Wenn man aber eine solche, verbreitete Beurteilung wissenschaftlich naher erforschen m6chte, muB man klarstellen, in welchem Sinn man es so sagen darf. Als eine unentbehrliche Voraussetzung solcher tJberlegungen behandelt dieser Aufsatz die eigene Rechtsvorstellung Friedrichs unter besonderer Berucksichtigung der sozialen Funktion des Gesetzbuches und des Juristen. Diese Auswahl ist gerechtfertigt, weil es eine wichtige und typische Problematik in der friderizianischen Rechtspolitik gibt, die die ganze Regierung kennzeichnet.* Im allgemeinen wird der aufgekiarte Absolutismus Friedrichs als ein eigenartiges, zeitgemaBes Zusammenspiel von Sozialdisziplinierung und Aurklarung charakterisiert, die auch im Bereich des Rechtslebens eine wichtige Rolle spielte und eine der geistigen Grundlagen des ALR war.2 Aus diesem Grund wird hier zuerst (1.) Nearly half a century has passed, the study of State responsibility at the ILC seems to be reaching its final stage, and it is expected that the second reading of the draft articles will be finalized in the year 2001. The on-going codification of the law of State responsibility is a unique project in the history of the ILC in the sense that it intends to codify \"secondary rules\" of international law. The notion of secondary rule in international law may have at least three different meanings according to different references. According to one author, procedural rules, as opposed to substantial rules, constitute secondary rules in terms of their content.[ Another author makes use of the concept of \"secondary rule\" in terms of the timing of the application of the rule.2 In this sense, the secondary rule is applied after some other (primary) rules have already been applied. One can also assert that the secondary rule is a \"rule for rule\" or \"meta-rule\" in terms of a vertical relationship with another rule. Although it must be noted that the draft articles on State responsibility do contain secondary rules in the three senses of the term, Draft Article 40, entitled \"Meaning of injured State\", seems to constitute a secondary rule as defined in the third interpretation above, in as much as it does not purport to impose any concrete obligations, or confer any concrete rights, substantial or procedural, on States. {"title":"Politics versus Economics: An Overview of International Political Economy","authors":"T. This discipline initially emerged from the field of International Relations that came into being after World War I, but it differs from the previous studies in many aspects. The most significant characteristic of IPE can be found in the emphasis it places on the interactions between the economics and the politics. The students of International Relations have traditionally regarded as critically and centrally important the military and security aspects of power politics and considered the balance of power as the ultimate mechanism to secure stability. IPE necessitates a shift, if not a change, in this preset perception, treating the economics as an equally significant factor. IPE reflects the dynamic and turbulent political and economic course of events after World War II. Throughout the Cold War, military and security issues were inevitably defmed as the \"high politics\" and played a crucial role. Needless to say, the economics, confined in the bounds of the \"low politics,\" attracted considerably less attention. However, as the Cold War structure diversified and deteriorated, and as the Bretton Woods regime gradually lost its effectiveness in maintaining the economic coalition within the Western bloc, economic issues began to seem far more problematic than ever. Furthermore, with the collapse of the Soviet Union and the end of the Cold War, military and security issues ceased to receive the contemplation and cogitation that it had enjoyed. Instead, the economics came to assume more importance. Such issues as trade conflicts between nations, restructuring of the international economic order, and international competition involving industrial productivity and technological advancement came to present themselves as highly strategic. More to the point, these events elevated the economics to the realm of the \"high politics.\" IPE has thus emanated as a viable and practical medium by which the international relations in the present can be effectively analyzed. As each state strives to increase its individual productivity and to nurture its high technology industries, interactions among nations do not and cannot only remain political but they also become economic. Most influenced were German, French and English law. It is not surprising that they are also the main objects of the comparative study today. These laws are at the same time great families of law. There are several families of law in the world. While there is broad agreement over the existance of these families exactly how they are defined, details varies from theory to theory. The first family is the European Continental Law, which has its origins in Roman Law. This family can be divided in two, e,g, the German law and the French law. The second family is the Anglo-American law. One of the drafters of our Civil Code, Hozumi, also referred to the \"Great families of law\"I. He classifies seven great families of laws. (i) the family of Chinese law, (ii) the family of Hindu law, (iii) the family of Mohammed law, (iv) the family of Roman law, (v) the family of Germanic law, (vi) the family of Slavonic law and (vii) the family of English law.
