Para pihak dapat menyelesaikan wanprestasi melalui berbagai cara seperti musyawarah, mediasi, arbitrase, maupun pengadilan. Jalur pengadilan sering dianggap hanya mengutamakan nilai kepastikan hukum dan mengesampingkan nilai keadilan dan kemanfaatan. Namun hal ini tidak terjadi dalam penanganan kasus PT. DSF melawan AH di Pengadilan Negeri Lumajang. Artikel ini bertujuan mendiskripsikan kewenangan Pengadilan Negeri Lumajang dalam memutus perkara Nomor 5/Ptd.Sus-BPSK/2017/PN.Lmj. Selain itu, dasar pertimbangan Majelis Hakim dalam perkara Nomor 5/Ptd.Sus-BPSK/2017/PN.Lmj. Jenis penelitian ini adalah penelitian yuridis normative dengan pendekatan kasus (case approach). Bahan hukum penelitian ini terdiri dari bahan hukum primer dan sekunder. Metode pengumpulan bahan hukum dengan inventarisasi berupa putusan No. 5/Ptd.Sus-BPSK/2017/PN.Lmj dan bahan hukum kepustakaan. Metode pengolahan bahan hukum menggunakan analysis interactive dengan membagi dalam tiga tahap yaitu reduksi data (data reduction), penyajian data (data display), dan verifikasi kesimpulan (conclutions). Hasil penelitian ini menunjukkan bahwa Pengadilan Negeri Lumajang tidak mempunyai kewenangan atau kompetensi relatif dalam mengadili perkara No. 5/Ptd.Sus-BPSK/2017/PN.Lmj. Penelitian Yuridis normatif dengan pendekatan aturan perundang-undangan dan konseptual. Analisis bahan hukum dilakukan setelah adanya pengkategorian tersebut. Bahan hukum yang digunakan adalah bahan hukum primer yang berupa aturan perundang-undangan, bahan hukum sekunder yang berupa jurnal, buku, dan bahan hukum yang berada dari media online, serta bahan hukum tersier yang berada dari kamus. Setelah bahan hukum terkumpul, maka akan dikelompokkan, disusun lalu dideskripsikan untuk untuk selanjutnya dianalisis untuk menjawab rumusan masalah serta mencapai tujuan penelitian. Penerapan Sertifikat Laik Higiene telah sesuai dengan teori efektivitas hukum, sebab di dalamnya telah terdapat aturan yang mendukung yaitu Peraturan Menteri Kesehatan Republik Indonesia Nomor 1096/Menkes/PER/VI/2011 Tentang Higieme Sanitasi Jasaboga yang ditunjang oleh Surat Edaran nomor HK.02.01/MENKES/335/2020 Tentang Protokol Pencegahan Penularan Corona Virus Disease di Tempat Kerja Sektor Jasa dan Perdagangan (Area Publik). Penegakan hukum dilakukan oleh paratur sipil negara serta dibentuk gugus tugas yang diterapkan pada setiap wilayah. Faktor yang terakhir adalah kebudayaan, yaitu terkait dengan nilai kemanusiaan yang ada dari masyarakat untuk mengurangi atau mencegah penularan covid 19 sehingga bisa diterapkan dalam roadmap. Sanksi bagi pelaku usaha di bidang jasaboga adalah sanksi administrasi dari Kepala Dinas Kesehatan Kabupaten/Kota yang berupa teguran, teguran tertulis atau pencabutan Sertifikat Laik Higiene serta pemberian ganti rugi dan/atau mengenai tindakan tertentu sehingga kerugian yang diderita oleh konsumen tidak akan terulang kembali. As a follow-up to this decision, the Ministry of Environment and Forestry established Minister of Environment and Forestry Regulation P.32/Menlhk-Setjen/2015 concerning Private Forests which has been renewed through Minister of Environment and Forestry No.9 of 2021 concerning Management of Social Forestry. Until now, the number of customary forests that have been determined is 107 customary forest units. One of the factors supporting the increase in the number of customary forests is a change in the internal legal culture of the LHK when verifying and validating customary forest applications. Based on the results of the research, facts and problems were found, one of which was related to the requirements for recognition of legal subjects for groups holding rights through regional legal products which could be in the form of Regional Regulations (PERDA). The PERDA contains the Recognition and Protection of Indigenous Peoples and the areas managed by these communities. Some PERDAs are not included with maps of customary territories or there are no other regional legal products that define the boundaries of the community's managed areas. In addition to the problems of legal subjects and areas of management, changes in the legal culture within a government institution also have an influence on the process of recognizing these rights. The process of drafting the legislation program is carried out not in accordance with the planning and scale of priorities that have been set so as not to provide legal certainty to the priority and legal development in the region. This study uses normative juridical methods with a statue approach and conceptual approach. In addition, to determine the aspects that cause the lack of legal certainty, this study also uses empirical juridical