For obvious reasons, however, the context has radically changed. Most of the factors which have lent shape and substance to this concept are now undergoing a profound transformation. The endpoint of this process is still nowhere in sight. We are experiencing a phase of transition which radically affects two categories, those of time and space, which have always been a focus of reflection on political philosophy. And as in every age of transition, a sense of emptiness and suspension is in the air: the presence of something new which is developing and gradually establishing itself, while the “old” still endures and continues to influence historical and social reality. In facing this phase of transition, a clear awareness emerges: the current global disorder cannot be addressed and resolved by reverting to some kind of Westphalian order. Still, borders remain the space that defines a given territory, preserving the homogeneity of shared space from the intrusion of external/alien elements. El papel de la justicia constitucional en la reglamentacion social en un contexto de grave crisis economica involucra la naturaleza de la racionalidad que orienta estas pronunciaciones del Juez de las leyes. Se comparan racionalidad economica y racionalidad juridica por medio del filtro de dos perspectivas teoricas diferentes. El aparato teubneriano se vuelve analizar para intentar garantizarle al derecho el control de las tendencias expansivas de la racionalidad economica. La oscilacion de la jurisprudencia constitucional entre las dos racionalidades y los cambios de paradigma interpretativo impuesto con la modificacion de la misma Carta fundamental con el nuevo art. 81, parecen dificultar esta solucion. Si el pronostico marxista mas perspicaz con respecto al soft power atane a la subsuncion real, al mismo tiempo esta no puede adquirir el perfil de dispositivo ontologico, tal y como se destaca de los analisis de los textos marxianos de Antonio Negri. Bajo esta perspectiva, la confesion se toma como reconocimiento a traves de la cual el sujeto autentica en si mismo sus propias acciones y pensamientos. Por lo tanto, no es solo un acto verbal por medio del cual el sujeto establece la verdad de su ser; la confesion tambien une el sujeto a la verdad, colocandolo en una relacion de dependencia con el otro y, al mismo tiempo, cambiando la relacion que el establece consigo mismo. Segun Foucault, esto es lo que explica el crecimiento masivo de las practicas de la confesion en las sociedades occidentales hasta su inscripcion efectiva en el corazon de los procedimientos de individualizacion del poder politico moderno. Este articulo explora el analisis de Foucault de las practicas confesionales y sus recientes avances en el trabajo de Giorgio Agamben (Opus Dei. Archeologia dell’Ufficio, 2012) y Roberto Esposito (Due.
