Gernet, and his role in the formation and improvement of the criminal-legal and criminological science in prerevolutionary jurisprudence. Methods : dialectical approach to cognition of social phenomena, allowing to analyze them in historical development and functioning in the context of the totality of objective and subjective factors, which predetermined the following research methods: formal-logical, comparative-legal, and sociological. Results: it is proved that, being the author of serious scientific developments in the field of criminal law and fundamental criminological research printed in pre-revolutionary Russia, M. N. Gernet laid the foundation for the further formation of criminological doctrine, which later became a sub-branch of criminal law science, thus significantly influencing the formation of the humanistic principle in the Russian criminal-legal theory. Analysis of M. N. Gernet’s works allows the author to assert that they identify many shortcomings in fighting crime by solely criminal-repressive methods, and also to show the negative phenomena in the field of assigning criminal penalties, which were created by the judicial practice in force at that time, which used various means to intimidate the population. Scienti fic novelty: the author’s approach to the analysis of the pre-revolutionary scientific heritage of Professor M. N. Gernet, as well as individual scientific works of his students and followers, allowed the author to conduct a comprehensive scientific study of the life, activities, scientific creativity of the greatest Russian jurist and scientist, Professor M. N. {"title":"Monetization of emotions in the existence of an electronic nomad","authors":"E. L. Methods: existential-phenomenological, analytical and logical, as well as structural and system-functional approaches. The ideas of D. Harvey, J. Baudrillard, N. Srnicek, R. van den Akker, A. Gibbons and T. Vermeulen on the state of modern society served as material for theoretical comprehension of the problem. Results: the research revealed that today the emotions monetization plays a significant role both in the life of a modern individual spending a lot of time in social networks, whom we call an electronic nomad, and of producers of goods and services, advertisers and intermediaries, bringing large profits to the latter. The consumerism ideology and the consumer society contribute to the emotions monetization, as well as the two-world, chaotic and fragmented here-existence of an electronic nomad, their loneliness and unstable structure of feelings. Consumption is not rationalized by a modern individual; it is associated with the desire for excess and is subject to a change of emotions and feelings. The nomad relies on advertising to satisfy his needs, where they are offered a product/service in an excellent form as a tempting deficiency. Today, to construct an advertising myth, databases and various platforms are used, targeting of potential customers is carried out, which allows manipulating their emotions and forcing them to make a choice. At the same time, the purchase of a product or service is associated with quickly forgetting the emotions, and possibly with subsequent disappointment. The electronic nomad, yielding to emotions, demonstrates lack of will, manipulability, and lack of reflexivity over what is happening. Scientific novelty: the results of the analysis of the current state of consumer society allow posing the problem of emotions monetization, identifying the reasons for the intensive development of this process in an electronic nomad, and discovering the features of manipulation tactics that lead to the conversion of emotions into monetary equivalent. {"title":"The video game industry’s money laundering problem: when do game publishers become money transmitters?","authors":"M. Methods : dialectical approach to cognition of social phenomena, allowing to analyze them in historical development and functioning in the context of the totality of objective and subjective factors, which predetermined the following research methods: formal-logical and sociological. Results : as enthusiasm for immersive multiplayer video games continues to grow, players are placing a high degree of value on virtual items like in-game currency, weapons, vehicles, and “skins”. The value of these items, paired with features that allow players to buy and sell them, has opened the door to criminals who can exploit these features to launder money. The United States maintains a robust legal framework to prevent and punish money laundering. One key piece of that framework is imposing certain reporting and recordkeeping duties on “financial institutions”, including money transmitters. If a company is subject to these duties, it must abide by complex and expensive anti-money laundering compliance requirements. Scientific novelty : the article, for the first time, considers the issue whether a game publisher is a criminal money transmitter. The paper takes up that question detailing the specific game features and publisher policies that, under current rules and guidance, lead to or rebuff the conclusion that a game publisher is a money transmitter. Practical significance : the main provisions and conclusions of the article can be used in scientific, pedagogical and law enforcement activities when considering the issues related to the qualification of actions of video games publishers in case of their participation in money laundering. The cult of murder” and “The world of maniacs and serial killers”, the reasons for the interest of