methods. The establishment of the Local Legislation Program has not provided legal certainty because Qanun Aceh No. 5 of 2011 on The Procedure of Formation of Qanun has not set concretely on the scale of priorities that form the basis of the urgency of the establishment of a qanun. These provisions are not imperative. The problems studied in this research are legal consequences of buying and selling apartments with a pre-project selling system that are not made in a Sale and Purchase Agreement deed before a Notary.The method used in this research arenormative legal research with a statute approachand conceptual approach. The legal material analysis techniques used are systematic interpretation and grammatical interpretation. Based on research results, apartment sale and purchase transactions with a pre project selling system made in the ordering agreement has fulfilled the legal requirements of the agreement. The conclusionis legal consequence of buying and selling apartments with a pre project selling system that is not made in a notarial deed. Ketentuan tersebut tidak bersifat imperatif. Permasalahan yang dikaji dalam penilitian ini adalah akibat hukum terhadap transaksi jual beli apartemen dengan sistem pre project selling yang tidak dibuat dalam akta pengikatan perjanjian jual beli di hadapan notaris. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik analisis bahan hukum yang digunakan adalah teknik interpretasi sistematis dan interpretasi gramatikal. Berdasarkan hasil penelitian, transaksi jual beli apartemen dengan sistem pre project selling yang dibuat dalam perjanjian pemesanan telah memenuhi syarat sah perjanjian. Kesimpulannya adalah akibat hukum terhadap transaksi jual beli apartemen dengan sistem pre project selling yang tidak dibuat dalam akta notaris yaitu perjanjian pemesanan sebagai instrumen hukum yang mengikat para pihak yang membuatnya layaknya undang-undang. Namun, perjanjian pemesanan mempunyai kekuatan pembuktian hanya sebagai akta dibawah tangan karena bukan merupakan akta otentik. This paper will examine how the problematics of setting up the Land Bank are, starting from institutional problems and legal issues in particular. This paper uses a normative legal research method using a statutory and conceptual approach. The results of the study indicate that the presence of the Land Bank Agency has a great potential to cause overlapping authorities between institutions in the land sector. The authority of the Land Bank Agency in the management and acquisition of land was previously also owned by the Ministry of ATR/BPN, so this causes an overlap between the two institutions. Other legal issues, relating to the orientation and substance of the Land Bank Agency. Based on the Job Creation Law, the orientation of the Land Bank is more on investment and economic development that contains risks. The purpose of this study is to determine the validity of same-sex marriage in the perspective of the flow of natural law. The method used is the juridical-normative method with a statutory approach and legal philosophy. The results of this study are that the flow of natural law is closely related to divine morality. Good and bad, wrong and right, proper and inappropriate, are measured according to divine moral standards. Therefore, human behavior and/or regulations made by humans that deviate and conflict with natural laws cannot be accepted and/or cannot be referred to as laws. Soegijanto","doi":"10.26740/jsh.v4n2.p357-378","DOIUrl":"https://doi.org/10.26740/jsh.v4n2.p357-378","url":null,"abstract":"Penelitian ini bertujuan untuk menganalisis pelaksanaan sistem bundling dalam pemasaran produk barang atau jasa agar tidak melanggar ketentuan dalam Undang- Undang Perlindungan Konsumen dan kriteria sistem bundling yang dapat digolongkan sebagai persaingan usaha tidak sehat serta mengkaji upaya yang dilakukan Badan Penyelesaian Sengketa Konsumen dan Komisi Pengawas Persaingan Usaha apabila menemukan penyalahgunaan sistem bundling tersebut. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan mengkaji kasus tersebut dengan peraturan perundang- undangan yang berlaku. Hasil peneltian menunjukkan bahwa sistem bundling yang digunakan pelaku usaha dalam layanan kesehatan merugikan konsumen karena melanggar hak konsumen hak untuk memilih dan mendapat barang dan/ atau jasa sesuai dengan nilai tukar dan kondisi serta jaminan yang dijanjikan sebagaimana diatur dalam Undang- Undang Perlindungan konsumen. Lalu tindakan pelaku usaha tersebut dianggap memenuhi kriteria sebagai sistem bundling yang menyebabkan terjadinya persaingan usaha tidak sehat dengan terpenuhinya unsur pada pasal 15 ayat 2 Undang undang nomor 5 Tahun 1999.
