Therefore, numerous transactions in relation to such respects are signed. In the course of transaction performance, it is common for the obligor to fail to perform the contractual obligations or to perform incompletely or improperly the contractual obligations. Obviously, when any breach of contract occurs, the parties to such contract want their rights and interests to be protected. Consequently, when the breach of contract gives rise to emotional distress damage, the liability to compensate for emotional distress damage is issued pursuant to Article 419 of the Civil Code 2015. However, the contract laws of Vietnam still have some shortcomings in relation to the liability to compensate for emotional distress damage caused by a breach of contract, particularly drawbacks relevant to i) The cases of compensation for emotional distress damage caused by a breach of contract; ii) The level of compensation for emotional distress damage caused by a breach of contract; iii) The form of compensation for emotional distress damage caused by a breach of contract. Thus, this article analyses and comments on foreign experiences on liability to compensate for emotional distress damage caused by a breach of contract while comparing it with regulations and practical application in Vietnam in order to draw some lessons for Vietnam to enhance laws and advance the effectiveness of applying the above-mentioned regulations in practice.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":"15 3","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140654145","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

There have been several initial studies on the theory of determining the value of audio-visual archives in Vietnam so far; however, due to the specificity of this type of document, the application still faces many difficulties. This article presents systematic research and analyses how to apply the theory of determining the value of audio-visual archives, a type of archive with specific characteristics in terms of origin, content of the document, and its appearance. The research methods used in this article are research methods of archival science, historical science, and interdisciplinary methods that use the perspectives and approaches of several different scientific disciplines. The result serves as a theoretical basis for further research which specifically considers the value of pictures, films as well as audio and video recordings for in-depth research and for agencies with audio-visual materials to apply appropriately; and as the basis for competent State agencies to promulgate documents regulating and guiding activities in determining the value of audio-visual documents.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":"58 3","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140655786","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

At its core, culture is not a monolithic entity but a dynamic amalgamation of myriad components, practices, and ideologies. These elements are not static but continually evolving, shaped by the interactions and exchanges within discourse communities. Discourse communities are fertile ground for nurturing, contesting, and disseminating cultural elements. Within these communities, language, beliefs, values, and norms are not merely transmitted but actively negotiated and transformed. This ongoing process contributes to the resilience and adaptability of culture, enabling it to respond to the ever-changing social and historical landscape. Central to our analysis is recognising culture as both \"socially situated\" and \"historically situated”. The former underscores the embeddedness of discourse communities within broader socio-cultural contexts, highlighting their interconnectedness with power dynamics, social hierarchies, and institutional structures. The latter emphasises the dynamic nature of culture, acknowledging its responsiveness to historical events, cultural exchanges, and shifts in collective consciousness. Through this scholarly exploration, we seek to offer a comprehensive understanding of how culture evolves within the intricate web of discourse communities, reflecting and shaping the world around them. By unpacking the complex interplay between culture, discourse, and their socio-historical contexts, we aim to illuminate the profound implications of these dynamics on individuals, communities, and societies at large.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":" 860","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140682157","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Recycled water is a feasible alternative to alleviate the water shortage, but it is constrained by humans’ perceptions. The current study examines how residents’ water scarcity awareness and climate change belief influence their willingness to use recycled water directly and indirectly. Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset of 1831 residents in Albuquerque, New Mexico, an arid inland region in the US. We discovered that residents’ willingness to use direct recycled potable water is positively affected by their awareness of water scarcity, but the effect is conditional on their belief in the impacts of climate change on the water cycle. Meanwhile, the willingness to use indirect recycled potable water is influenced by water scarcity awareness, and the belief in climate change further enhances this effect. These findings implicate that fighting climate change denialism and informing the public of the water scarcity situation in the region can contribute to the effectiveness and sustainability of long-term water conservation and climate change alleviation efforts.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":"118 45","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140679486","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In the salinity-impacted regions, shrimp-rice production is a possibility besides the traditional rice models. This paper aims to assess the economic efficiency of rice-based farms in the Mekong delta in the context of salinity-induced hazards. The random sample is collected from 254 rice-based farms in 28 villages in 24 districts in the western coastal region in the Mekong delta. The method of Data Envelopment Analysis and OLS and Tobit regression estimations are used to measure the economic efficiency and identify the determinants of the technical and scale efficiencies respectively. The findings show that the average overall efficiencies for the technical efficiency and the scale efficiency are 0.642 and 0.848 respectively, implying that substantial inefficiencies occur in farming practices in the Mekong delta. It indicates that there is still potential for improving the economic efficiency of rice-based system. The findings also show that, statistically significantly, the land ownership and the area are the determinants of the economic profit; the irrigation system, saltwater drains, salinity impact, are the determinants of the economic irrigated water use; the land ownership status, the area, and type of seed are the determinants of the technical efficiency; and the gender, age, education level, irrigation system, saltwater drains, area, type of seed, and numbers of fertilizing and weeding are the determinants of the scale efficiency","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":"108 36","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140679914","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

By collecting accounting and market data of Vietnamese property firms listed on the Ho Chi Minh City Stock Exchange for the period from 2017 to 2022, we employ a panel data approach with a total of 306 observations. With data that ensures stationarity, the study utilises the Feasible Generalised Least Squares (FGLS) method to address potential concerns related to heteroskedasticity within the model. The results indicate that the relationship between capital structure in general, capital structure by term, and firm value is quadratic, suggesting the presence of an optimal level of capital structure. Firm value increases with the increase in the debt ratio, and firms can maximise value at the optimal debt threshold. Additionally, the study finds that firm value is influenced by scale and asset structure, both of which have a positive impact on firm value. However, there is no evidence of the impact of sales growth and liquidity on firm value in this analysis.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":" 786","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140682099","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The analysis uses 2001-2022 data from the General Statistics Office and the Ho Chi Minh Stock Exchange (HoSE). This time frame encompasses various market cycles, including the recent financial crises, which alter the characteristics of stock variance. The findings reveal that inflation has a strong impact on the volatility of stock indexes because the psychological herd of the stock players has a huge impact on market volatility such that it weakens the market, leading to instability due to stock prices being blown up too high or depressed too low. Herd mentality facilitates price manipulation, stock price manipulation, and speculation. When the demand for capital flows into the secondary market, a surge has led to a large amount of money in circulation. This has caused a high level of inflation. The findings indicate that a one percent increase in inflation is associated with a 6.692 percent increase in the VN index, suggesting that Vietnam’s stock market returns can hedge against inflation. Yet, the popularity of speculative investments necessitates that the Vietnamese government not only address inflation but also improve financial regulations and stock market oversight.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":" 895","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140681938","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This article explores the food security status of impoverished households in Tuong Duong district, employing the Household Food Insecurity and Access Scale (HFIAS) for assessment. A survey of 125 households across two communes within the district provided insights into the prevalence of household behaviours indicating insufficient quality and quantity of food, as well as anxiety and uncertainty regarding insecure access to food supplies. The majority of respondents were categorised as “moderately food insecure” or “mildly food insecure”. Key determinants of food security for this impoverished population, such as human, natural, physical, social, and financial capital, were identified. The findings suggest that policy priorities should focus on: (1) Expanding the scale of agricultural production and irrigation systems; (2) Enhancing support activities related to agricultural production for households; (3) Broadening the livelihood framework; (4) Developing infrastructure to improve market accessibility for the impoverished population in the district.","PeriodicalId":506424,"journal":{"name":"Ministry of Science and Technology, Vietnam","volume":"9 8","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-04-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140680938","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
