Our analysis is guided by the question: What do elected officials’ discussions about the IAP reveal about the implementation of compensatory transitional justice mechanisms in settler colonial states, and about colonial relations (specifically attempts at reconciliation) more generally? Our study focuses on debates that took place between 2004 and 2019. We explored elected officials’ framing of both Survivors and the Canadian State in their discussions about the IAP. Our analysis reveals the limited reach of dialogue based in a partisan and antagonistic context and supports those scholars who assert that transitional justice is incompatible with reconciliation and decolonization. By way of contributing to the larger interdisciplinary study entitled Reconciling Perspectives and Building Public Memory: Learning from the Independent Assessment Process, of which this article is part, we reflect on what our findings mean not only for public memory but also for studying the IAP moving forward.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"33 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"133316935","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It connects current cruise promotion to earlier exploration histories and investigates the paradoxes that arise in the drive to bear witness to climate change while accelerating its impacts through carbon-intensive travel. It also examines some of the ways that Franklin expedition tourism in particular is being used to reinforce claims of Canadian sovereignty over Arctic resources. Overall, the promotion of this kind of maritime tourism highlights many of the key fault lines between visitor expectations and geophysical and cultural realities in a changing North, raising doubts about whether expanded development of such tourism can succeed in creating climate change ambassadors. The article concludes that the potential for developing cross-cultural environmental justice solidarities depends in significant measure on the tourism industry’s greater inclusion of Inuit perspectives that understand the Arctic not merely as a place to travel through, but as a homeland of earth, sea, and the shifting ice between.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"96 1 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"123476271","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

None explore the provenance of this legislation beyond a few sentences of the most general conjecture. This paper contends that Canada’s first Inquiries Act was a by-product of a political crisis that grew out of the politics and institutional processes integral to the resolution of claims for rebellion losses in Canada during the 1840s. As the events associated with the passage of the 1849 Rebellion Losses Bill would disclose, this crisis posed an existential threat to the viability of the Union. The passage of the Inquiries Act, precipitated by the immediate contingencies of the rebellion losses crisis, marked for Canada a fundamental shift in constitutional authority dating back to 1688. The Act embraced methods of inquiry denied to the Crown since the late seventeenth century. Though created by a democratic legislature, the Inquiries Act revived a Crown-driven inquisitional approach to public inquires long since inoperative in Great Britain. The Act thus marked a shift in the relationship between state and citizen, and opened a new terrain for the long struggle to protect the individual against the all-powerful state.Résumé:Les comptes rendus de commissions d’enquête au Canada citent rarement la loi sur les enquêtes, une loi fondamentale de 1846. Aucun n’étudie l’origine de cette loi, sinon en quelques phrases qui avancent de vagues hypothèses. D’après le présent article, la première loi canadienne sur les enquêtes est le sous-produit de la crise politique entourant le règlement, dans les années 1840, des réclamations pour les pertes subies durant les rébellions. Comme allaient le révéler les événements associés à l’adoption du projet de loi de 1849 sur les pertes dues aux rébellions, cette crise menaçait la viabilité de l’Union. L’adoption de la loi sur les enquêtes, précipitée par les impondérables immédiats de la crise susmentionnée, a marqué pour le Canada un glissement fondamental sur le plan de l’autorité constitutionnelle, laquelle remontait à 1688. La loi a adopté des méthodes d’enquête dont la Couronne était privée depuis la fin du XVIIe siècle. Bien qu’elle ait été l’œuvre d’une assemblée législative démocratique, la loi sur les enquêtes a redonné vie à une démarche inquisitoire de la Couronne en matière d’enquêtes publiques, depuis longtemps abandonnée en Grande-Bretagne. Ainsi, la loi marquait un changement dans la relation entre l’État et le citoyen et ouvrait un nouveau champ à la longue lutte visant à protéger l’individu contre l’État tout-puissant.