A total of 74.1% of the rulings were dismissed in the first instance and 75% in the second instance. The 2 grounds for finding against the defendent were loss of chance 6 (42.85%) and diagnostic and/or therapeutic malpractice 5 (35.71%). The statistical approach can be complex but there exists validated non-commercial software, such as Familias, which aid in estimating the likelihood ratios of the DNA test for the given hypotheses.
