Within it, the reactions of the individual who harm the values protected by criminal norms are analyzed, aiming to guarantee the rights of the parties and other participants, as well as the efficient exercise of the duties of the judicial bodies. \u0000Although the purpose of criminal proceedings is no longer effectively enshrined in the Code of Criminal Procedure, the notion is nevertheless found in Article 8 of the Code of Criminal Procedure under the title \"Fairness and reasonable term of criminal proceedings\". It stipulates that criminal prosecution and trial must be conducted in compliance with procedural guarantees and the rights of parties and procedural subjects in such a way that facts constituting criminal offences are ascertained in a timely and complete manner, no innocent person is held criminally responsible and any individual who has committed a crime is punished according to law,  within a reasonable time. \u0000According to Article 97 para. (1) Code of Criminal Procedure, evidence is those realities, events, circumstances that serve to establish the existence or non-existence of a crime, as well as to the identity of the person who committed it. Thus, evidence comprises three interconnected and interdependent elements: evidence, means of proof and evidentiary procedures. The literature states that by introducing this system, \"a more effective control over the manner of taking evidence can be established. Moreover, the analysis of the evidence will be possible only in terms of form, so that it complies with the law, while the analysis of the evidentiary procedures will concern the technical operation by which that means of evidence was obtained.\" \u0000The use of technical supervision as an evidentiary procedure in criminal proceedings is a topical topic, given the technological leap in communication and information that has taken place in recent years. We note that in the title dedicated to evidence (Title IV) of the New Code of Criminal Procedure we find a new chapter (Chapter IV), which refers to special surveillance or investigation techniques. This legislation seeks to strike a balance between ensuring the State's right to use new evidentiary procedures and respecting the right to privacy and the secrecy of correspondence. \u0000Thus, Article 138 para. (1) The Code of Criminal Procedure expressly and exhaustively provides for special technical surveillance techniques, as follows: letter (a) interception of conversations and communications; lit.(b) access to an information system; lit.(c) video, audio or photographic surveillance; (d) tracking or tracing by technical means; lit.(e) obtaining data on a person's financial transactions. The business world is also very dependent on the conduciveness of the business climate that supports it. If the business climate conditions are not conducive, it will affect the stability of the business world, and can even cause business actors to suffer losses, which results in the capability and credibility of business actors in carrying out their business activities being disrupted, and can even result in bankruptcy. To maintain the smooth running of their business, business actors must obtain guaranteed protection through legal instruments established by the government. Legal protection given to banks as creditors is needed in maintaining business continuity. This legal protection is very important, considering that banking is an economic joint that supports the most vital national economy. {"title":"The influence of strategic competitive response capability on the performance of commercial organizations in Kenya listed in Nairobi securities exchange","authors":"Peter Ngugi","doi":"10.47577/tssj.v56i1.8885","DOIUrl":"https://doi.org/10.47577/tssj.v56i1.8885","url":null,"abstract":"Strategic competitive response has been identified as effective factor that harnesses a business ability to utilize all its skills, capabilities and resources in order to gain competitive advantage and thus survive and increase its value over time. It focuses on the organization's assets, resources and market position, projecting how well it will be able to employ strategies in the future. This study sought to explore the influence of strategic competitive response capability deployment on performance of listed organizations in Nairobi securities exchange. There is a dearth of studies empirically investigating the relationship between interaction of strategic competitive response capability deployment and organizational performance. This gap in knowledge is exacerbated by multiple definitions, ambiguity of constructs, contradicting views and little grounding of the theory in empirical observation. The objective was to determine the influence of strategic response capability performance. The study employed two theories to explain the interaction of strategic competitive response action and organizational performance, the theories were resource-based view and dynamic capabilities theory. A cross sectional research design was employed with the focus set on the operations of corporations listed in Nairobi securities exchange. A census survey of 67 firms was conducted. The results show that strategic competitive response has a positive statistically significant relationship with performance (β=0.600, p=.000). The results have also shown that strategic competitive response was positively correlated to organizational performance at 99% confidence level (r=6.45, p=0.000).This study concludes that strategic competitive response capability significantly influences organizational performance positively. In this regard, we focus on the effect of the international transmission of uncertainty shocks on global stock market performance. Given that the United States is the world’s leading economic power, some studies have highlighted