Piracha","doi":"10.1080/07293682.2021.1920992","DOIUrl":"https://doi.org/10.1080/07293682.2021.1920992","url":null,"abstract":"ABSTRACT The New South Wales (NSW) Environmental Planning and Assessment Act (EPAA) was promulgated in 1979 to simplify the planning process, to pay particular attention to ecological sustainability and to improve community consultation in planning matters. In the four decades since its inception, the EPAA has been amended more than 150 times. The changes to the planning system have mostly revolved around the decision-making process, the unmistakeable struggle for control between the State and Local Government and the attempts to shift to a post-political/ managerial planning system. The delegation of substantial decision-making powers to Local Government by the EPAA on its inception forced the State Government to work collaboratively with Local Government. In practice, however, this has proven difficult for the NSW State Government. In this paper, we will draw attention to some of the decision-making reforms that have dominated the planning system debate in NSW, how they have created legitimacy questions and stronger opposition to planning decisions, and how a shift to a post-political decision-making system is being used to overcome the power and legitimacy of collaborative planning and to re-concentrate the decision-making powers in the political hierarchies. We conclude that the change to the post-political system of the past decade is a move in the wrong direction. The most recent amendment to the EPAA regarding the compulsory use of the Independent Hearing and Assessment Panels (IHAP) in all Sydney metropolitan councils, hides political influences within the decision-making process and is another means of eliminating or undermining the democratic scrutiny that comes with the exercise of political powers. As these buildings age, commercial and planning drivers promote redevelopment, but renewing private multi-unit housing poses significant and unique problems, as this housing is typically under multiple ownership (e.g., strata title). Jurisdictions worldwide have responded by changing laws to allow redevelopment with less-than-unanimous consent of all unit owners, meaning a majority of owners can vote their neighbours out of their homes against their will. In New South Wales, legislation introduced in 2015 enabled the redevelopment of strata titled property with the consent of 75% of owners. Research conducted at the time highlighted a range of risks, especially for vulnerable groups like lower-income and elderly residents. With the legislation now due for a statutory 5-year review, it is timely to revisit the research findings and examine subsequent developments, to identify key issues for policymakers when assessing the impact of the law's first five years. In the context of rapidly transforming inner-city suburbs, the question becomes whether consolidation can be achieved through laissez faire zoning combined with strong market incentives for both large- and small-scale developers. This study draws upon an empirical analysis of property boundary change in Brisbane, Australia to demonstrate that without adequate specification, consolidation policy encouraging infill of greyfield inner-city sites can create perverse outcomes that fragment, rather than consolidate, the existing lot structure. The creation of ‘backyard subdivisions’ is one outcome in which additional dwellings are built alongside existing houses protected by preservationist statutes. Despite best intentions to retain dwelling character whilst consolidating growth, redevelopment outcomes do not achieve the purported benefits of consolidation. Using case studies situated in Adelaide, South Australia, this research explores both the development and characteristics of small commercial or community inner city green spaces, how they have aided revitalisation through imaginative treatments of leftover spaces, and the integration of stories and nostalgia in place creation. One of the potential benefits of nurturing such small scale green interventions in our cities are the impacts on wellbeing, not only for those who are resident in the city, but also for those who work there, study in or visit the city. Anecdotally, some of this occurs in NSW due to uncertainties and fears held by the landholders. This paper examines the responses provided by several NSW Local Government Authorities (LGA) to a simulated enquiry by a landholder who may wish to remain anonymous but desires to obtain guidance on how to manage Indigenous Australian heritage sites on his/her property. The information (and forward links) provided on LGA websites was found to be generally poor. Direct enquiries were found to provide accurate information, but this entailed the loss of anonymity. As the world implements social distancing and home isolation in response to the COVID-19 pandemic, access to quality greenspace close to where people live may become more critical. This research investigated residential zoning code assessment benchmarks and development outcomes in terms of changing greenspace but found that the planning assessment process made analysis fraught and inaccurate. Nonetheless, the findings indicated that impact assessable development applications and approvals were not consistent with the stated policy objectives. Closer adherence to stated assessment benchmarks providing more generous setbacks, building separation and greenspace, could achieve the policy intent of higher-density development in a clean, green, sustainable city. The significance and implications of such findings has relevance for broader policy development, implementation and evaluation to improve governance through effective, efficient evaluation of policy outcomes. This study highlighted the imperative for demonstrable compliance with assessment benchmarks; and identified the need for future research into evaluation of planning policy implementation, to ensure outcomes comply with stated objectives. Further research is also required to understand the impact of, and future planning requirements for, residential greenspace. Highlights: Brisbane’s planning vision recognises the importance of greenspace provision. Development applications and approvals were not consistent with the stated policy intent. New development approvals had significantly reduced greenspace around sites. Public submissions had minimal impact on development approval outcomes. In March 2018, an Australia-wide Internet survey mainly of clubs and councils was conducted which asked respondents to rate the scenic quality of the landscape with and without a wind farm, and also to rate the acceptability or otherwise of the wind farm in scenes with the wind farm. Photographs of wind farms in NSW, Victoria and SA were used. From the response of nearly 800 participants a sample of 556, weighted to be representative of the Australian population, was analysed. While the respondents rated the scenic quality of landscapes with wind farms lower than scenes without them, they rated wind farms acceptable in virtually all landscapes, including high scenic quality coastal scenes. The finding suggests that the community is very tolerant of the visual impact of wind farms. Results are presented for 18 wind farms. This survey is unique in that it not only asked participants to rate the landscape with and without wind farms but it also asked them to rate the acceptability of the wind farm in each scene. Based on existing theory, an analytical framework is built to locate gentrification, which takes into account various demographic indicators and spatial markers. The findings are quite surprising, and contradict earlier urban geography theories that frame gentrification as an inner-city phenomenon. The highest levels of gentrification are not found in the immediate inner cities but rather in a band located 5–15 km from the CBDs. In contrast to outer suburbs, the inner suburbs in all three cities are relatively stable and affluent at this point, with median house prices surpassing one million dollars, and median incomes substantially higher than average.
