. Hasilnya adalah pertama, Indonesia menganut prinsip universalitas terhadap harta pailit yang berada di luar batas negara sehingga aset pailit dapat berada di dalam dan luar yurisdiksi negara. Namun, kurator mengalami kesulitan dalam mengeksekusi boedel pailit karena terbentur yurisdiksi negara lain. Kedua, Undang No.37 Tahun 2004 Tentang Kepailitan dan PKPU tidak mengatur kewenangan kurator dalam mengeksekusi boedel pailit di luar batas yurisdiksi Indonesia khususnya yang bertentangan yurisdiksi negara lain sehingga perlunya merevisi Undang-Undang Kepailitan terkait Kepailitan Lintas Batas Negara, terutama dalam hal mendukung kemudahan berbisnis. Ketiga, Singapura dengan Indonesia memiliki kesamaan prinsip universalitas dalam mengeksekusi boedel pailit di luar negaranya. This article focus on studying water resource management practices based on traditional wisdom carried out by indigenous peoples in Indonesia and whether the management of water resources based on traditional wisdom can be used as an example of sustainable water resource management. The results of research conducted on the Ciptagelar indigenous people, Subak practices in Bali and 9 (nine) regions in Indonesia show that the practices of water resource management carried out in these areas are in line with the approach of sustainable water resource management. Some forms of community practice can even be adopted in the management of water resources carried out by the government. Furthermore, regulation of water resources based on values that live in society is easier to implement in the life of the community itself, therefore, regulation of water resources in the future must pay more attention to the values that live in the community. Abstrak Pluralisme hukum di Indonesia memberikan tempat bagi masyarakat adat untuk mengelola sumber daya alamnya, yang kehidupannya dilandasi falsafah hidup yang selaras dengan alam, menghasilkan pola pengelolaan sumber daya alam yang ramah lingkungan dan berkelanjutan. Artikel ini fokus pada mempelajari praktek pengelolaan sumber daya air (SDA) berdasarkan kearifan tradisional yang dilakukan masyarakat adat di Indonesia dan apakah pengelolaan SDA berdasarkan kearifan tradisional ini dapat dijadikan contoh pengelolaan SDA yang berkelanjutan. Hasil penelitian yang dilakukan pada masyarakat adat Ciptagelar, praktik Subak di Bali dan 9 wilayah di Indonesia menunjukkan bahwa praktik-praktik pengelolaan SDA di wilayah tersebut sejalan dengan pendekatan pengelolaan SDA yang berkelanjutan. Beberapa bentuk praktik masyarakat bahkan dapat diadopsi dalam penyelenggaraan pengelolaan SDA yang dilakukan oleh pemerintah. The purpose of this study is to find the measurement and criteria of judges' confidence in the evidentiary process of a trial in finding material truth in the judiciary of West Java Province and the factors influenced the formation of the judge's conviction in deciding criminal cases. This normative study is analyzed using qualitative data. The results show that the establishment of judges' beliefs in criminal cases in the judiciary of West Java Province is based on the evidence according to what is regulated in Article 184 (1) of the Criminal Procedure Code and the facts at the hearing. The formation of the judge's conviction is seen from whether there is a match between the statements of the witnesses, the statements of witnesseses with other evidence and with the statements of the defendant related to the case charged by the Public Prosecutor. If the facts are found that are the result of conformity between the witness testimony and other evidence and the defendant's statement with the elements of the article charged, then the judge's conviction emerges / is formed. Some factors that influence judges in forming beliefs include experience of the judges, the form of a single judge and panel of judges, Court Class (I A or I B), and cultural and religious background. Abstrak Menarik untuk diteliti mengenai bagaimana seorang hakim dapat meyakinkan dirinya sendiri bahwa ia telah menemukan kebenaran materiil dari suatu tindak pidana. Tujuan penelitian ini adalah untuk menemukan ukuran dan