The text outlines the actual picture of collective relations in the technological area. Technology rests within man, in this resting it surpasses him. Technology draws the world and the human into itself and retains it. The opposites of man and artificial intelligence are in dispute. For an artificial intelligence system to be an artificial intelligence is to engage in a dispute between man and the essence of technology. What is the essence of technology? It lies in what the technology really is. It establishes this dispute in the form of an artificial intelligence system that makes it public. The human being, his or her rights, freedoms, duties, what appears to be inviolable, inalienable and unalienable in his or her being, what reaches him or her and is only given to him or her, without which he or she would not be a human being, is only experienced through the artificial intelligence system, being subjected to its influence. According to the authors, this is unnecessary. Based on the analysis of the regulations and the jurisprudence of the Supreme Court, they show that the Labour Code guarantees people who use modern technologies the right to rest. However, the authors agree, that the problem is the practical application of these provisions. In addition to numerous benefits, it carries significant risks for employees. The authors of this article attempted to answer the question to what extent Polish labor law is ready for the challenges posed by the use of artificial intelligence in employment and what possible actions should be taken to provide employees with an adequate level of protection against potential threats that may result from the use of artificial intelligence in employment. For this purpose, the authors identified the areas where the greatest threats related to the use of artificial intelligence are perceived and analyzed the currently existing legal protection measures that can be used to guarantee this protection. In this aspect, one of the most pressing questions is whether this right should also be granted to management and other autonomous decision makers. Based on the novel approach adopted by the Constitutional Court of Colombia in this aspect, we argue that total deprivation of management and managerial staff of the right to disconnect is a violation of human dignity. This is due to the core, undiminishable nature of the right to rest, of which an employee cannot be deprived regardless of the functions they perform in the workplace. Taking a different position, that the employer is obliged to negotiate with respect to the elements of the claims that do constitute legitimate subject matter of a collective dispute, as the Supreme Court found in its judgment of 16/03/2022 (II PSKP 47/21), is contrary to the Act on the Resolution of Collective Disputes ,the principles of criminal liability, and the principle of voluntary bargaining recognized in international law. It also carries the risk for the employer that it will not be possible to hold trade union activists acting during such a collective dispute accountable in the future. The demarcation between traditional dependent employment and self-employment has culminated in the evolution of distinct legal frameworks and protective measures. These frameworks traverse substantive labour laws, social security provisions, health insurance, and tax structures, each meticulously designed to cater to the specific needs and attributes of workers within these separate employment categories. Given the escalating prominence of the self-employment domain, there’s an emerging imperative for a re-defined labour legislation strategy.
