The decision was taken consciously by mutual consent. It is also related to the current trend among young couples not to have children because they feel reluctant to be responsible for their children’s lives and focus on household life as a childless married couple. Apparently, this has also been accepted and validated by several young couples in Wates District, Kediri Regency. Of course, regarding Childfree itself, there is no Islamic law that regulates it, so, in this case, the author uses the perceptions of Muhammadiyah and Nahdlatul Ulama figures to give their views on the Childfree phenomenon among young couples in Wates District, Kediri Regency. This research uses a qualitative approach with descriptive methods. Data collection by interviews and observations of Nahdlatul Ulama and Muhammadiyah figures in Wates District, Kediri Regency. The results of this study indicate that there are various viewpoints regarding childfree, but what has become the agreement of NU and Muhammadiyah figures in Wates District, Kediri Regency, regarding Childfree is that they tend to disagree and encourage young couples to return to their religious knowledge, and to take a holistic approach regarding making that decision. One of them is non-cash payments or cashless payments, which are the latest innovations and are increasingly prevalent in buying and selling payments to MSMEs. This study aims to find out how the Cashless system is implemented in the MSME sector in the city of Medan, then to find out how the Islamic economic perspective is in implementing the Cashless payment system. This study uses a qualitative research method with data collection techniques, namely by observation, interviews, documentation on the UMKM posbloc in Medan city as well as a study of the literature to be analyzed with the author's observations to answer the formulation of the problem on this problem. The results of this study show that the Cashless system used by the Medan city posbloc is in several ways, namely debit cards, credit cards or by scanning the QRIS code (Quick Response Code Indonesian Standard). APMK (Payment using a card) or with a QRIS scan which has been promoted by Bank Indonesia provides convenience in making transactions with a cashless system without cash more efficiently and effectively. According to the Islamic economic perspective, QRIS is permissible because there is no usury in buying and selling payments to MSMEs. Cosmetics are beauty products women use to beautify or change their appearance. It is usually used to beautify the outside of the human body to get an attractive appearance. Even though they are not a basic need, cosmetics are one of the many products used daily and routinely, especially by women. This study aims to find out the form of accountability for compensation related to beauty products whose distribution permits have been withdrawn but whose products are still found circulating in the community and how that will be done according to the views of the Sharia Economic Law Compilation (KHES) and Law No. 8 of 1999 concerning Consumer Protection. This study uses a juridical-normative research method in which legal and statutory theory is the approach. The theory used in this study is the theory of legal protection, namely providing protection for human rights that are harmed by other people. The results of this study explain that legal protection and liability for compensation to consumers, especially for beauty products whose distribution permits have been withdrawn by BPOM, are regulated in KHES and in UUPK Article 4 letter a, which explains the rights of consumers to obtain safety, security and comfort when using goods/services. This study used a descriptive qualitative research method, with primary and secondary data sources used as data sources. Data collection techniques were used in the form of interviews, observation, and direct surveys. In addition, data collection techniques were also obtained from several selected sources as additional information in this study. The results of the study showed that the implementation of Maslahah Mursalah in the Circular Economy of UKM Tempe Berkah, Hamparan Perak in the element of hifdzu an-nafs (care of the soul) can provide comfort and maintain health for employees, the community, and the surrounding environment from the dangers of pollution. And able to help the community in meeting its basic needs. Then, the implementation of Maslahah Mursalah on the Circular Economy of waste of UKM Tempe Berkah in Hamparan Perak Village in the element of hifdzu al-mal (maintenance of assets), where UKM Tempe Berkah obtains their assets in a good way through buying and selling, using the assets following sharia and there is no element of appropriation other people's assets because they can provide appropriate salaries to their employees so that no one feels abused. Keputusan memilih produk tabungan Bank Sumut Syariah diduga dipengaruhi oleh berbagai faktor, dalam penelitian ini dibatasi pada faktor atribut produk, promosi dan komitmen religius. Jika keputusan memilih produk tabungan meningkat hal ini mengindikasikan meningkatnya loyalitas nasabah.Tujuan penelitian ini untuk mengetahui bagaimana pengaruh faktor atribut produk, promosi dan komitmen religious terhadap keputuasn memilih, serta bagaimana pengaruh keputusan memilih terhadap loyalitas nasabah. Teknik Sampel yang digunakan adalah purposive sampling, dengan alat analisis data adalah Structural Equation Model. Hasil penelitian menunjukkan tidak terdapat pengaruh yang signifikan Atribut Produk Tabungan terhadap Keputusan Memilih produk tabungan di Bank Sumut Syariah. Terdapat pengaruh Keputusan Memilih terhadap Loyalitas Nasabah. Terdapat pengaruh yang signifikan Komitmen Religius terhadap Keputusan Memilih produk tabungan Bank Sumut Syariah. Irwan","doi":"10.20414/ijhi.v21i2.574","DOIUrl":"https://doi.org/10.20414/ijhi.v21i2.574","url":null,"abstract":"This study aims to see the pattern of application of legal theory in thesis writing of students of the Islamic Family Law Study Program (HKI) in the Faculty of Shari’ah and Law at UIN Sumatra Utara, to analyze the factors that influence the polarization of the application of legal theory in student thesis writing, and to explain solutions in overcoming uniformity and unpreparedness of students in using the theoretical framework and legal theory in writing a thesis. This research is qualitative research using content analysis. Data collection techniques were carried out using documentation methods, Focus Group Discussions (FGD), and interviews. The results indicate that there are six polarizations in the application of legal theory to a student thesis. First, the thesis does not use a theoretical framework that contains legal theories. Second, the thesis uses a theoretical framework but does not contain legal theories. Third, the thesis uses the theoretical framework and explains the legal theories that will be used as its analysis tool, but does not use it on analysis. Fourth, the thesis uses a theoretical framework and explains the legal theory in it, but the legal theory used as an analysis is different from the legal theory in the theoretical framework. Fifth, the thesis does not use legal theory in the theoretical framework, but the analysis uses legal theory. Sixth, a thesis that uses the theoretical framework and legal theory used in the theoretical framework then applies the legal theory in analyzing the results of his research. Factors that influence the polarization of the application of legal theory in student thesis writing are; factors of teaching materials and teaching lecturers, factors of supervisors, and factors of student seriousness. The results of the study indicate that there are still shortcomings in terms of supervision and requirements for the establishment of SMLLC in Indonesia both from Gierke’s theory and Islamic law perspective. Penelitian ini merupakan penelitian hukum empiris. Data primer dalam penelitian adalah kata-kata dan tindakan masyarakat nelayan Kecamatan Medang Deras. Sedangkan data sekunder, penulis menggunakan berbagai literatur yang membahas tentang maqashid al-syariah. Hasil penelitian menjelaskan, bahwa menggunakan jaring tarik dan jaring hela yang merusak ekosistem laut, dengan alasan apapun, hukumnya adalah haram. Selagi laut masih tercemar, maka semua manusia akan terus berdosa. Adapun dosa yang paling besar ditanggung oleh pelaku perusakan lingkungan hidup, kemudian pemerintah yang mempunyai kekuasaaan dan kewenangan hukum, serta yang terakhir adalah masyarakat yang berkewajiban mencegah, mengingatkan, memelihara dan memberikan keteladanan yang baik dalam pelestarian lingkungan (hifz al-bi’ah).