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"63 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"116718576","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Their 2016 final tour, undertaken after lead singer Gordon Downie was diagnosed with brain cancer, spectacularly reinforced longstanding perceptions of a privileged link between the band’s music and Canadian national identity. This article probes this connection, asking why deeply ambiguous and often critical references to Canada sufficed to raise The Hip to an extraordinary status as icons of Canadian nationalism. Drawing from theories of “banal” and “everyday” nationalism, it argues that, while The Hip’s work may legitimately be read as nationalist, Canada’s position as a culturally peripheral nation is the key to explaining the incongruous appropriation of the Hip’s work for nationalist self-celebration. The discourse around The Tragically Hip, then, helps to illuminate some of the ways in which nationalism works in a culturally peripheral context.Abstract:Résumé : Le groupe musical The Tragically Hip est un phénomène remarquable, voire unique, dans la musique populaire canadienne. Sa dernière tournée, en 2016, entreprise après qu’on eut diagnostiqué un cancer du cerveau chez le chanteur Gordon Downie, a renforcé de façon spectaculaire la perception entretenue depuis longtemps d’un lien privilégié entre la musique du groupe et l’identité nationale canadienne. L’article examine ce lien par cette question: pourquoi a-t-il suffi de parler du Canada de manière profondément ambiguë et souvent critique pour que The Tragically Hip accède au statut extraordinaire d’icône du nationalisme canadien? S’inspirant des théories du « nationalisme ordinaire » ou « de tous les jours », l’article soutient que, si l’œuvre de The Hip peut avec raison passer pour nationaliste, la position du Canada en tant que nation culturellement en marge constitue la clé permettant d’expliquer l’appropriation incongrue de l’œuvre de The Hip à des fins d’apologie nationaliste. Le discours entourant The Tragically Hip contribue donc à éclairer certains modes de fonctionnement du nationalisme dans un contexte culturellement marginal.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"56 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121378429","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The chicken and egg war began when the Quebec government established the Fédération des producteurs d’œufs de consommation du Québec (FPOCQ) in 1970, a marketing board that began to restrict the price, grading, and sale of all eggs in Quebec, including egg imports from other provinces. The new board disrupted egg sales in Manitoba and Ontario, and it was not long before a series of legislative retaliations among the provinces took place, including strict import controls on broiler chickens and eggs and the seizure of out-of-province produce. Although predominantly contained to the neighbouring provinces of Manitoba, Ontario, and Quebec, this event was significant because it resulted in appeals to the Supreme Court of Canada, claims made concerning the rights of provinces vis-à-vis the federal government, and the restriction of agricultural goods, in this case, poultry and eggs, across provincial boundaries. This episode also had serious political ramifications, including fractured relationships among farmers, consumers, other industry stakeholders, and politicians and heightened tensions surrounding the legality and authority of provincial agricultural marketing boards. Ultimately, this “war” provided a significant impetus for the federal government to establish a national system of supply management in the egg and poultry sectors, a system which remains today.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"57 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"114554115","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Brantford, Hamilton, and Niagara were selected to build on previous research that mapped Municipal-Indigenous relations in seven municipalities across Canada. Studies regarding Municipal-Indigenous relations indicate the degree of inclusion of Indigenous Peoples in policy processes is as unique as each municipality. Some municipalities are urban Indigenous policy innovators with formal mechanisms for Indigenous inclusion in policy processes while others lag. An investigation of three Ontario municipalities is pivotal in partially supporting the finding that larger urban centres with proportionately smaller Indigenous populations are moving toward substantive Indigenous relationship building when compared to smaller municipalities with proportionately higher Indigenous populations.Résumé:Les relations entre les administrations locales et les populations autochtones urbaines de l’Ontario n’ont guère été étudiées, même si plus de la moitié de la population autochtone du Canada vit en ville, qu’une personne autochtone sur cinq habite en Ontario et que les Six Nations de Grand River comptent la plus grande population vivant dans une réserve au Canada. Les villes de Brantford, de Hamilton