The literature study method is used by collecting information from relevant sources such as books, journals, and related documents. The results show that Islamic law provides a robust framework for each child to contribute to society through values such as Justice, balance, and social responsibility. Implementing children's rights in Islamic law creates holistic growth and positive social change. Educational institutions, families, communities, and the state are essential in upholding the child's rights. Despite challenges such as diverse interpretations, gender imbalances, and social problems, opportunities lie in the flexibility of Islamic law and the involvement of activists and civic organizations. Dalam pembahasan diuraikan bahwa dalam Konstitusi Indonesia Desentralisasi asimetris ditegaskan dan diakui hingga saat ini. Terdapat 4 (empat) daerah yang mempunyai ciri khusus dalam pengisian jabatan kepala daerahnya. Keempat daerah tersebut adalah DKI Jakarta, Daerah Istimewa Yogyakarta, Papua, dan Aceh. Realita pada pemerintahan daerah, landasan yuridis konstitusional berlakunya desentralisasi asimetris tersebut dapat ditinjau pada Pasal 18A ayat (1), dan Pasal 18B ayat (1) UUD 1945. This is reinforced by the regulation in PP No. 2 of 2007, the revocation was carried out by the president must go through a legal process. The legal process referred to is not the litigation process, but the HAN process, namely the Menkumham examines, after being reviewed it is feasible to revoke the status of the former ISIS member's Indonesian citizen, then the Menkumham submits it to the President, and continues with the issuance of a Presidential Decree. However, there is a problem, if the Government complies with the positive law regarding the revocation of the status of Indonesian citizens. Ex-members of ISIS seem undemocratic, because it is only based on a Presidential Decree issued based on the recommendations of the Ministry of Law and Human Rights. For this reason, the author is interested in writing about the revocation of the status of Indonesian citizens who are former members of ISIS which is in accordance with the concept of a democratic rule of law, but also prioritizes effectiveness and time efficiency. The author considers that the revocation of the status of Indonesian citizens who are ex-ISIS members by the government is something that is logical for now, but the government before revoking the status of Indonesian citizens who are ex-ISIS members must ask for consideration from the Constitutional Court as a bodyguard, and interpreters of Pancasila and the Constitution through the revision of the Constitutional Court Law and the Citizenship Law. AbstrakMenurut Pasal 23 Ayat (1), Huruf d UU Kewarganegaraan, WNI kehilangan status kewarganegaraannya dengan beberapa alasan, yaitu salah menjadi tentara asing tanpa izin terlebih dahulu dari Presiden. Hal ini diperkuat oleh pengaturan dalam PP No.2 Tahun 2007, pencabutan itu dilakukan oleh presiden harus melalui proses hukum. Proses Hukum yang dimaksud bukan Proses Litigasi, akan tetapi Proses HAN, yakni Menkumham memeriksa, setelah dikaji layak untuk dicabut status WNI Mantan Anggota ISIS ini, selanjutnya Menkumham menyerahkan ke Presiden, dan dilanjutkan dengan dikeluarkan Keppres. Akan tetapi ada problematik, jika Pemerintah tunduk pada hukum positif tentang pencabutan status WNI Mantan Anggota ISIS terkesan tidak demokratis, karena hanya berdasarkan Kepres yang dikeluarkan berdasarkan Rekomendasi Kemenekumham. This can create a legal vacuum or the obscurity of election crimes in the field of electronics in the use of electronic election systems. Although Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions generally regulates electronic crimes, the 11 articles of electronic crimes do not regulate electronic crimes at the time of the election stage. The electronic election crime above will guarantee protection for all applications that will be implemented by the KPU in carrying out the 2024 election stages. In the context of this crime, the \"electronic election system\" includes all electronic systems used by the KPU in accordance with the Decree of the General Election Commission of the Republic of Indonesia Number 13/TIK.03/14/2022 concerning Plans for Electronic-Based Government Systems. In this study, a normative juridical method was used with a statutory approach to study the legal basis, legal principles, and