The question of al-mafqud property has a great implication on the ownership of the property as the property is frozen as a result of being unable to identify the status of its owner and the benefits resulting from this property are also frozen and barred from being enjoyed by its heirs. This situation has led to many problems that are so critical and extremely difficult to solve and harm the society and the nation as a whole. According to the Jabatan Kehakiman Syariah Malaysia (JKSM) and Amanah Raya Berhad, the value of this al-mafqud property reaches 10 billion. Thus, the efforts of the authoritative party should be taken seriously to find a solution to this al-mafqud property. One potential solution is to use a waqf instrument. However, some sharia and civil laws need to be scrutinized and need to be strengthened to assist in the settlement of al-mafqud property. This paper will discuss the potential and challenges of settlement of al-mafqud property through a wakaf instrument. As for the Shariah law, Syariah officers in Malaysia face challenges in controlling scientific-based exhibits and evidence. This has been seen as a result of lack of exposure, knowledge and comprehensive training in evidencing procedures using scientific-based qarinah. This preliminary study discusses the proposal to establish fiqh forensics fundamental module for the use of Syariah officers in Islamic legal institutions in Malaysia. This qualitative study applied inductive and deductive approaches in obtaining general and specific conclusion from primary and secondary sources. The findings show that there is a need to propose for the development of a specific module to empower human capital which includes enforcement, shariah prosecutors, judges and registrars within the integration framework of forensic science integration and fiqh based on the concept of 'fiqh forensics'. According to Dr. Wan Hasmah Wan Teh, Literature Lecturer, School Of Humanities, Universiti Sains Malaysia (USM), she explained that flower bathing is a ritual that is very well known in the Southeast Asian region, including Malaysia, where the Malays are mostly aimed at enhancing the aura, beauty and ‘seri pengantin’ (Siti Sofia, 24 March 2018). Therefore the use of flower bath therapy is often associated with beauty compared to health care. So, the community needs to be given more exposure on the benefits of flower bathing for healthcare. Flower bath therapy in Malay medicine has the potential to be applied as a prevention and for disease treatment, especially in dealing with mental disorders that have doubled over the past ten years (Datuk Seri Dr. S. Subramaniam, September 28, 2016). Flower bath therapy can help in mental health problems by lowering the cortisol hormone (stress hormone), enhance the sense of comfort, relaxation and increase endorphin levels that provide a sense of ‘feel-good’ and reduce pain. Flower bath therapy is also found to be potentially in preventing depression. Although generally speaking, the fiqh discussion of waqf is only focused on two major hadiths; the hadith related to Sayidina 'Umar in Khaybar and also the date farm of the Bayruha' property of Abu Talhah. However, if it is examined more closely, there are many more hadiths discussing waqf in various aspects in al-Kutub al-Sittah. The analysis found that there were 36 texts of hadiths related to waqf in al-Kutub al-Sittah and there was a text of hadith describing on specific waqf mosque in particular. The sources of the hadiths related to the wakaf of the mosque are from Sahih al-Bukhari and Sahih Muslim, and cross references are found that the hadiths are also found in al-Kutub al-Sittah other than Sahih al- Bukhari and Sahih Muslim. Fatwa institutions play a role in producing explanations and solutions that coincide with the objective of Islamic law (maqasid Syariah). Life preservation as one of the objective of Islamic law has a close relationship with medical science. The objective of this article is to analyze the relation of medical science with the the objective of Islamic law and to analyze the application of the objective of Islamic law in the modern fatwa related to medical sciences. This is a qualitative study using content analysis method. The findings show that medical science has a significant relationship with the achievement of the objective of Islamic law. Medical science based on Islamic law can fulfill the five basic needs that are the core of the objective of Islamic law. Medical science that cares for the health of individuals and societies help individuals and communities perform the perfect worship as well as the commitment of religious life with which it can safeguard muslim belief system. Medical science also safeguarding the safety of human life. Human intellect can only be maintained by practicing a healthy living culture. A healthy individual can build a healthy family and society to ensure the survival of human beings with which it can preserve the human descendants. This study is to analyze the application of the national blue ocean strategy in Zakat of Penang (ZPP) in the context of the distribution of zakat education today. The ZPP was chosen as the highest among the highest education zakat in the country in 2017 amounting to RM 31,713,200.41 being 31.78% of the total distribution of RM 99,782,721.01. The question is, how far is the application of the national blue ocean strategy to assist the distribution of zakat education in ZPP and how does the application take place according to current and local conditions? Hence, the objective of this study is to identify the forms of joint ventures carried out with external agencies to strengthen the distribution system in ZPP and to meet the reality of current zakat distribution of education. The methodology of the study was conducted qualitatively by collecting data through library research and field research using unstructured interview methods. Data analysis uses descriptive and comparative methods. The implementation of Food Bank Centre is very suitable as the Malaysia government’s focus to ease burden among the B40 group in 11th Malaysia Plan. In addition, Malaysia also focuses on Sustainable Development Goals (SDGs) whereby to ensure everyone can access food and end hunger by 2030. However, poverty rates are higher in rural area especially in Kedah, Malaysia. This article explores Model of Food Bank Centre offer to the needy and poor by Lembaga Zakat Negeri Kedah (LZNK). In 2019, The Food Bank covering 574 mosques in Kedah, to cover 17,220 families of the needy and poor in need to access food every month. Maqasid shariah theory is used as a guideline and conjunction to implement the SDGs 2030 as maqasid syariah itself already highlight on the elements of SDGs. The result of this program created aid to the needy and the poor in term of virtuous and moral matters. Furthermore, it also gives a positive impact to stakeholder towards LZNK. It serves as a type of punishment under hudud imposed on unmarried persons for committing adultery and those who commits robbery. It also serves as a type of punishment under takzir. In its early implementation, the offender will be banished to other districts which aimed to isolate them from crime factors. At present, banishment is deemed no longer effective as the offender can still communicate with their criminal counterparts via telephone and internet as a result of technological advances. This resulted in the punishment not being able to achieve preventative objectives due to supervision issues. The purpose of this article is to review the continuity of its implementation in modern times. Using comparative methods, comparisons were made with provisions of the same elements in the Prevention of Criminal Act 1959 (POCA). The findings show that the advancement in science and technology has made implementation of this punishment become practical. This was achived through the application of electronic monitoring devices (EMD) to monitor the offenders. As a result, the issues regarding supervison on the offenders which remain setback to the effectiveness of the punishment have been resolved. Hence, the implementation of taghrib remain relevant and not obsolete. A complete diagnosis can lead to the determination of the right type of treatment and proper prescription medication in the disease healing process. Syaikh Ahmad Al-Fatani, is a great religious scholar and his medical knowledge in the Malay World, has produced a book manuscript that could be a guide to Malay medical practitioners, especially in the process of diagnosing patients. Hence, this study will discuss Shaykh Ahmad Al-Fatani’s perspective on the method of identifying illness by focusing on his manuscript, Tayyib Al-Ihsan Fi Tibb Al-Insan. The book discusses on Malay medicine, with main focus to determine the medicines and treatments against ailments. Data collection is done through library research and bibliogafi data analysis from this book, past studies and related journals to determine the method using by Syaikh Ahmad Al-Fatani for identification of illness.