kriteria keyakinan hakim terhadap proses pembuktian di persidangan dalam menemukan kebenaran materiil pada lembaga peradilan di wilayah hukum Provinsi Jawa Barat dan faktor-faktor apakah yang mempengaruhi pembentukan keyakinan hakim dalam memutus perkara pidana. Penelitian normative ini dianalisis dengan data kualitatif. Hasil menunjukkan bahwa Pembentukan keyakinan hakim dalam perkara pidana pada lembaga peradilan di wilayah hukum Provinsi Jawa Barat didasarkan pada alat bukti sesuai dengan yang diatur di dalam Pasal 184 ayat (1) KUHAP dan fakta-fakta di persidangan. Terbentuknya keyakinan hakim dilihat dari apakah ada kesesuaian antara keterangan para saksi, keterangan antara para saksi dengan alat bukti lain dan dengan keterangan terdakwa terkait perkara yang didakwakan oleh Jaksa penuntut Umum. Apabila ditemukan fakta-fakta yang merupakan hasil kesesuaian antara keterangan para saksi dengan alat bukti lain dan keterangan terdakwa dengan unsur-unsur pasal yang didakwakan, maka keyakinan hakim muncul/terbentuk. The concept of production sharing has changed several times, where the latest was the change of cost recovery scheme to gross split. The changed type of production sharing contract become the basis for examining the philosophical level related to its existence. This normative research uses prescriptive legal and conceptual approach. Based on the results of the research, similar characteristics were found that the types of production sharing contracts remain used even even with different schemes. Therefore the principle of responsive competition and the principle of proportionality sharing must exist as a philosophical foundation in its implementation. Abstrak Kontrak bagi hasil merupakan jenis kontrak kerja sama yang digunakan oleh Pemerintah Republik Indonesia dalam melaksanakan pengelolaan minyak dan gas bumi. Perubahan konsep bagi hasil mengalami beberapa kali perubahan, dan yang terakhir terjadi adalah perubahan skema cost recovery menjadi skema gross split . Perubahan jenis kontrak bagi hasil menjadi dasar untuk meneliti dari tataran filosofis terkait eksistensinya. Artikel ini menggunakan tipe penelitian normatif dengan pendekatan perundangan serta konseptual yang disajikan secara preskriptif. Whereas the policy of the transfer of function is contrary to the laws and regulations concerning land use and spatial planning, in particular the provisions set forth in Government Regulation Number 16 year 2004 concerning Land Use. This is an empirical juridical research using sociological juridical approach . The result shows that there are legal factors and non-legal factors that cause Sumenep Regency Government to issue permits to shrimp pond investors. The legal consequences of such policy include the privatization of the beach and against the spirit of land reform. Abstrak Tulisan ini bertujuan untuk menganalisis faktor penyebab dikeluarkannya izin kepada investor untuk mengalih fungsikan tanah pertanian yang lokasinya berdekatan dengan tanah pesisir di Kabupaten Sumenep menjadi tambak udang beserta akibat hukumnya. Padahal kebijakan alih fungsi tersebut bertentangan dengan peraturan perundang-undangan tentang penatagunaan tanah dan penataan ruang, khususnya ketentuang-ketentuan yang diatur di dalam PP Nomor 16 Tahun 2004 Tentang Penatagunaan Tanah. Untuk menjawab tulisan tersebut, digunakan penelitian yuridis empiris dengan pendekatan yuridis sosiologis. Hasilnya, terdapat faktor hukum dan faktor non hukum yang menyebabkan Pemerintah Kabupaten Sumenep mengeluarkan izin kepada investor tambak udang. The results of mediation are generally a written agreement signed by the parties witnessed by the village head, religious leaders, and community leaders. Although the peace agreement was carried out in the village with the village head and / or religious figure as the mediator, however, the parties obeyed the results of the mediation. The results shows that the mediation of the inheritance dispute settlement of Madurese society was carried out on a voluntary basis and to be kept secret from others, with village head and religious leaders as mediators. Mediation of inheritance