Rasyid","doi":"10.24815/SKLJ.V3I1.12530","DOIUrl":"https://doi.org/10.24815/SKLJ.V3I1.12530","url":null,"abstract":"Putusan No. 1531 K/Pid.Sus/2010 Mahkamah Agung memutus bebas terdakwa tindak pidana narkotikabernama Ket San.Salah satu pertimbangan utama Mahkamah Agung adalah perihal kedudukan 2 (dua) orang polisi yang menangkap Ket San yang kemudian juga hadir sebagai saksi dipersidangan. Permasalahan yang perlu dikaji yaitu hubungan antara tersangka dengan polisi penangkapdan pembuktian kesaksian polisi penangkap dalam perkara tindak pidana penyalahgunaan narkoba.Tujuan penulisan untuk mengetahui hubungan antara tersangka dengan polisi penangkap dan bagaimana kekuatan pembuktian saksipolisi penangkap dalam perkara penyalahgunaan narkoba.Metode penelitian yang digunakan yaitu yuridis empiris. Hasil penelitian diketahui bahwa selama proses pemeriksaan berlangsung, seseorang yang disangka atau didakwa melakukan sesuatu tindak pidana dilindungi oleh hukum sebagaimana diatur dalam Pasal 50 sampai Pasal 68 KUHAP. Polisi Penangkap boleh bersaksi sepanjang memenuhi kualifikasi saksi sebagaimana diatur Pasal 1 angka 26 dan 27 KUHAP dan tidak dapat dipertimbangkan apabila keterangan saksi tersebut bertentangan dengan Pasal 185 ayat (6) KUHAP, secara formal kehadiran polisi penangkap di persidangan pada saat memberi keterangan yang sifatnya verbalisan. Disarankan bagi instansi penegak hukum untuk profesionalisme, wajib menghormati hak orang yang melakukan tindak pidana dalam memperoleh hak-haknya danketerangan saksi yang berasal dari Polisi Penangkap saja dalam satu perkara pidana sebaiknya dihindari kecuali Penuntut Umum memiliki alat bukti lain yang untuk mendukung pembuktian di persidangan.Ruling No. 1531 K/Pid. Tujuan penelitian ialah mekanisme perlindungan hukum data pribadi nasabah serta perjanjian asuransi yang dilakukan oleh pihak asuransi dengan nasabah PT BNI (Persero), menyebabkan PT BNI (Persero) melakukan wanprestasi kepada nasabahnya dikaitkan tanggungjawab melindungi data nasabah, dan upaya hukum yang dapat ditempuh nasabah yang merasa dirugikan perihal data pribadinya. Metode Penelitian yang digunakan adalah yuridis normatif. Hasil penelitian ini bahwa dalam mekanisme perlindungan data telah dilaksanakan hanya saja terjadi kebocoran data nasabah dikarenakan kelalaian dalam membuat kesepakatan terhadap pihak kedua (asuransi) walaupun itu adalah anak perusahaan Bank sendiri. Penyebab terjadi wanprestasi terhadap perlindungan asuransi adalah dikarenakan pihak BNI masih menggunakan metode telemarketing dalam penawaran asuransinya. Upaya hukum untuk memenangkan hak serta keadilan pihak nasabah sering ditempuh pengancara menggugat. The research objective is the mechanism of legal protection of customers' personal data and insurance agreements carried out by insurance parties with customers of PT BNI (Persero), causing PT BNI (Persero) to default to its customers associated with responsibility to protect customer data, and legal efforts that can be taken by customers who feel harmed regarding his personal data. The research method used is normative juridical. Menteri Dalam Negeri masih dapat melaksanakan Keputusan untuk membatalkan Peraturan Daerah karena Putusan Mahkamah Konstitusi tidak berlaku surut, namun idealnya yang lebih berhak membatalkan Peraturan Daerah adalah Mahkamah Agung. Kedua, Kedudukan Peraturan Daerah yang dibatalkan oleh Keputusan Menteri Dalam Negeri yang masih dilaksanakan oleh Pemerintah Daerah setelah dikeluarkannya Putusan Mahkamah Konstitusi maka Peraturan Daerah tersebut tidak langsung batal karena ada mekanisme yang harus dilakukan yaitu pencabutan. Selama belum ada pencabutan, maka Peraturan Daerah dimaksud tetap ada tetapi tidak bisa dilaksanakan. Disarankan kepada Pemerintah Pusat agar merevisi Undang-Undang Nomor 23 Tahun 2014 khususnya pasal yang mengatur tentang pembatalan Peraturan Daerah dan apabila mengeluarkan suatu peraturan perundang-undangan harus berpedoman pada hierarki peraturan perundang-undangan yang berlaku saat itu.In 2016 the Minister of Home Affairs canceled 3,143 problematic Regional Regulations. Penelitian ini bertujuan