{"title":"ОБЫЧНО-ПРАВОВОЕ РАСТОРЖЕНИЕ БРАКА","authors":"Эркин Валериевич Енчинов","doi":"10.7816/SAD-01-01-04","DOIUrl":"https://doi.org/10.7816/SAD-01-01-04","url":null,"abstract":"Abstract: In the Altai society of the end of XX – the beginnings of the XXI centuries marriage is made out through official registration in the Registry Office, and through a traditional wedding with offerings to fire, Spirit of Altai. There are two processes in divorce: in the Registry Office or court and traditional divorce proceedings. \"Airylysh\" traditional divorce in the Altai culture is a long process with participation of the parties from the husband and the wife. Today Altaians have two types of traditional divorce procedures: with participation of representatives from two parties and the sprinkling of ritual milk with the subsequent cutting of a ritual curtain; one-way \"notification\" of the fire, without ritual offering of milk. All procedure is carried out by \"neme biler kizhi\" (alt. a man who knows something, a clairvoyant). Procedure of divorce is carried out by \"neme biler kijzi\", a traditional judge. There are following stages of divorce proceedings: 1) the pre-judicial; 2) court; 3) post judicial (judgment execution). The objective of the traditional court is to keep family together but if the parties decided to stop their relations, traditional court makes decision. Decisions of traditional court have advisory nature. Duranli","doi":"10.7816/SAD-01-01-01","DOIUrl":"https://doi.org/10.7816/SAD-01-01-01","url":null,"abstract":"OZET Carligin toprak ve yeni kaynak arayislari, XVIII. yuzyilda Sibirya topraklarinda yapilan arastirmalara buyuk bir hiz verilmesini saglamistir. 1725- 1730 tarihleri arasinda Birinci Kamcatka Arastirma Grubu’nun, 1733- 1743 tarihleri arasinda da Ikinci Kamcatka Arastirma Grubu’nun calismalari, Rusya’nin Sibirya’daki hakimiyetini arttirmasini, ulke ekonomisine yeni kaynaklar saglamasina yardimci olmustur. Genel olarak duzenli bir devlet sisteminden uzak olan Sibirya’nin yerli halklari topraklarina gelen bu yeni sistemle uzlasmak durumunda kalmistir. I. Petro’nun hayallerini gerceklestiren arastirma gezileri, Sibirya topraklarinin sadece cografi, yer alti ve yer ustu kaynaklar acisindan incelemekle kalmamis, bu topraklari yurt edinmis kucuk topluluklarin da cok yonlu incelenmesini saglamistir. Ikinci Kamcatka Arastirma Grubu kadrosunda yer alan, Yakov Ivanovic Lindenau, baslangicta bu arastirma grubunun siradan bir cevirmeni olarak Sibirya topraklarina gelir. Zaman icinde gerek cografi tasvirleri gerekse basta Yakut olmak uzere, diger Sibirya halklarinin cok yonlu tasvirleriyle bu alanda onemli calismalar yerine getirir. Avrupa kokeni Rusya vatandasi Lindenau’nun raporlarinin genel olarak Almanca yazilmis olmasi, onun bu donemde sadece basit bir “cevirmen” olarak gorulmesi onun bilimsel mirasinin uzun yillar goz ardi edilmesine neden olmustur. Makalede Yakov Ivanovic Lindenau’nun hayati, onun Sibirya arastirmalari icindeki yeri, Yakut kulturu ile ilgili calismalara katkisi ele alinmaya calisilacaktir.
