Evaluation should include general and genital examinations, collection of forensic specimens, and culturing for sexually transmitted diseases. Obtaining a complete history is not only medically and legally crucial, but also can be a valuable therapeutic activity. Antibiotic prophylaxis, postcoital contraception, and testing for human immunodeficiency virus should be offered. An understanding of the rape trauma syndrome is the foundation for providing emotional support. A survey was designed to evaluate the expectations that patients have of PAs faced with a patient's psychosocial problems. The survey was distributed in 1987 to four practices that employ PAs in south central Kansas. Selected patients were surveyed for their expectations of the PA in dealing with a series of personal, social, psychological, and health-related items. Demographic and role-delineation data from 40 PAs agreeing to participate in the study were collected by questionnaire and telephone interviews. The data indicated that the majority of ophthalmologic PAs are employed in large practices that specialize in cataract and radial keratotomy procedures and that those practices are primarily located in the Southeast and Gulf regions of the United States. Guidelines are needed in two major areas: assessing incapacity and seeking surrogate decision makers. Judicially declared incompetency does not necessarily imply incapacity to make medical choices. Proposed standards for determining incapacity require a multistep evaluation of the patient's abilities to understand, reason, and communicate. When decisions must be made for an incapacitated patient, priority is given to the patient's previously stated preferences. An advance directive--living will or durable power of attorney--simplifies the process. If no advance directive was prepared, a surrogate decision maker may be designated according to applicable state statutes. It is becoming increasingly critical to involve patients in the decisions that affect their care. Legal frameworks are evolving to protect the rights of both \"competent\" and \"incompetent\" patients. By writing instructions in advance, patients can increase their control and autonomy over health-care decisions. Physician assistants can facilitate the process by incorporating a patient value history into the chart and explaining legally recognized documents. Living wills generally apply in the context of terminal illness or irreversible coma; however, definitions of terminal conditions, imminent death, or life-sustaining procedures can be problematic. The special concerns of PAs are also being addressed by our national leadership. Confidentiality and anonymity are critical factors, along with the employer's established policies. PAs working in emergency and surgical settings may be at greater professional risk of exposure to HIV; those with personal risk factors may consider being tested if their work exposes them to opportunistic infections. Evolution of malpractice law during the past years has seen dependent practitioners held accountable to a standard of care expected to be provided by peers. Physician assistants are no longer protected from liability or suit. The most common action of liability is professional negligence; other actions include breach of contract, battery, informed consent, defamation of character, and invasion of privacy.
