Abstract

Abstract: In the Altai society of the end of XX – the beginnings of the XXI centuries marriage is made out through official registration in the Registry Office, and through a traditional wedding with offerings to fire, Spirit of Altai. There are two processes in divorce: in the Registry Office or court and traditional divorce proceedings. "Airylysh" traditional divorce in the Altai culture is a long process with participation of the parties from the husband and the wife. Today Altaians have two types of traditional divorce procedures: with participation of representatives from two parties and the sprinkling of ritual milk with the subsequent cutting of a ritual curtain; one-way "notification" of the fire, without ritual offering of milk. All procedure is carried out by "neme biler kizhi" (alt. a man who knows something, a clairvoyant). Procedure of divorce is carried out by "neme biler kijzi", a traditional judge. There are following stages of divorce proceedings: 1) the pre-judicial; 2) court; 3) post judicial (judgment execution). The objective of the traditional court is to keep family together but if the parties decided to stop their relations, traditional court makes decision. Decisions of traditional court have advisory nature. Keywords: altai people, customary law, divorce.
