Salva","doi":"10.1163/15718182-30040008","DOIUrl":"https://doi.org/10.1163/15718182-30040008","url":null,"abstract":"\u0000Using a “child participation research as duty fulfilment and investigation” approach, we looked into US children’s participation reasons in the 2018 Parkland shooting protests. As duty bearers, we highlight children’s protest participation reasons ground up and in vivo. Then, we explore these reasons for children’s views on the four key issues hounding children’s rights. Using 326 randomly selected US middle and high school newsletters, we found ten significant themes substantively different from but logically linked with organisers’ publicised objectives. The reasons indicate children’s internalisation, a source of autonomy development, of the issues surrounding the shooting and protests. They reveal children’s views on the four key issues that emphasise the need to consider more the convergent and in-between of the mutually exclusive categories in childhood/child rights studies. Future studies should consider treating the being/becoming, nurturance/self-determination rights, and similar, convergent, and in-between categories in dynamic logical disjunctive relations. This article is based on a qualitative case study with children to explore child participation in research and the understanding of collaborative alliances. Analysis of field notes from workshops with children as co-researchers in a co-creation project forms a picture of four key components to answer the research question of how collaborative alliance as a methodological approach to child participation can support their ability to express their views freely: (a) having a valuable role in the collaboration, (b) creating a safe framework, (c) inclusion through information, and (d) an open and exploratory approach to the task. Following an exhaustive search using established methods for evaluating empirical research, 28 studies were included in this review. Patterns, advances and gaps in the literature indicated the benefits of doll use, as well as guidance and future directions for researchers. Drawing on research conducted in a secondary school in the UK, the article applies Fricker’s framework, in particular her concepts of testimonial and hermeneutical injustice, to explain some of the reasons for adults’ disquiet around children’s participation rights. Fricker’s concept of testimonial injustice explains how prejudice about a social group results in deflated attributions of credibility to their views and opinions. Hermeneutical injustice occurs when a social group struggles to make sense of their social experiences because of insufficient interpretive resources in the collective social imagination. By applying these concepts to children, I highlight the role of silence in conceptualising children’s right to be heard and to freedom of expression. However, there are ongoing questions over its universal applicability. In this paper I offer a critical examination of children’s rights, focusing on the uneven distribution rather than universal spread of rights which dominates the discourse. The paper focuses on educational rights in terms of frames of reference that limit children’s access to rights, including mass compulsory schooling, futurity and discursive forms of participation. Drawing on the illustrative case of young carers in England, the paper argues this critical conception of schooling restricts children’s access to formal education, marginalising their material and emotional contributions to their families and communities. The state claims an interest in enforcing immigration control by removing the adult. The child, on the other hand, has an interest in maintaining their relationships with both of their parents, as well as the practical and cultural benefits of growing up in the country of their nationality or habitual residence. How to decide between these competing claims is of practical and theoretical importance in human rights determinations under Article 8 echr and Article 3 uncrc. This article investigates the theoretical distinction which is drawn between decisions about a child and decisions affecting a child, and argues that this approach is problematic. First, Article 8 echr is an incomplete vehicle for determining the best interests of the child.