regulatory processes related to postponing elections in Indonesia. journals or surveys conducted by credible research institutions. The results of the discussion stated that the results of a survey conducted by Indonesia Political Opinion on the postponement of the general election in 2024, the result was that the approval rate was only 23% while the rejection rate was 77%. The details are 31% strongly disagree, 46% disagree. Besides that, through the General Election Commission Decree Number 21 of 2022 the implementation of the elections was set for February 14, 2024. The Central Jakarta District Court decision number 757/Pdt.G/2022/PN Jkt Pst which required the KPU to postpone the elections has also been annulled by the Jakarta High Court . Furthermore, related to efforts to postpone constitutional and comprehensive elections is by changing the provisions of the articles contained in the 1945 Constitution of the Republic of Indonesia, another way is by issuing a Presidential Decree. The conclusion of this article states that the chance of postponing the election is very small and even if it has to be postponed the correct procedures and procedures are only through amendments to the 1945 Constitution of the Republic of Indonesia. AbstrakTujuan penelitian ini adalah untuk menakar peluang terjadinya penundaan pelaksanaan Pemilu 2024 dalam perspektif Hukum ketatanegaraan di Indonesia. Dalam penelitian ini, digunakan metode yuridis normatif dengan pendekatan perundang-undangan untuk mempelajari dasar hukum, prinsip-prinsip hukum, dan proses pengaturan terkait penundaan pemilu di Indonesia, selain itu digunakan juga sejumlah dokumen hasil riset terdahulu dalam rangka memperkuat argumentasi penelitian, baik dalam bentuk jurnal ataupun survei yang dilakukan oleh lembaga peneliti kredibel. Hasil pembahasan menyatakan bahwa hasil survei yang dilaksanakan oleh Indonesia Political Opinion terhadap penundaan pemilihan umum di tahun 2024, hasilnya tingkat persetujuan hanya berada pada angka 23% sementara tingkat penolakan sebanyak 77%. Rinciannya 31% sangat tidak setuju, 46% tidak setuju. Disamping itu, melalui Keputusan Komisi Pemilihan Umum Nomor 21 Tahun 2022 pelaksanaan pemilu ditetapkan pada tanggal 14 februari 2024. Putusan PN Jakarta Pusat nomor 757/Pdt.G/2022/PN Jkt Pst yang mengharuskan KPU untuk menunda pemilu juga telah dibatalkan oleh Pengadilan Tinggi Jakarta. This study attempts to address the issue of early marriage in relation to the court's ability to grant dispensation from marriage as a requirement for legalizing marriage for those who have not reached the legal marriageable age through a constitutional approach, legal sociology, and legal anthropology. The review revealed that the majority of the dispensation petitions submitted had been approved. The judge uses procedural and substantive factors based on laws and regulations to decide the marriage dispensation case, taking into account the facts of the case while also paying attention to the fiqh and the guiding principles of Islamic law, which are derived from the verses of the Koran and hadith. Although there is a perception that judges are quick to grant requests or are thought to play a role in South Kalimantan's legalization of early marriage.AbstrakFokus kajian ini adalah mengenai tingginya pernikahan dini di Kalimantan Selatan baik yang dilakukan dibawah tangan maupun yang dilakukan scara resmi dengan fasilitas dispensasi kawin dari pengadilan. Untuk selanjutnya menelaah secara mendalam pertimbangan hukum hakim Pengadilan Agama di Kalimantan Selatan dalam memproses perkara dispensasi Kawin. Melalui pendekatan konstitusional dan pendekatan sosiologi hukum dan antropologi hukum penelitian ini mencoba menjawab persoalan pernikahan dini dikaitkan dengan kewenangan pengadilan dalam memberikan dispensasi kawin sebagai syarat untuk melegalkan perkawinan bagi mereka yang belum mencapai usia minimal kawin. Dari telaah yang dilakukan mendapatkan temuan bahwa sebagian besar permohonan dispensasi yang diajukan adalah dikabulkan. Hakim dalam memutus perkara dispensasi kawin didasarkan kepada fakta persidangan dengan menggunakan pertimbangan prosedural dan substansial yang di dasarkan peraturan perundangan dengan tetap memperhatikan prinsip Hukum Islam yang bersumber dari ayat ayat al Quran dan hadis serta kaidah kaidah fikih. Metodologi penelitian yang digunakan penulis dalam memecahkan permasalahan ini ialah dengan menggunakan