dispute settlement of Madurese society is bining based on customary law because it is in accordance with way of life Madurese society “todus” (shame or humiliation) and the value of respect for “bhuppa bhabbu ghuru rato” (parent,Qur’an teacher, and leader). Abstrak Penelitian sosiologis ini bertujuan untuk mengkaji bagaimana pelaksanaan mediasi penyelesaian sengketa waris masyarakat Madura; serta bagaimana kekuatan mengikat mediasi penyelesaian sengketa waris masyarakat Madura. Hasil mediasi umumnya berbentuk kesepakatan tertulis yang ditandatangani para pihak dengan disaksikan oleh kepala desa, tokoh agama, dan tokoh masyarakat. Meskipun kesepakatan perdamaian itu dilakukan di desa dengan mediator kepala desa ( klebun ) dan/ tokoh agama ( keyae ), ternyata para pihak taat melaksanakan hasil mediasi tersebut. Sumber data diperoleh melalui wawancara dan FGD dengan para informan. Hasil penelitian menunjukkan bahwa mediasi penyelesaian sengketa waris pada masyarakat Madura dilakukan atas dasar sukarela dan diupayakan untuk dirahasiakan dari masyarakat lain, dengan mediator sesepuh kerabat atau klebun (kepala desa) dan keyae (tokoh agama). The renewal of Islamic family law must be carried out with approaches and methodologies that originate from the tradition of Islamic thought itself, and not based on the perspective of thoughts from outside Islam. Maqasih Syariah can be an adequate alternative as a conceptual-methodological basis for Islamic family law reform. In addition being considered able to relate to the concepts and values of modernity, such as equality, gender justice and so on, the Maqasih Syariah approach also has methodological tools for dialogue with Islamic scientific methodologies and traditions such as ushul fiqh, so it is probable that the legal products produced with this approach will become contextual Islamic family law products that are acceptable to all groups of people. Abstrak Banyak kalangan menilai bahwa hukum keluarga Islam di Indonesia harus segera diperbarui.Namun pembaruan hukum keluarga Islam tersebut bukanlah hal mudah.Penolakan berbagai pihak terhadap CLD-KHI, sebagai salah satu upaya pembaruan hukum keluarga Islam, dapat dijadikan pelajaran bagaiaman upaya pembaruan hukum keluarga Islam harus dilakukan.Pembaruan hukum keluarga Islam harus dilakukan dengan pendekatan dan metodologi yang berasal dari tradisi pemikiran Islam sendiri, bukan berdasarkan prespektif pemikiran dari luar Islam. The article is a philosophical foundation and constitutional basis for the establishment of the Law of the Republic of Indonesia Number 23 Year 2014 on Local Government. In the Law, the Central Government has granted authority to the Provincial Government to manage the mining resources. For instance, East Java Province has 24 Regencies with the potential of non-metallic mineral mining and 11 Regencies with the potential of metal mineral mining. The northern coast region of East Java is the center of the mining exploitation area, but 20–35% of the population lives below the poverty line. This normative research focuses on urgency of mining management by East Java Provincial Government that aims at regulating community-based mining so that it can overcome the problem of poverty and pay attention to environmental sustainability. Abstrak Undang-Undang Dasar Tahun 1945 menyebutkan bahwa hubungan keuangan, pelayanan umum, sumber daya alam dan sumber daya lainnya antara pemerintah pusat dan pemerintahan daerah diatur dan dilaksanakan secara adil dan selaras berdasarkan Undang-Undang. Pasal tersebut merupakan landasan filosofis dan landasan konstitusional pembentukan Undang-Undang Republik Indonesia Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Dalam Undang-Undang tersebut Pemerintah Pusat telah memberikan kewenangan kepada Pemerintah Daerah Provinsi dalam pengelolaan pertambangan. Provinsi Jawa Timur memiliki 24 Kabupaten dengan potensi pertambangan mineral non logam dan 11 kabupaten dengan potensi pertambangan mineral logam. Wilayah pantai utara provinsi Jawa Timur merupakan pusat dari wilayah eksploitasi pertambangan, namun 20–35% penduduknya hidup dibawah garis kemiskinan.
