The consequence of this rule of law is that all aspects of state life are regulated in existing legal policies. This applicable law has a function as a regulator of all community actions including children. Children need special protection and enforcement within the protection of the law itself. The influence of all existing developments, including the development of science, technology, and culture, is not only felt by adults, but also by children. Along with these developments, it also does not cover the emergence of deviant behavior from minors, and one form of deviation is bullying. In Indonesia itself, cases of bullying are often found by underage children which have even been categorized as violence and bullying. Then often the perpetrator is not punished according to his actions just because he is underage, so this makes it difficult for the victim to heal the trauma because they still see the victim roaming around without proper law enforcement. Starting from actions or treatments that can result in psychological, physical and social losses, so that one of the steps in overcoming this is to ensure protection. The government's effort in tackling this problem is to create a statutory regulation regarding the protection and needs of children's rights which becomes a reference for the effectiveness of efforts in child protection issues. Because the law discusses how we should treat children so that they are prosperous and protected and their needs and rights are fulfilled. In an effort to understand it further, this journal was created to compare the concept or basis of child protection from Indonesia and Malaysia. {"title":"Sexual Harassment Cases in the Indonesian Broadcasting Commission Against Victims: How is the Law Enforcement?","authors":"Aulia Maharani","doi":"10.15294/jcs.v7i1.36285","DOIUrl":"https://doi.org/10.15294/jcs.v7i1.36285","url":null,"abstract":"In mid-2021, the Indonesian people were shocked by a news report about a case of same-sex sexual harassment carried out by employees of the central Indonesian broadcasting commission or better known as the central KPI. Which is, this case has been going on for a long time but due to the slow handling of the law, the victim also made an open statement to social media so that this case was widely discussed. The form of same-sex sexual harassment according to positive law is basically the same as sexual harassment against the opposite sex, only the difference lies in the perpetrator and the victim, namely the same sex. The elements of same-sex sexual harassment are the existence of an act related to sex, the form of the act is physical and non-physical and there is no voluntary action. The method of writing this article is based on normative law with a statutory approach and a case approach. The results of the research in this article show that there is evidence against perpetrators of same-sex sexual harassment by co-workers at the Central KPI. However, in accordance with the provisions of Article 184 paragraph (1) of the Criminal Procedure Code that evidence is carried out with the testimony of witnesses, expert statements, letters, instructions and statements of the defendant. The discussion of this article uses a written study from various reading sources which is entirely aimed at developing speculations related to the growth of victims, the causes of sexual brutality in children and the impact and treatment of sexual crimes on children, as well as on adults. Sexual violence is an activity that is carried out by someone without the consent or willingness of the person who is the victim of the sexual violence. In this sexual violence the acts are in the form of rape by a stranger, rape in a marriage relationship and there is also courtship, this sexual harassment can be in the form of mental or physical abuse, forced abortion, and there is also sexual abuse of children. Of the types of sexual violence is a form of violation of human rights (HAM) that can have a psychological impact on victims of sexual violence. \"Theresia\" in the Pulih Foundation Webinar with The Body Shop Indonesia, Tuesday (29 June 2021) said that the psychological impact on victims of sexual violence for example, such as mental disorders, depression, personality disorders, psychotic disorders, panic disorders, trauma, insomnia, and symptoms of disorders that cause unable to be himself, then there are thoughts of ending his life, abusing drugs and alcohol for him to escape from the problems he faces and to make his life more calm”. The research objectives of this article are to find out how sexual violence occurs, the psychological impact of sexual violence, and to find out how the psychological dynamics of victims of sexual violence are.