the adverse effects of the international propagation of US uncertainty shocks on international stock markets (Ehrmann and Fratzscher, 2009; Klobner and Sekkel, 2014; Hammoudeh et al., 2016). \u0000Using VAR modeling, our study examines the specific impact of economic policy uncertainty in the USA on the stock markets of four African countries: Tunisia, Egypt, Morocco, and South Africa. Terrorism crimes are included in non-military threats so that they must be faced with non- military strategies. In this case, BNPT is the leading sector in implementing non-military strategies to prevent women from being involved in terrorism and also deradicalisation efforts for prisoners, deportees and returnees. The purpose of this study is to analyse how the motives and factors of women can be involved in terrorism and how the non-military defence strategy to overcome women's involvement in terrorism. The research method used is qualitative which is conducted by using desk review technique. The results show that there are two opinions found to be the root cause of women's involvement in terrorism, the first is patriarchy culture and women as victims. But the tendency in Indonesia that occurs is women as victims, the powerlessness of women who are bound by patriarchal culture, the limited insight they have is also the reason so that women are victims of terrorism itself, the findings of the other root of the problem are social inequality or economic problems. The International Union for Conservation of Nature (IUCN) 2020 found that gender-based violence was aligned with climate and environmental crises in various developing countries. In addition, 9.9 women were affected heavily by natural disasters in Indonesia (BPS, 2017). Meanwhile, only 20% of women's leadership constitutes the entire energy sector (WEF, 2022). Another important statement from the IPCC (2022) said that women (particularly pregnant women) became highly impacted by the climate crisis. The Assessment Report on the State of Gender Equality and Climate Change in ASEAN (2022) built evidence on the importance of recognising women’s roles in climate action in ASEAN countries. In light of this background, this paper will analyse the critical complexities of ASEAN women's leadership towards climate action in order to evaluating the implementation of SDGs goal 5 and 13. To have further deep analysis, this paper will explore the case study of Balinese and Cambodian women who have best practices of climate action, locally, nationally and globally, which also enhance ASEAN countries' commitment to SDGs. Some of the best practices in Cambodia include a Renewable Energy (RE) programme that actively engages with and promotes women-led energy enterprises by implementing “The Smoke-Free Village” approach and training women as champions for gender-transformative Disaster Risk Reduction (DRR). Meanwhile, in Bali, Balinese women play an important role in climate action by establishing the Bali Women Climate Entrepreneur Project which encourages 10 start-ups to join the program and many other best practices to be explored further. As a methodology, the best practices of women leadership in both countries will be collected through literature reviews, interviews, statistics from the Balinese and Cambodia government/SDGs centres, and other relevant documents’ review. This research has a critical paradigm with a qualitative research design. The data collection method consists of in-depth interviews (in dept interviews); observation; literature and document study; and triangulation. The research quality criteria are based on historical situatedness. The research results show that the populist political communication style of government political actors is a symbolic action of a leader born from the democratic process. The component of the populist political communication style that is prominently used is the pro-people component. The motive revealed was the desire to build alternative political power through image and public opinion. Meanwhile, the interests of power are to protect and strengthen the legitimacy of the leadership to maintain power and pave the way for political career advancement. Meanwhile, the varied voices as to women’s capacity to drive are heard in media reports. This article examines media representations of Chinese women drivers on the official news website Chinanews.com. News reports from 2012 to 2021 were collected, sorted in Nvivo 11, and analyzed under the guidance of van Leeuwen’s socio-semantic approach. The results of the analysis revealed three dominant discourses about women drivers: problematic discourse, commendable discourse, and victim discourse, in which categorisation strategy, nomination strategy and passivation strategy, along with the description of material actions and semiotic actions were employed. However, observations in the last few months, especially after implementing online learning for approximately two years, show a decline in the interest, enthusiasm, and motivation of students at State High School 2 Samarinda in facing the democratic system. To overcome this problem, this research aims to evaluate school management in developing a democracy laboratory for students at SMA Negeri 2 Samarinda. A qualitative approach was used in this research, by collecting primary data through field observations, interviews with school principals, teachers, and students, and secondary data from various reference sources such as books, articles, and scientific journals. Data analysis was carried out using the stages of data collection, data reduction, data presentation, and conclusion. The results of the research show that SMA Negeri 2 Samarinda has succeeded in implementing democratic development management at school, both in the classroom and in the school environment effectively.
