{"title":"STRATEGI PELAKSANAAN KETENTUAN DUTY-FREE QUOTA-FREE INDONESIA DALAM KERANGKA ORGANISASI PERDAGANGAN DUNIA (WORLD TRADE ORGANIZATION)","authors":"Veri Antoni","doi":"10.22146/jmh.37969","DOIUrl":"https://doi.org/10.22146/jmh.37969","url":null,"abstract":"Abstract Ministerial Conference on Duty-Free Quota-Free (DFQF) in Hongkong, 2015, mandated for the developed countries to provide DFQF market access for at least 97 per cent of products originating from LDCs. For the developing countries shall seek to provide DFQF market access for products originating from LDCs. Indonesia was one of the developing countries that agreed in conference. The article aims to identify and analyze what strategy should be done by Indonesia related to the implementation of DFQF (duty free quota free) agreement. Indonesia as contracting parties of the establishment of WTO agreement should follow WTO’s agreements including DFQF’s agreement for the least development countries/LDCs). In granting DFQF preference to the LDCs countries, Indonesiashould use GSP (Generalized System of Preference) scheme or pattern because of the absence of clear regulation about DFQF. The implementation by making requirements that must be followed by the LDCs countries if they wish to obtain DFQF preferences as happened when a country wants to obtain GSP. The requirements can be related to DFQF products, criteria DFQF recipients, limitation DFQF value and suspension act, and the period of granting DFQF preference. Intisari Pertemuan Konfrensi Tingkat Menteri (KTM) di Hongkong tahun 2005 terkait duty- free quota-free (DFQF) mengamanatkan negara-negara maju untuk memberikan fasilitas DFQF sebesar 97% dari jumlah pos tarifnya kepada negara kurang berkembang ( least developed countries/LDCs) . Untuk negara berkembang dianjurkan untuk memberikan hal tersebut. Indonesia adalah salah satu negara berkembang yang menyepakati konferensi tersebut. Tulisan bertujuan untuk mengetahui dan menganalisa strategi apa yang sebaiknya dilakukan oleh Indonesia terkait pelaksanaan DFQF terhadap negara kurang berkembang. Sebagai salah satu negara Organisasi Perdagangan Dunia ( World Trade Organization /WTO), Indonesia terikat dengan perjanjian-perjanjian dalam kerangka perjanjian WTO, termasuk kesepakatan DFQF. Dalam pemberian preferensi DFQF ini, Indonesia sebaiknya menggunakan skema atau pola seperti Generalized System of Preference (GSP) mengingat tidak adanya pengaturan yang jelas terkait dengan DFQF. Penerapan DFQF dapat diwujudkan dengan membuat persyaratan-persyaratan yang harus diikuti oleh negara LDCs apabila mereka berkeinginan untuk memperoleh preferensi DFQF seperti suatu negara ketika berkeinginan memperoleh GSP. The opening up of opportunities for private companies to become competitors of SOEs which is a company that has been running a monopoly business, aiming to make SOEs as large corporations that are survive and compete, also remain an agent of development. Strengthening SOEs was done through normative by using documentary research. SOEs is expected to be the main business entity that plays a role in national development, by combining corporate/business and public service principles, which are able to be independent and compete globally but still rely on the concept of economic democracy as a distinctive feature of the Indonesian nation. Intisari Demonopolisasi BUMN Persero yang dilakukan terhadap PT KAI (Persero) dan PT Pelindo (Persero), menghendaki BUMN Persero sebagai korporasi yang mandiri yang mampu menyeimbangkan antara tujuan kegiatan usaha untuk profit motif sekaligus menjalankan usaha untuk kemanfaatan umum. Dibukanya peluang perusahaan swasta menjadi kompetitor BUMN Persero yang selama ini menjalani usaha secara monopoli, bertujuan untuk menjadikan BUMN Persero sebagai korporasi besar yang kuat bertahan dan bersaing, serta tetap menjadi agent of development . Penguatan terhadap BUMN Persero dilakukan melalui penelitian normatif dengan mengguakan documentary research. This research aims to describe protection of land title for traditional people in human right perspective and its principles . This research is doctrinal , use conceptual and statute approach Secondary data used is analysed qualitatively. The result shows there is no special declaration and convention regulating about land title for minor y t include traditional people and only broadening of housing right. There are several principles of traditional people protection, namely: non discrimination, Self-determination, progressive implementation and lastly and effective participation. Intisari Masyarakat tradisional sebagai minoritas yang bermukim di pantai berhak mendapatkan hak atas tanah. Penelitian ini mengkaji perlindungan hak atas tanah masyarakat tradisional dalam perspektif hak asasi manusia dan prinsip perlindungannya. Penelitian ini merupakan penelitian doktrinal menggunakan statute dan conceptual approach dengan data sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan belum terdapat konvensi maupun deklarasi khusus mengatur hak atas tanah bagi minoritas termasuk masyarakat tradisional sebagai perluasan hak atas perumahan. Pada intinya pengaturan tersebut menegaskan bahwa penyedia jasa internet (ISP) tidak dapat melakukan melakukan diskriminasi atau pembedaan atas konten data yang dibawa dalam jaringan internet, sehingga pengguna tidak boleh dibatasi oleh ISP dalam penggunaan internet dan pemilihan aplikasi internet. Namun demikian, pengaturan tersebut bersinggungan dengan beberapa isu yaitu privasi, moral publik, dan keamanan negara. Tulisan ini menjelaskan tentang network neutrality, dan meninjau posisi Indonesia untuk menerapkan pengaturan tersebut. Meanwhile, Article 6(2) stipulates an exception where death penalty may only be imposed for the ‘most serious crimes.’ The Human Rights Committee had previously provided that ‘most serious crimes’ exclude other crimes which do not result in loss of life regardless of how severe the crime may be, including—crimes that threaten national security. In this regard, this Article will attempt to explore the scope of ‘most serious crimes’ by means of interpretation and margin of appreciation. Intisari Pasal 6 Kovenan Internasional tentang Hak Sipil dan Politik melindungi hak untuk hidup. Sementara itu, Pasal 6 (2) menetapkan pengecualian di mana hukuman mati hanya dapat dikenakan untuk 'kejahatan paling serius.' Komite Hak Asasi Manusia sebelumnya menetapkan bahwa 'kejahatan paling serius' mengecualikan kejahatan lain yang tidak mengakibatkan hilangnya nyawa terlepas dari seberapa parah kejahatan itu, termasuk — kejahatan yang mengancam keamanan nasional. The target of PTSL is only for uncertified land in a village or suburb. One of the areas implementing PTSL program is Batu City that had previously applied National Agrarian Operation Project (PRONA). As a new registration system, PTSL is worthy to discuss and analyze whether or not systematic and complete land registration has already provided legal certainty for land owners. The method used in this research is juridical-empiric research method using juridical sociological approach. Legal data analysis used is by qualitative descriptive analysis method. According to the research result and analysis, it can be concluded that there are many hindering factors experienced by Agrarian Office of Batu City, PTSL participants and village officials in Batu City. Land registration through PTASL program is, however, still substantial in providing legal certainty for all participants. This is because land certificates that are issued from PTSL is signed by Adjudication Committee Chief. Intisari Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan program pemerintah untuk mewujudkan peta tunggal di Indonesia. Sasaran PTSL yaitu bidang tanah yang belum memiliki sertifikat dalam satu kelurahan atau desa. Salah satu daerah yang mengikuti Program PTSL yaitu Kota Batu yang sebelumnya juga mengikuti Proyek Operasi Nasional Agraria (PRONA). Sebagai sistem pendfataran yang baru, PTSL menarik untuk dikaji dan dianalisis agar dapat diketahui faktor penghambat dan pendukung dalam pelaksanaan, perlu pula dikaji dan dianalisis apakah pendaftaran tanah sistematis lengkap telah memberikan kepastian hukum kepada pemilik tanah. Metode penelitian yang digunakan yaitu metode penelitian yuridis empiris dengan menggunakan metode pendekatan yuridis sosiologis. Analisis data hukum menggunakan metode analisis deskriptif kualitatif. Berdasarkan hasil kajian dan analisis dapat disimpulkan bahwa banyak ditemukan faktor penghambat yang muncul dari pihak Kantor Pertanahan Kota Batu, Peserta PTSL, dan pihak Desa atau Kelurahan di Kota Batu. Pendaftaran tanah melalui Program PTSL tetap memberikan kepastian hukum kepada pesertanya. This study uses empirical juridical research methods. This research was conducted by examining primary data and secondary data which will then be analyzed qualitatively to answer the issues raised. MoU must be made as a condition to be able to make regional cooperation agreements based on the mandate of Article 6 paragraph (1) Government Regulation No. 28 of 2018 concerning Regional Cooperation where one of the stages that must be passed is the preparation and signing of a collective agreement. The MoU has a control function from the Regional Head towards the implementation of regional cooperation, given the legal relationship that arises in the implementation of regional dimensions of public cooperation based on consideration of the efficiency and effectiveness of public services and mutual benefit to the parties. Intisari Penelitian ini bertujuan untuk mengetahui dan mengkaji kedudukan Memorandum Of Understanding (MoU) dalam penyelenggaraan perjanjian kerjasama daerah berdasarkan Peraturan Pemerintah No. 28 Tahun 2018 Tentang Kerjasama Daerah serta pemahaman bagi pemangku kebijakan mengenai hakikat MoU dalam Perjanjian Kerjasama Daerah. Penelitian ini menggunakan metode penelitian yuridis empiris. Penelitian ini dilakukan dengan mengkaji data primer dan data sekunder yang kemudian dianalisis secara kualitatif untuk menjawab permasalahan yang diangkat. MoU wajib dibuat sebagai syarat untuk dapat membuat perjanjian kerjasama daerah berdasarkan amanat Pasal 6 ayat (1) Peraturan Pemerintah No. 28 Tahun 2018 Tentang Kerjasama Daerah dimana salah satu tahapan yang harus dilalui adalah penyusunan dan penandatanganan kesepakatan bersama. Dengan menggunakan psychological type of the cognitive function, ditemukan bahwa: Pertama, secara internal PPNS KI (KI) sudah menjalankan tugas dan fungsi PPNS KI, meskipun belum pada level ideal. Faktor-faktor internal yang memengaruhi hal tersebut yakni: (i) belum terdapat struktur PPNS KI di Kantor Wilayah Hukum dan HAM, dan (ii) penempatan PPNS ke dalam jabatan atau posisi tertentu yang tidak relevan dengan tugas dan wewenang PPNS. Kedua, secara eksternal berdasarkan tinjauan normatif, dipahami bahwa penegakan hukum KI dapat menempuh beberapa jalur. State recognitions towards adat law community are dynamics. This paper is written based on legal normative research to describe dynamics of adat law community recognition. In the early of Indonesia independent, adat law community was considered as foundation of Indonesia nation state establishment. Since 1957 and during New Order era, there was systematic effort to abolish adat law communities because adat law was perceived as symbol of backwardness. After the amendment of the Constitution, adat law community and their traditional rights are recognized by law and enforced through court decision. Adat law community can determine their type of recognition to strengthen their legal capacity to manage Adat Forest; to organize Adat Village; or to hold communal land rights.