teenagers and young people in these groups, the techniques used by moderators of social network pages to attract supporters and form a cult of violence among them and stimulate the commission of murders based on the research results (multidimensional content analysis of the social network pages content). Methods : general scientific (analysis, system-structural, comparative-legal) and specific scientific methods (multidimensional content analysis of the social network pages content). Results : based on the analysis of more than 17 thousand fragments of correspondence of participants of the movement “Maniacs. The cult of murder” and more than 34 thousand fragments of correspondence of participants of the movement “The world of maniacs and serial killers”, a semantic field was constructed, including the main topics discussed on the pages of the above-mentioned destructive social groups, methods of involving teenagers in a destructive total ideology modeling the most important spheres of life of the movements’ supporters, leveling the value of human life and turning someone else’s death into an ordinary phenomenon. It is concluded that within the framework of the destructive radical nationalist social movement “Maniacs. The cult of murder” an ideology was formed that has the following features: teleology, scientific appearance, wide audience coverage, presence of symbols and attributes, discussion of topics that have a socially negative character, using the language means that are understandable only to the community members. Scientific novelty : the main topics discussed by participants of destructive social movements “Maniacs. The cult of murder” and “The world of maniacs and serial killers” are described and analyzed. It is proved that as a result of immersion into such content, violence and murder cease to cause natural negative emotions, feelings of disgust and empathy for the victim in teenagers. The study showed that the formation and distribution of content in publics currently takes place on behalf of the users, which, on the one hand, allows removing part of the responsibility from the moderators, and on the other hand, turns the pages of movements into a so-called self-reproducing (by terminology of Niklas Luhmann – autopoietic) system capable of self-production, i.e. its existence is ensured by the activity of the users. Methods: static panel data models, graphical method. Results: the paper shows that currently the issues of the digitalization impact on economic processes are insufficiently studied from an empirical point of view, and the conclusions obtained by the researchers are quite contradictory. To assess the impact of digitalization, the authors formed a model with fixed effects, the variables of which are indicators of exports and imports of goods and services of geographical macro-regions, the use of international bandwidth, oil rents, investment indicators, etc. The main conclusion is that the use of international data transmission channels has a statistically significant effect on export and import flows. Modeling in terms of geographical macro-regions showed that the impact of international data flows on export and import flows was uneven. Scientific novelty: the negative impact of international data flows on exports in Latin America and the Caribbean and imports in Europe and Central Asia, East Asia and the Pacific is shown. A quantitative assessment of the impact of cross-border data flows on international trade flows gives grounds to assert the ambiguous consequences of digital transformation in relation to international trade for certain geographical macro-regions. Practical significance: conclusions based on the study results can become the basis for assessing the consequences of measures aimed at increasing the country’s involvement in the globalization and digitalization processes. Shutova","doi":"10.21202/2782-2923.2023.3.571-585","DOIUrl":"https://doi.org/10.21202/2782-2923.2023.3.571-585","url":null,"abstract":"Objective: to identify criminal risks inherent in a medical robot, taking into account its hardware-technological (technological and digital) features, and to construct, based on this analysis, the author’s classification of criminal risks and models of criminal-legal protection of public relations arising in the medical robots’ turnover.Methods: the article uses general scientific (analysis, synthesis, induction, deduction, classification) and specific scientific methods of cognition, and the logical-legal method.Results: The security vulnerability of medical robots causes serious concern in manufacturers, programmers and those interacting with the robots in the healthcare industry. In medical institutions, robots interact closely with children, the elderly and the disabled, and it may not be clear to the patient whether the robot is working properly or being attacked. Any harm caused by a surgical robot as a result of unauthorized access (or other illegal actions) can undermine the public’s faith in medicine and in the healthcare system as a whole. Threats to the safety of medical robots can have further negative consequences for themselves, as such facts of unlawful influence can lead to robots breaking down or harming other nearby equipment that is the property of the healthcare institution, and worse – the life and health of patients or medical workers. In this regard, the paper identifies criminal risks and threats inherent in medical robots, and formulates measures to improve criminal legislation aimed at countering crimes arising against the legal turnover