et de Niagara ont été choisies pour poursuivre les recherches antérieures qui avaient cerné les relations entre les municipalités et les Autochtones dans sept municipalités du Canada. D’après les études sur ce sujet, le degré d’inclusion des Autochtones dans les processus politiques varie selon chaque municipalité. Certaines d’entre elles innovent en matière de politique autochtone urbaine et disposent de mécanismes formels d’inclusion des Autochtones, tandis que d’autres sont à la traîne. Une enquête sur trois municipalités de l’Ontario s’impose pour étayer en partie la conclusion selon laquelle les grands centres urbains comptant une population autochtone proportionnellement faible s’orientent vers l’établissement de solides relations avec les Autochtones comparativement aux petites municipalités ayant une population autochtone proportionnellement élevée.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"39 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121778183","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Focusing my analysis around key works by Lawren Harris, A.Y. Jackson, J.E.H. MacDonald, and Franklin Carmichael, I offer an alternative perspective on commonly-adopted national and wilderness narratives, and instead consider these works in line with an emergent ecocritical consciousness. While a conversation about wilderness in relation to the Group of Seven often ignores the colonial history and Indigenous communities that previously inhabited coastal Lake Superior, this paper identifies these within a discussion of the environmental history of the region. That the environment of the north shore of Lake Superior was a primordial space waiting to be discovered and conquered only seeks to ratify the landscape as a colonial space. Instead, by engaging with the ecological complexities and environmental aesthetics of Lake Superior and its surrounding shoreline, I challenge this colonial and ideological construct of the wilderness, accounting for the prevailing fur trade, fishing, and lumber industries that dominated during the nineteenth and early twentieth centuries. A discussion of environmental history and landscape painting further allows for a consideration of both the exploitation and the preservation of nature over the course of the twentieth century, and looks beyond the theosophical and mystical in relation to the Group’s Lake Superior works. As such, the timeliness of an ecocritical perspective on the Group of Seven’s landscapes represents an opportunity to consider how we might recontextualize these paintings in a time of unprecedented anthropogenic climate change, while recognizing the people and history to whom this land traditionally belongs.Résumé:L’article remet en question l’idéalisation de la nature à laquelle sont souvent associés les paysages du Groupe des Sept représentant la rive nord du lac Supérieur. Axant son analyse sur certaines œuvres marquantes de Lawren Harris, A. Y. Jackson, J. E. H. Alors que bien souvent, en traitant du thème de la nature sauvage chez le Groupe des Sept, on ne tient pas compte du colonialisme et des communautés autochtones qui habitaient auparavant les rives du lac Supérieur, cet article les met en évidence dans une analyse de l’histoire environnementale de la région. Présenter l’environnement de la rive nord du lac Supérieur comme un espace originel en attente d’être découvert et conquis ne fait que consacrer le paysage en tant qu’espace colonial. I demonstrate that the supposedly apolitical discourse of accountability functions as a form of neoliberal and settler-colonial governmentality that reaffirms the legitimacy of settler state intervention into the pathologized Indigenous family. Using the death of Serenity in Alberta’s child intervention system in 2014, and the subsequent legislative debates surrounding her death and the lack of accountability in the child intervention system as a case study, I demonstrate that accountability as both a discourse and a mechanism moves between positioning Albertans-as-Victims, Albertans-as-Stakeholders, and, finally, Albertans-as-Responsible-Agents. Ultimately, I argue that shifting discourses of accountability, which move from governmental to societal to individual accountability, re-centre a relationship of settler possession in relation to the Indigenous Public Child, whose life and death become available for consumption by settler publics in exchange for governmental credibility and accountability.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"24 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"132292010","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

