However, the contract laws of Vietnam still have some shortcomings in relation to the liability to compensate for emotional distress damage caused by a breach of contract, particularly drawbacks relevant to i) The cases of compensation for emotional distress damage caused by a breach of contract; ii) The level of compensation for emotional distress damage caused by a breach of contract; iii) The form of compensation for emotional distress damage caused by a breach of contract. Due to the socio-economic development, the spiritual demands of individuals are increasing, such as improving physical appearance, health care... 关于因违约造成精神痛苦损害的赔偿责任的外国经验和越南的教训
随着社会经济的发展,个人的精神需求也在不断增加,如改善外貌、保健......。因此,与这些方面有关的交易层出不穷。在交易履行过程中,义务人不履行合同义务或不完全、不适当地履行合同义务的情况屡见不鲜。显然,当发生任何违约行为时,合同当事人都希望自己的权益得到保护。因此,当违约造成精神痛苦损害时,根据 2015 年《民法典》第 419 条规定,应承担精神痛苦损害赔偿责任。然而,越南的合同法在违约引起的精神痛苦损害赔偿责任方面仍存在一些不足,尤其是在以下方面存在缺陷:i) 违约引起的精神痛苦损害赔偿案例;ii) 违约引起的精神痛苦损害赔偿水平;iii) 违约引起的精神痛苦损害赔偿形式。因此,本文在分析和评论国外关于违约造成的精神痛苦损害赔偿责任的经验的同时,将其与越南的法规和实际应用进行比较,以便为越南在实践中完善法律和提高上述法规的适用效力提供一些借鉴。