of medical robots (Article 2352 of the Criminal Code of the Russian Federation).Scientific novelty: at the moment there are few Russian studies devoted to the legal regulation and protection of medical robots. Basically, such researches are done by medical scientists. Methods: general scientific methods of systemic, structural and comparative analysis, as well as specific scientific methods (static and graphical analysis, expert assessments). Results: the analysis was carried out of the externalities of the sanctions pressure policy, which significantly affected the activities of the Russian small and medium-sized enterprises. Among the key factors studied are the disruption of logistics chains, reduction of the customer base, restrictions on monetary transactions, blocking of digital platforms, etc. The special role of this sector in eliminating the imbalances of the country’s economy in a difficult geopolitical situation and economic instability is outlined. It is proposed to investigate ways of adapting small businesses to new economic conditions, taking into account the systematic classification of enterprises in the SME sector. The forecast trends in the development of small and medium-sized firms for the near future are formulated. Based on the analysis of externalities, the author suggests measures to increase the adaptability of enterprises in the studied segment of the economy, which can be used by both representatives of the business community and government agencies. Scientific novelty: the division of firms into three categories (“kids”, “genetic dwarfs”, “transformers”) and three subgroups (“travelers”, “reorganizers”, “imago”) is proposed; their key functions and ways of adaptation characteristic of each category of enterprises are identified, which made it possible to develop recommendations on improving the adaptability of small and medium-sized enterprises, taking into account their characteristics. Methods : dialectical approach to cognition of social phenomena, allowing to analyze them in historical development and functioning in the context of the totality of objective and subjective factors, which predetermined the following research methods: formal-logical and sociological. Results : greenspaces play an important role in the urban landscape, with prior research suggesting that they are associated with numerous health and social benefits for residents. Despite this, research conflicts regarding the relationship between greenspaces and crime, with some studies finding these locations to be criminogenic and others finding them to be protective against local crime. This study examines this relationship in Portland, Oregon, considering different greenspace types as well as different crime types. Scientific novelty : this study presents a novel methodological adaption to measure crime concentration and specialization around discrete location types by integrating a street network buffer into the standard Location Quotient (LQ) metric. Results suggest that Portland’s greenspaces as a whole do not experience a concentration of crime; however, varying patterns emerge when examining different greenspace and crime types. This study identifies diverse crime concentrations in proximity to small parks, while finding other greenspace categories to be associated with crime-specific concentrations nearby. Others, still, have lower than expected counts of crime concentrating nearby, potentially demonstrating protective trends. These results highlight the importance of disaggregating both crime and location types to better understand the complex relationship between greenspaces and crime. Practical significance : the main provisions and conclusions of the article can be used in scientific, pedagogical and law enforcement activities when considering the issues related to minimizing crime on the territory of urban green spaces. Against the background of COVID restrictions, active development of remote services, and aggressive marketing of management companies, the number of shareholders has increased significantly. The paper analyzes the main trends in the development of UIF market in 2018-2022; the main factors of the development of collective investments are formulated. It was determined that the key factors hindering the development of this market are the low level of financial literacy of retail investors, the poor quality of UIF portfolio management, leading to losses for unit holders, and the increased risks as a result of the sanctions burden on the Russian financial market. Based on the study results, the basic recommendations are formulated that may contribute to the development of the market and improve the quality of managing the assets of unit holders. Scientific novelty: a review of research on the unit funds effectiveness was conducted, as a result of which it was determined that research on the collective investment market as such is poorly represented, and the problems of the market efficiency under sanctions are not considered. The main challenges and limitations of the collective investment institution development under the current economic conditions are formulated: (1) digitalization of the financial sector, (2) blocking of foreign assets, (3) low level of financial literacy of the population. Recommendations were made for the UIF market development: (1) legal regulation of the transparency of funds, (2) creation of a system of assignment of claims on the unit holders’ assets, (3) creation of a system of remuneration for the UIF success with active investment strategies strategies.