penelitian hukum normatif. Menggunakan penelitian hukum normatif karena pada praktinya, penulis menggunakan bahan pustaka yang ada untuk dilakukan penelitian. Kemudian lanjut pada tahap penelitian, penulis menggunakan bahan hukum sekunder seperti, buku, jurnal, artikel dan karya tulis lainnya yang dianggap penulis memiliki kesinambungan dengan permasalahan yang sedang penulis telititi. Karena penulis menggunakan penelitian hukum normatif maka teknik pengumpulan data yang dilakukan oleh penulis ialah dengan cara bahan pustaka atau studi dokumen serta untuk menganalisis bahan hukumnya penulis menggunakan teknik dedukasi dan interpretasi yaitu menganalisis bahan hukum yang ada secara umum ke khusus dan melalui penafsiran. Regulasi pengaturan terkait pemberantasan tindak pidana korupsi yang ada di Singapura lebih membedakan kepada pelakunya yaitu pejabat atau pegawai swasta. Sedangkan di Indonesia lebih kepada delik yang dilakukannya. Lembaga independen CPIB yang ada di Singapura sebelumnya merupakan bagian dari kepolisian namun kemudian ia memisahkan diri akibat adanya penyuapan didalam lembaga kepolisian tersebut. Sedangkan di Indonesia KPK hadir sebagai upaya pemberantasan tindak pidana korupsi yang menggantikan lembaga-lembaga sebelumnya yang dianggap kurang efektif dalam melaksanakan tugas dan wewenangnya. The reluctance to take care of the inheritance, the amount of debt left behind, to the desire to give their inheritance to other heirs who need it more is one of the many reasons put forward by the heirs for refusing. However, the concept of refusal of this kind is not found in Islamic inheritance law. Even though the reasons above do not rule out the possibility of being experienced by Muslim heirs. Therefore this paper aims to analyze the refusal to become an heir in the perspective of Islamic law and the Civil Code. This paper uses a normative juridical research method with three (3) approaches namely, statutory approach (statute approach), conceptual approach (conceptual approach) and comparative approach (comparative approach). The conclusion that the author draws is that the Islamic inheritance system does not recognize any refusal to become an heir because the inheritance system uses the principle of ijbari. While in kuperdata, warus can refuse to become heirs as long as the refusal is made expressly before the court where the inheritance is.AbstrakPenolakan menjadi ahli waris merupakan salah satu hal yang dimungkinkan dalam KUHPerdata. Adanya keengganan mengurus harta waris, besarnya hutang yang ditinggalkan, hingga keinginan untuk memberikan harta waris miliknya kepada ahli waris lain yang lebih membutuhkan merupakan salah satu dari sekian banyak alasan yang diajukan ahli waris untuk melakukan penolakan. Akan tetapi kosnep penolakan semacam ini tidak ditemui dalam hukum kewarisan islam. Padahal alasan-alasan diatas tidak menutup kemungkinan juga dialami oleh pewaris muslim. Oleh karenanya tulisan ini bertujuan untuk menganalisis penolakan menjadi ahli waris dalam prespektif hukum islam dan KUHperdata. Tulisan ini menggunakan metode penelotian yuridis normatif dengan tiga (3) pendekatan yakni , pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan perbandingan (comparative approach). Adapun kesimpulan yang penulsi ambil adalah sitem kewarisan islam tidak mengenal adanya penolakan menjadi ahli waris karen sistem pewrisanya menggunakan asas ijbari. This research is normative legal research conducted through library research by conducting studies and analyzing primary, secondary and tertiary legal materials. In this writing, researchers also conducted observation activities on Legal Politics in the Changes to the Criminal Code. The problems that will be studied in this research are: (1) How is the politics of criminal law in Indonesia? (2) How is legal politics in criminal law reform in Indonesia? This research is normative legal research using normative case studies in the form of legal behavior products. The results of the research show that it is time to update the criminal law of the Dutch colonial legacy which is still based on the principles and foundations of that time and replace it with a criminal law system and a new criminal law that is more relevant to the lives of Indonesian people.AbstractTulisan ini ingin mencoba memberikan gambaran tentang Politik Hukum Perubahan KUHP di Indonesia, baik secara teori normatif hukum maupun dalam prakteknya.
