Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dan yuridis empiris. Hasil penelitian menunjukkan bahwa pertama, implementasi pemenuhan hak atas reparasi bagi perempuan korban konflik Aceh belum berjalan sesuai dengan hukum internasional. Kedua, ada faktor-faktor yang menyebabkan pemenuhan hak atas reparasi bagi perempuan korban konflik Aceh belum berjalan sebagaimana mestinya.This research aims to examine the implementation of fulfillment of the right to reparations for women victims of armed conflict in Aceh and its compliance with international law. The methods employed in this research are doctrinal and empirical legal research. The research found that firstly, the fulfillment of right to reparations for women victims of armed conflict in Aceh has not been implemented in compliance with international law. Tujuan penulisan artikel ini untuk membahas implementasi peran Ombudsman RI dalam pengawasan kinerja Pemerintah di Kota Banda Aceh dan mengetahui tentang kendala dan hambatan yang dihadapi Ombudsman serta upaya pencegahan dan penyelesaian. Metode penelitian menggunakan pendekatan yuridis empiris, yaitu menelaah hukum sebagai pola prilaku yang ditujukan pada penerapan peraturan hukum. Berdasarkan hasil penelitian, peran Ombudsman dalam melakukan pengawasan terhadap kinerja Pemerintah di Kota Banda Aceh belum sepenuhnya sesuai dengan fungsi, tugas dan kewenangan yang diatur Undang-Undang, disebabkan karena masih adanya kendala yang dihadapi.The function and the duty of Ombudsman must be implemented to overcome the maladministration which can cause disadvantageous to the state and society. This research aims to find out and describe the role of Aceh Ombudsman in supervising the work performance of Banda Aceh government and to discuss the obstacles faced by Aceh Ombudsman and prevention efforts and socialization supervising to overcome the barriers. The method used of this study is juridical-empiric approach to analyze law based on the behavior pattern related to the law regulation implementation. Ketua Badan Pengawas Pemilihan Umum (Bawaslu) Republik Indonesia mengeluarkan Surat Edaran Nomor: 0240/K.Bawaslu/TU.0001/III/2017 tentang Penegasan Masa Tugas Lembaga Pengawas Pemilihan Umum Ad Hoc dalam Rangka Pemilihan Gubernur dan Wakil, Bupati dan Wakil Bupati dan/atau Walikota dan Wakil Walikota Tahun 2017. Surat Edaran tersebut disimpulkan bahwa masa kerja Panwaslih di Aceh berakhir pada bulan Mei bagi daerah yang terdapat penyelesaian sengketa di Mahkamah Konstitusi dan bulan Juni bagi daerah yang vakum sengketa. Hal ini mengakibatkan ketidakpastian hukum bagi penyelenggara Pemilihan Kepala Daerah dan menimbulkan kegaduhan dalam internal Panwaslih di Aceh. Penelitian ini mengkaji bagaimanakah kedudukan dan  kekuatan hukum Surat Edaran Bawaslu, mengkaji kepastian hukum masa kerja Panwaslih di Aceh atas keputusan Bawaslu Republik Indonesia yang telah mengeluarkan Surat Edaran yang dijadikan rujukan Pemerintah Aceh untuk merevisi Peraturan Gubernur sebelumnya mengenai masa kerja Panwaslih di Aceh. Metode Penelitian yang digunakan adalah penelitian normatif atau penelitian hukum kepustakaan.The article 60 paragraph (4) of the Act Number 11, 2006 concerning the Government of Aceh stated that the working period of the Election Committee ends 3 (three) months after the inauguration of the elected regional head, while in other juridical regulations especially the Act Number 15, 2011 concerning the General Election Organizer and the Election stipulates to expire no later than 2 (two) months after all stages of the election are completed. Pasal 1 angka 2 Undang-Undang Nomor 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial menyatakan bahwa Jaminan sosial adalah salah satu bentuk perlidungan sosial untuk menjamin seluruh rakyat agar dapat memenuhi kebutuhan dasar hidupnya yang layak. Dalam Pasal 224, 225, dan 226 Undang-Undang Nomor 11 tahun 2006 tentang UUPA, kewajiban kepada Pemerintah Aceh untuk memberikan pelayanan kesehatan secara menyeluruh kepada penduduk Aceh terutama penduduk miskin, fakir miskin, anak yatim dan terlantar. Pasien BPJS Kelas 3 di beberapa Rumah Sakit di Kota Banda Aceh memerlukan perlindungan secara hukum dalam menerima pelayanan kesehatan yang bertujuan menjamin adanya kepastian hukum yang didapatkan oleh pasien, sehingga pasien terhindar dari kerugian saat menerima pelayanan kesehatan yang seharusnya diberikan secara baik dan optimal oleh tenaga kesehatan.Kerugian sebagaimana dimaksud berupa kerugian atas kerusakan, pencemaran, dan atau kerugian menderita penyakit/cacat sebagai akibat perbuatan/kesalahan dokter. Bentuk ganti kerugian berupa perawatan kesehatan dalam rangka memulihkan kondisi pasien, pengembalian uang atau pengembalian barang dan atau pemberian santunan yang sesuai dengan