However, when cannabis was first criminalized in 1923, there was effectively no use of it in Canada at that time, and scholars have struggled to identify the specific reasons for which cannabis was added to the schedule of prohibited drugs. When situated within the drug discourse of the time, the lack of an explanation for criminalization becomes less surprising; the contemporary links between addiction, drug use, and racism likely transformed any prohibitive drug control measures into the kind of policy that did not require debate or analysis on the part of Parliament. Drugs and racial minorities were presented as connected threats to the integrity of the white Canadian population and to moral order, and moral reformers capitalized on this connection to support the criminalization of drugs. While the documentary source of the criminalization of cannabis remains unknown, these discursive conditions are of far greater import in understanding why cannabis was criminalized.Résumé:Le Canada a récemment levé l'interdiction de l'usage récréatif du cannabis, qui a duré près d'un siècle. Cependant, au moment de la criminalisation du cannabis pour la première fois en 1923, cette substance n'était pas du tout consommée au pays, et les chercheurs ont eu du mal à déterminer les raisons précises pour lesquelles elle a été ajoutée à la liste des stupéfiants interdits. Dans le contexte de l'époque concernant la drogue, l'absence d'explication étonne moins; les liens que l'on faisait alors entre dépendance, consommation de drogue et racisme ont probablement transformé toute mesure prohibitive visant le contrôle des stupéfiants en un type de politique ne nécessitant pas de débat ou d'analyse de la part du Parlement. On présentait la drogue et les minorités raciales comme des menaces à l'intégrité de la population blanche du Canada et à l'ordre moral, et les réformateurs moraux ont misé sur ce lien pour prôner la criminalisation des stupéfiants. Cet état d'esprit est bien plus important pour comprendre pourquoi le cannabis a été criminalisé que le fait que la source documentaire de sa criminalisation reste inconnue.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"29 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-07-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"121954571","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The first drug prosecution of a Canadian \"celebrity\" took place in 1985 after the Royal Canadian Mounted Police (RCMP) found a small amount of marijuana in the luggage of New Brunswick Premier Richard Hatfield at the airport in Fredericton. He was charged with simple possession and, aided by a team of lawyers, pleaded not guilty. Although Hatfield was the most successful premier in the province's history, he was facing challenges over the economy and language policy, and a finding of guilt would have devastated both his political career and the fortunes of his party. This article examines the Hatfield drug prosecution, which was followed by revelations of drug use with university students in 1981, as a chapter in Canadian legal and political history. It involved not only a privileged defendant, but also the independence of judges, the role of the RCMP, the relationship between the courts and the media, federal-provincial relations and an internal RCMP probe. Hatfield, the political celebrity, won his 1985 court battle but, with his lifestyle impugned, lost in the court of public opinion. In 1987, his party was crushed by the landslide victory of Frank McKenna's Liberals.Résumé:À partir des années 1960, les procès de célébrités relatifs à la drogue impliquaient généralement des acteurs ou des musiciens. Le premier procès pour drogue d'une célébrité canadienne a eu lieu en 1985 après la découverte, par la GRC, d'une petite quantité de marijuana dans les bagages du premier ministre du Nouveau-Brunswick, Richard Hatfield, à l'aéroport de Fredericton. Accusé de possession simple, celui-ci a plaidé non coupable avec l'aide d'une équipe d'avocats. M. Hatfield avait beau être le premier ministre à la plus brillante réussite de l'histoire de la province, il était confronté à des difficultés concernant l'économie et la politique linguistique, et un verdict de culpabilité aurait été dévastateur pour sa carrière politique et pour son parti. Le présent article examine la poursuite contre Hatfield, qui a été suivie par des révélations sur sa consommation de drogue avec des étudiants en 1981, une page de l'histoire du droit et de l'histoire politique. L'affaire n'impliquait pas seulement un accusé privilégié; elle touchait aussi l'indépendance des juges, le rôle de la GRC, la relation entre les tribunaux et les médias, les relations fédérales-provinciales et une enquête interne de la GRC. Hatfield, la célébrité politique, a gagné sa bataille judiciaire de 1985, mais, blâmé pour son style de vie, il a perdu devant le tribunal de l'opinion publique. Quant à son parti, il a mordu la poussière en 1987, par suite de la victoire écrasante des libéraux de Frank McKenna.","PeriodicalId":265433,"journal":{"name":"Journal of Canadian Studies/Revue d'études canadiennes","volume":"173 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2021-07-01","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"132513255","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