untuk menganalisis putusan hakim dalam perkara faraid di Mahkamah Syar’iyah Jantho sehingga tidak dapat dieksekusi, hambatan dalam melakukan eksekusi dan upaya yang dilakukan untuk mencegah hambatan pelaksanaan eksekusi tersebut. Metode Penelitian ini adalah yuridis empiris melalui pengambilan data lapangan dan kepustakaan. Penelitian lapangan dimaksudkan untuk memperoleh data primer. Penelitian kepustakaan sebagai data sekunder dilakukan dengan cara mempelajari buku-buku, peraturan perundang-undangan dan literatur yang ada relevansi dengan masalah yang diteliti. Hasil penelitian menunjukkan bahwa pertimbangan Hakim hanya mengikuti prosedur penegakan hukum formil dan materil sebagaimana diatur dalam peraturan perundang-undangan yang berlaku. Majelis Hakim kurang menggali hukum nilai-nilai hukum adat yang berlaku dalam masyarakat. Hambatan dalam melakukan eksekusi karena pihak tergugat memanfaatkan celah hukum mengajukan gugatan ke Pengadilan Negeri. Upaya yang dilakukan untuk mencegah hambatan tersebut dengan memberikan pemahaman hukum kepada masyarakat melalui meja informasi tentang proses hukum dalam perkara perdata.According Article 54 section (2) of Law Number 48 of 2009 of Judiciary Power (Law of Judiciary Power) states that: “The Implementation of court judgment in civil case is conducted by secretary of court and bailiff led by Head of the Court”. Pihak-pihak yang menganggap bahwa OTT adalah ilegal mendasarkan pada argumentasi bahwa tidak adanya istilah Operasi Tangkap Tangan dalam KUHAP, yang ada hanyalah Tertangkap Tangan.Perbedaan tersebut kemudian disimpulkan bahwa OTT adalah illegal.Penelitian ini bertujuan untuk menjelaskan OTT Komisi Pemberantasan Korupsi Terhadap Gubernur Aceh dalam kaitannya dengan istilah Tertangkap Tangan dalam KUHAP dan OTT dalam kaitannya dengan teknik penyidikan khusus yang dikenal dengan istilah Controlled Delivery. Metode penelitian yang digunakan adalah metode penelitian hukum normatif (yuridis normatif) dengan melakukan studi bahan kepustakaan guna mengumpulkan data sekunder. Penelitian hukum normatif dilakukan dengan cara meneliti bahan pustaka (kepustakaan) yang merupakan data sekunder. Dari analisis yang dapat dipahami maka OTT Komisi Pemberantasan Korupsi terhadap Gubernur Aceh dalam kaitannya dengan istilah tertangkap tangan dalam KUHAP bahwa Pasal 111 ayat (1) KUHAP dan Pasal 1 butir 19 KUHAP diatas dasar hukum bagi Komisi Pemberantasan Korupsi dalam melakukan Operasi Tangkap Tangan (OTT) yang dianggap illegal serta memandang bahwa Operasi Tangkap Tangan berbeda dengan Tertangkap Tangan yang terdapat pada pasal-pasal tersebut. Kemudian OTT dalam kaitannya dengan teknik penyidikan khusus yang dikenal dengan istilah Controlled Delivery sering digunakan oleh penyidik BNN, menilai bahwa praktik KPK dalam OTT telah menggunakan dua tindakan tersebut (interdiction and entrapment) yang berarti penyidik KPK telah mengadopsi tanpa kewenangan yang telah dimiliki penyidik BNN, sehingga KPK telah melakukan tiga jenis tindakan yang melanggar UU (interdiction, entrapment dan dalam proses penyelidikan). Hasil penelitian menunjukkan bahwa Hakim MK melakukan ultra veres dalam mengadili perkara-perkara pengujian undang-undang terhadap UUD Tahun 1945 karena karena memiliki kewenangan lebih yang diberikan oleh UUD Tahun 1945 sehingga dapat merusak tatanan keharmonisan dalam penagakan hukum antar lembaga kekuasaan negara. Hakim MK memberikan pertimbangan hukum bersifat ultra petita karena hanya menjadikan undang-undang sebagai sumber hukum dalam penemuan hukum dan mengabaikan sumber-sumber hukum lainnya seperti hukum yang tidak tertulis yaitu nilai-nilai yang hidup dalam masyarakat.Article 24 of the Indonesia Republic’s Constitution 1945 provides that the Constitutional Court is eligible to try at the first and final levels which the decision is final. The Constitutional Court must be working with other institutions in enforcing law. However, the court decided controversial decision, as in treating the cases has been acting beyond its power, the legal consideration violates universal rules of law, such as ultra petita and ultra veres. The