ketentuan perundang-undangan.National Social Security Agency (BPJS) has a function to conduct national health of social security based social insurance principle and equity principle aiming at securing the members in order to obtain the benefit of health care. Article 1 point 2 of the Act Number 24, 2011 regarding National Social Security Agency stipulates that Social Security is one of the forms of social protection in securing all people to fulfill basic need of proper lives. Articles 224, 225, and 226 of the Act Number 11, 2006 regarding Aceh Governance Act oblige the Aceh Government especially the poor, orphan and abandoned kids. Patients of the National Social Security Agency of Class 3 in several hospitals in Banda Aceh need law protection in providing health services aiming to secure the existence of law certainty acquired by the patients hence it prevents from the loss while accepting the health services that should be provided well and optimally by medical staffs. The loss aforementioned are damages, contamination, or suffering from illness/disability resulted from medical malpractice. Tanah dikatakaan diterlantarkan, menurut Pasal 6 ayat (1) PP No. 11 Tahun 2010 tentang Penertiban dan Pendayagunaan Tanah Terlantar, hak milik tersebut diidentifikasi dan diteliti terlebih dahulu. Apabila upaya penertiban yang diatur dalam PP No. 11 Tahun 2010 tidak dipatuhi oleh pemiliknya, menurut Pasal 9 ayat (2) PP No. 11 Tahun 2010 Kepala BPN atas usul Kepala Kantor Wilayah BPN menetapkan tanah tersebut sebagai tanah terlantar, sehingga menjadi tanah yang dikuasai langsung oleh Negara. Walaupun penelantaran tanah dapat mengakibatkan hapusnya hak atas tanah, akan tetapi dalam kenyataannya di Kota Banda Aceh masih dijumpai adanya hak milik atas tanah yang diterlantarkan (terindikasi terlantar). Hasil penelitian menunjukkan bahwa hak milik atas tanah yang terindikasi terlantar di Kota Banda Aceh belum dapat dikategorikan sebagai tanah terlantar, karena penelantaran tersebut bukan dilakukan dengan sengaja. Penelantaran tanah termasuk hak milik atas tanah dapat mengakibatkan terganggunya keindahan Kota Banda Aceh dan dapat mengganggu warga masyarakat di sekitarnya. Upaya yang ditempuh pihak Kanwil BPN Provinsi Aceh terhadap hak milik atas tanah yang terindikasi terlantar di Kota Banda Aceh sampai saat ini hanya baru sebatas melakukan pemantauan di lapangan, yang dilakukan oleh pihak Kantor Pertanahan Kota Banda Aceh.Article 27 of the Act Number 5, 1960 on the Fundamental Agrarian Rules states known as the Agrarian Act (later celled as UUPA) that the right of owning the land title right states that the right is void if it is owned by a state one of those is it is abandoned. The land can be deemed as abandoned land, pursuant to Article 6 (1) of the Government Regulation Number 11, 2010 regarding the Enforcement and Empowerment of Abandoned Land,the Right is identified and investigated in order to determine whether the land can be deemed as abandoned land. Despite the fact that he abandonment of the land causes the void of the right in Banda Aceh can be found the right that is abandoned (indicated abandoned). The research shows that the right, which is indicated abandoned in Banda Aceh, has not been grouped as abandoned land as the abandonment is not done intentionally. The abandonment of the land might be said as the factor causing the insight views of Banda Aceh and it can disturb the society around the land. Penelitian ini bertujuan untuk mengetahui pengaturan dan pembinaan terhadap narapidana yang mengalami gangguan kejiwaan dalam lapas dan mengidentifikasi kepastian hukum bagi narapidana yang sedang mengalami gangguan kejiwaan serta mengetahui status hukum bagi narapidana yang sembuh dari gangguan kejiwaan. Metode penelitian adalah normatif-empiris dengan menggunakan jenis penelitian deskriptis analisis. Hasil penelitian menunjukkan bahwa Pengaturan tentang perawatan narapidana yang mengalami gangguan jiwa dalam lembaga pemasyarakatan di Indonesia belum diatur. Adapun mengenai narapidana yang mengalami gangguan kejiwaan di lembaga pemasyarakatan di Indonesia hingga kini belum ada kepastian hukum karena kasus seperti ini hampir tidak pernah terjadi di Indonesia. Terkait status hukum narapidana yang sembuh dari gangguan kejiwaan masih tetap sebagai tersangka (ditahan). Tidak ada keringanan hukuman apalagi sampai dibebaskan sebelum masa hukuman habis dijalankan.Law No.12 / 1995 on Penal Institutions and Government Regulation no. 99 Year 2012 on the Second Amendment to Government Regulation Number 32 Year 1999 concerning Terms and Procedures for Implementation of Rights of Citizens of Correctional Penitentiaries does not explain the provisions of prisoners who are crazy in prisons as happened in prisons Class II-A Lambaro on behalf of