{"title":"The Implication of the Interim Measures Issued by Arbitrator\u0000(A comparative analysis)","authors":"Abd Almohsen Alajmy","doi":"10.33193/IJOHSS.18.2021.190","DOIUrl":"https://doi.org/10.33193/IJOHSS.18.2021.190","url":null,"abstract":"Article 173 of the Kuwaiti Arbitration Act, as a general principle, preserves the authority to issue interim measure to the court. By the language of Article 173, it can be inferred that the legislator intended to imply a number of legal prohibitions. The language of exception in Arabic legal text reflects the following norms, first: the exceptional law should be narrowly interpreted to avoid any incompatible meaning which conflicts with the general intention of the legislator.  Second, it cannot be relied on in a comparative analysis to examine the legality of similarly situated issue. For instance, if the parties drafted a mediation agreement, they cannot consent to allow the mediators to issue interim relief relying on the permissibility contained in Article 173. Hence, the Arbitration Act adopted the ‘duality principle’ which enables courts to issue any type of preliminary relief notwithstanding parties’ consent to confer this power to the arbitral tribunal. The problem is that the law does not address whether the interim relief issued by arbitral tribunal should be enforced or whether cannot be appealed, therefore the matter cannot be litigated again. \u0000This article will trace the arbitration law approach of Kuwait, in a comparative method, in relation to the applicability of the interim measures to the resolution of the final dispute. This requires that conflicts which are a natural part of human life are amicably resolved when they arise. Largely, people have the options of resorting to the statuary courts system or indigenous approaches which are rooted in the customs and traditions societies for the resolution of conflicts. This study examined the indigenous conflict resolution among the Nabdam of Ghana using the descriptive design within the qualitative research paradigm. It involved thirty persons from the area consisting chiefs, elders, and individuals who have employed the approach in resolving their disputes. The instruments of interview guide, focused-group discussion guide, and observation check lists were deployed to gather data for the respondents. It emerged from the study that the Nabdam indigenous conflict resolution approach is a well-structured one with four stages which has no formal place the involvement of women. It also emerged that despite modernization and proliferation of religions in the area, the approach has potential into the future due to many factors. Even though women have no official role in the application of the Nabdam indigenous conflict resolution approach, they were found to be effective in managing disputes especially those involving women. {"title":"Training of 'Body Language and Public Speaking' and Pupil’s Disruptive Behaviour","authors":"Aymen Hawani, Maher Mrayah","doi":"10.26803/IJHSS.12.6.1","DOIUrl":"https://doi.org/10.26803/IJHSS.12.6.1","url":null,"abstract":"The purpose of this study is to describe and analyze students' disruptive behaviour and teacher trainee’s responses before and after a Body Language and to Speak in Public training module for school teachers at the end of initial training physical education teachers (PET). A quasi experimental research is used to find out the effect of Language and to Speak in Public training on students’ disruptive behaviours. A sample of 389 students; 243 males and 146 females participated in this study along with 20 trainee teachers; 10 (6 males and 4females) who constitute the control group while 10 (5males and 5females) make the experimental group. The investigators have adapted Brunelle’s Disciplinary Incidents Observation System (DIOS) and used Sony model 4K Handcam cameras with builtin projector and a BoomTone DJ wireless microphone equipped with a transceiver to detect and record students’ disruptive behaviours, respectively. Findings reveal that the courses directed by trainee students during work readiness internships show a high degree of disruption, since there is a rate of 1.3 and 1.01 DB per minute. The frequency of onset of disruptive behaviours (DB1 and DB2) is slightly lower in sessions facilitated by trainees who have been trained in \"Body language and public speaking\". Similarly, at the level of disruptive behaviours (DB3), the trainees who underwent the training realized more significant decrease in the frequency of appearance of these behaviours. Faced with these disruptive behaviours, the trainees who attended the training were slightly more interactive in their reactions during the sessions. Findings constitute a repertory index to perceive the different disruptive behaviors of students and the reactions of trainee students to these behaviors. {"title":"Response of sweet corn (Zea mays L. var. saccharata) to vermicompost and inorganic fertilizer application","authors":"Jeffrey P. Villaver","doi":"10.26803/IJHSS.12.6.2","DOIUrl":"https://doi.org/10.26803/IJHSS.12.6.2","url":null,"abstract":"This study was conducted to determine the appropriate rate of vermicompost that would influence the agronomic performance and evaluate the effect of combining the different vermicompost rates and the specific rate of inorganic fertilizer that could effectively promote the growth and yield of sweet corn. The experiment was conducted in a Randomized Complete Block Design (RCBD) with ten (10) treatments and three (3) replications. The treatments are as follows: T1 – 120-90-60 kg ha-1 inorganic fertilizer or farmers’ practice, T2 – 5 t ha-1 vermicompost + 102-76.5-51 kg ha-1 inorganic fertilizer, T3 – 10 t ha-1 vermicompost + 96-72-48 kg ha-1 inorganic fertilizer, T4 – 20 t ha-1 vermicompost + 84-63-42 kg ha-1 inorganic fertilizer, T5 – 40 t ha-1 vermicompost + 60-45-30 kg ha-1 inorganic fertilizer, T6 – no application (control group), T7 – 5 t ha-1 vermicompost, T8 – 10 t ha-1 vermicompost, T9 – 20 t ha-1 vermicompost, and T10 – 40 t ha-1 vermicompost. Results of the study revealed that the different treatments influenced the ear yield (husked and unhusk), kernels per ear, weight per ear, percentage of marketable ears, percentage of barren plants, and percentage of double ears. The treatments 1 to 5 yielded significantly higher compared to the control treatment (T6) which implies that the application of vermicompost with 50 - 85% of the farmers’ practice had significant improvement in sweet corn production. The application of 20 t ha-1 vermicompost + 70% of farmers’ practice achieved the highest yield at 12.50 and 15.80 t ha-1 husked and unhusk ears respectively. Highest percentage of double ears at 29.69% was attained on the plants applied with 40 t ha-1 vermicompost + half of farmers’ practice. {"title":"Redefining Social Constructs: An Exploratory Research on the Integration of Deaf Employees in the Philippine Metropolitan Workforce","authors":"J. Nevertheless, as movements on redefining the society began to materialize, much has been done to improve the status of the Deaf, as demonstrated by workplace inclusion and accommodations. Therefore, the study's primary purpose was to gauge the extent of this leap of social structure by investigating employer attitudes, capacities, struggles, and achievements in the employment of Deaf employees while taking into account the real essence of workplace inclusion. An exploratory study design was conducted with two subframes of participants: the hearing employers and Deaf employees. Recruitment of participants was achieved through purposive sampling, and data was gathered using a mixed-methods approach. Research instruments included Attitudes to Deafness Scale, Basic Need Satisfaction at Work, and Rosenberg Self Esteem Scale. Descriptive and exploratory analyses were used in the interpretation of results.  Results showed a significant difference between the employers and the Deaf employees' perspectives, raising an issue on the separation between diversity and inclusion.