identified research problems are (1) the Constitutional Court judges commits ultra veres and (2) the Constitutional Judges provides law consideration based on ultra petita. This research aims to analyze the reasons of judges for committing ultra veres and ultra petita in treating cases reviewing the acts towards the Constitution 1945. This is normative legal research, which comprises of primary, secondary and tertiary legal sources. The research approach used in this research is historical, comparative and philosophical approaches. Penelitian ini bertujuan untuk mengetahui dan menjelaskan peranan dan hambatan hakim mediator serta untuk mengetahui upaya yang dilakukan untuk mencegah dan mengatasi terjadinya hambatan tersebut. Jenis penelitian dengan pendekatan yuridis empiris. Teknik pengumpulan data melalui penelitian kepustakaan untuk data sekunder dan penelitian untuk memperoleh data primer. Analisis data yang digunakan adalah kualitatif. Berdasarkan penelitian diketahui peranan hakim mediator dalam menangani perkara/sengketa sudah berjalan, namun belum optimal. Terbukti dari 18 (delapan belas) kasus, jumlah kasus yang selesai melalui mediasi hanya 2 (dua) kasus, sedangkan tahun 2016 sampai 2017 belum ada kasus yang selesai melalui mediasi. Hal tersebut disebabkan jumlah mediator yang terbatas dan kurang memiliki kapastitas sumber daya yang memadai. Upaya untuk mencegahnya berupa sosialisasi manfaat mediasi dan mengikuti pelatihan mediasi serta mediasi harus dilakukan secara profesional. Ketua Mahkamah Syar’iyah Banda Aceh hendaknya melakukan sosialisasi manfaat Mediasi, dan Mahkamah Agung RI hendaknya mengevaluasi praktik mediasi dan menambah jumlah hakim.Article 4 paragraph (1) and (2) Supreme Court Regulation Number 1 of 2016 states that it must first be pursued a settlement through mediation, as well as Article 17 paragraph (1) of the Judicial Examining Judge requiring the Parties to take Mediation. Pengisian jabatan pimpinan DPR terhadap Setya Novanto dan Fahri Hamzah tidak mengikuti prosedural yang sama. Usulan penggantian Setya Novanto oleh Golkar dilaksanakan oleh pimpinan DPR, akan tetapi usulan pemberhentian Fahri Hamzah oleh PKS tidak dilaksanakan sesuai dengan prosedur yang berlaku. Penelitian ini bertujuan untuk mengetahui kesesuaian penggantian dan pemberhentian Setya Novanto dan Fahri Hamzah dengan peraturan perundang-undangan yang berlaku. Penelitian ini menggunakan metode penelitian yuridis normatif. Berdasarkan kajian yang telah dilakukan terbukti bahwa pemberhentian dan penggantian jabatan pimpinan DPR terhadap Setya Novanto dan Fahri Hamzah tidak sesuai dengan ketentuan yang berlaku. Dalam pemberhentian Fahri Hamzah ternyata tidak sesuai dengan peraturan perundang-undangan yang berlaku. Terjadinya cacat hukum prosedural membawa konsekuensi terhadap jabatan, sehingga jabatan Fahri Hamzah sebagai pimpinan DPR saat ini tidak sah. Penerapan asas legalitas akan mewujudkan kepastian hukum dan persamaan perlakuan. This legal defective cause a consequence on head of house of representative position, so that Fahri Hamzah position as one of head of DPR is not valid. Tujuan penulisan untuk mengetahui dasar penentuan kerugian negara dalam perkara tindak pidana korupsi dan mengetahui proses penetapan kerugian negara dalam perkara tindak pidana korupsi, Penulisan dilakukan dengan penelitian kepustakaan, dan pendekatan yuridis normatif, hasil penelitian diketahui dalam menentukan nilai kerugian negara pada perkara tindak pidana korupsi, jika perkaranya sederhana maka penentuan nilai kerugian negara dilakukan oleh Kejaksaan, jika perkaranya perlu audit secara mendalam maka Kejaksaan berkoordinasi dengan Badan Pemeriksa Keuangan (BPK) atau dengan Badan Pengawasan Keuangan dan Pembangunan (BPKP) sebagai alat bukti awal persidangan mengenainya nilai kerugian negara. Proses Penetapan kerugian negara yaitu dengan menghadirkan LHPKKN dari BPKP atau hasil perhitungan sendiri oleh Kejaksaan. Disarankan agar disebutkan pada setiap Undang-Undang yang mengatur mengenai tindak pidana korupsi bahwa hanya BPK lembaga yang berwenang menetapkan nilai kerugian keuangan negara.