Zabir bin Ilyas. This study aims to determine the regulation and guidance of prisoners who experience psychiatric disorders in prisons and identify legal certainty for inmates who are experiencing psychiatric disorders and know the legal status for prisoners who recover from psychiatric disorders. The research method is normative-empirical by using type of descriptive analysis research. The results of the study indicate that the regulation of the treatment of inmates who are mentally ill in prisons in Indonesia has not been regulated. As for the inmates who suffered psychiatric disorders in prisons in Indonesia until now there is no legal certainty because cases like this almost never happen in Indonesia. Related to the legal status of convicts who recover from psychiatric disorders still remain as a suspect (arrested). Hasil penelitian menunjukan kendala pelaksanaan pemidanaan anak sebagai pelaku jinayah yaitu karena Faktor perundang-undangan, Faktor Aparatur, Faktor sarana prasarana, Faktor Masyarakat, seperti belum adanya penyidik anak yang bersertifikasi, dan aturan proses pelaksanaan eksekusi terhadap Anak belum ada, sehingga Anak sebagai pelaku dalam Qanun Jinayat sama dengan proses penanganan perkara terhadap orang dewasa yang membedakan hanya mengenai pemidanaannya dan tata cara pelaksanaan 'Uqubat terhadap anak yang tidak diatur dalam peraturan perundang-undangan mengenai sistem peradilan anak diatur dalam Peraturan Gubernur sehingga menjadi kendala tersendiri dalam penyelesaian perkara anak yang melakukan tindak pidana yang diatur dalam Qanun. Disarankan agar Pemerintah Aceh segera membentuk dan mengundangkan Peraturan Gubernur sebagai aturan pelaksana dalam pelaksanaan eksekusi terhadap Anak yang melakukan pidana sebagaimana diatur dalam Qanun Aceh Nomor 6 tahun 2004 Tentang Hukum Jinayat. Dan diharapkan pula hakim sebagai pemutus perkara mampu memberikan rasa keadilan bagi masyarakat.Acoording to Article 66 of Qanun Aceh Number 6, 2014 regarding Islamic Criminal Law states that if a child under the age of 18 (eighteen) years committing a crime or allegedly committing Islamic criminal law, then the child shall be subjected to a Juvenile Justice statutes, Article 67 Paragraph (1) Qanun Number 6, 2014. The research shows that a child as a perpetrator in Qanun Jinayat is similar to the trial process of the cases against adults but in terms of punishments and the procedure of implementing punishments on the procedure of implementation of punishment for children as the perpetrators of criminal acts regulated in Qanun becomes its own constraint in settling the case of juvenile committing crime in Qanun. It is recommended that The Government of Aceh should immediately establish and enact the Governor Regulation as the implementing rule in executing the execution process of the youth offenders as stipulated in Qanun Aceh Number 6, 2004 on Islamic Criminal Law committed by a child by not ignoring the principles of child protection as a child and a victim. For law enforcement officers including judges are expected to have legal psychological knowledge that can sustain deep analysis and legal considerations in imprisonment or custody. Qanun  Aceh Nomor 6 Tahun 2014 tentang  Hukum Jinayat, memberikan pengertian tentang Pelecehan Seksual pada Bab I ketentuan umum Pasal (1) ayat ke - 27 yaitu:  Pelecehan seksual adalah perbuatan asusila atau perbuatan cabul yang sengaja dilakukan seseorang didepan umum atau terhadap orang lain sebagai korban baik laki-laki maupun perempuan tanpa kerelaan korban. Penelitian ini bertujuan untuk mengetahui bagaimana Penegakan Hukum Pelecehan Seksual pada Anak, dalam Sistem Peradilan Jinayat, hubungan sistem Peradilan Jinayat dengan Sistem Peradilan Pidana Anak. Penulisan karya ilmiah ini  menggunakan jenis  penelitian  hukum  normatif, di mana penelitian hukum yang menggunakan sumber data primernya merupakan norma-norma yang berlaku baik yang berupa Kitab Undang-Undang Hukum Pidana (KUHP) dan peraturan Perundang-Undangan, Qanun, dengan pendekatan library research. Disarankan kepada Pemerintah perlu secepatnya membuat langkah-langkah strategis, rencana aksi dan penerapan sanksi yang tegas terhadap prilaku seks yang menyimpang. Dewan Perwakilan Rakyat Aceh (DPRA) perlu membuat aturan lebih lanjut termasuk aturan acaranya agar permasalahan ini menjadi lebih jelas dan pasti sehingga terhdap korban mendapatkan suatu kepastian hukum dan nasibnya menjadi lebih jelas serta terpenuhi hak-haknya.The Act Number 35, 2014 which is the revision of the Act Number 23, 2002 on the Child Protection which in the Act explains the obligation to provide protection to children, but the criminal provisions for perpetrators of child abuse in the Act are still very weak as a basis for dealing with child abuse cases.
