That a ‘right’ of states against individuals could be embedded within instruments otherwise dedicated to the protection of individual rights against the state is the foundation and the exemplar of immigration exceptionalism. This chapter focuses on the emergence and articulation of this exceptional norm in the jurisprudence of apex courts in the Anglosphere and the European Court of Human Rights. The first part of the chapter explains how the norm manifests doctrinally in the jurisprudence of the United States Supreme Court (plenary power), the Supreme Court of Canada (Chiarelli exception) and the European Court of Human Rights (Strasbourg reversal). The next part turns to the genealogy of the legal equation of sovereignty with border control. I argue that courts have relied on a selective and strategic misreading of eighteenth century jurist Emmerich de Vattel’s account of the law of nations. This distortion of Vattel commenced in the eighteenth century and has assumed a taken-for-granted quality that resists the re-examination required to challenge immigration exceptionalism. The fundamental formal error upon which immigration exceptionalism rests is the confusion of a state’s right under international law and a state’s power under domestic law. States possess rights against other states under international law, including the right to regulate borders. Domestically, states exercise power over individuals to regulate entry. But state constitutions and regional rights instruments cannot create or protect a state’s right against individuals. States assert powers over people; people assert rights against the unlawful exercise of those powers. Properly understood, a claim that the state has a ‘right’ (as opposed to ‘power’) to exclude or expel the non-citizen is incoherent and antithetical to the normative foundation of contemporary rights instruments.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"105-127"},"PeriodicalIF":0.0,"publicationDate":"2023-11-10","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147890817","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

But, as all good constitutional lawyers know, those texts and doctrines are completely and complexly intertwined with the political systems within which constitutional law is found. For that reason, understanding constitutional law means understanding constitutional politics as well. The Handbook deals with the politics of constitutional law around the world. We have chosen to organise the Handbook around ‘foundations,’ ‘structures,’ ‘rights,’ and ‘futures.’ The content of the categories of ‘structures’ and ‘rights’ is obvious; by ‘foundations,’ we mean the key reasons, principles, trends, and extra-legal considerations underpinning constitutional creation and design; and by ‘futures,’ some of the questions that seem likely to shape constitutional development around the world.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"1-12"},"PeriodicalIF":0.0,"publicationDate":"2023-11-10","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"https://www.elgaronline.com/downloadpdf/edcollchap/book/9781839101649/book-part-9781839101649-7.pdf","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147887276","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"OA","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Designed to promote ex lege exclusion from rights on the basis of pre-modern blood-based caste assignment, citizenship faces difficulties in the world of human rights, which are concrete and individualisable as opposed to the world of citizenship, which is general and necessarily abstract.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"550-569"},"PeriodicalIF":0.0,"publicationDate":"2023-11-10","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147911686","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It is something that sociology, and particularly political sociology, should and can address to a greater extent than it has previously. While teaching and research on the far right has traditionally been interdisciplinary, it has been dominated (and its assumptions, theoretical framing and questions, determined) by disciplines other than sociology, including political science, terrorism studies, history, and criminology. In this chapter, I will: 1. Reflect on my experience teaching, as well as researching, the far right, as a sociologist; 2. Provide an overview of the contributions different disciplines and disciplinary approaches make to our understanding or the far right and what I refer to here as 'far right studies', including sociology; 3. Discuss issues, topics and gaps in the field that political sociology, and wider sociology, can speak and contribute understanding to, as well as highlight potential challenges. While it will not provide a template or instructions for teaching about the far right in political sociology, either as a stand-alone module, or as a lecture or unit on one, I do hope that this can provide a resource and starting point for educators.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"48-72"},"PeriodicalIF":0.0,"publicationDate":"2023-10-19","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147891041","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

I situate the durable solutions in a sedentarist worldview where - despite the prevailing protractedness of most displacement-settings - non-migratory living is the norm. The chapter introduces the meaning and practices of the three solutions as an interaction between policy and the experiences and practices of displacement. The chapter also introduces the four chapters in this Part in the overall discussion of the durable solutions: the strategic use of durable solutions in the Latin American context; the way housing has been used in formulating locally based solutions for internal displacement in Georgia and Ukraine; the role of self-reliance and economics of displacement in promoting solutions for both refugees and internally displaced in Uganda; and identifying alternatives to the durable solutions.","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"332-349"},"PeriodicalIF":0.0,"publicationDate":"2023-10-17","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147915295","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

By questioning forced migration only with the grammar of inclusion/exclusion and citizenship, the communitarian (Walzer, Wellman) and cosmopolitan (Carens) positions, which are very far apart, ignore the concrete experience of mobility and the political character of forced migration. For Hervé Nicolle, this is a symptom of a critical deficit. How can we think of a philosophy that does not take forced migration as an object but starts from the migrants' own experience? To think about migration in a political and effective way, we need to go beyond the questions of 'thresholds of acceptability', of labels, of 'good' or 'bad' migrants, by moving from a metaphysical understanding of freedom (states, individuals) as free will or autonomy to a political understanding of freedom as relationality (Butler) and plurality (Arendt).","PeriodicalId":42994,"journal":{"name":"Cambridge International Law Journal","volume":"1 1","pages":"46-58"},"PeriodicalIF":0.0,"publicationDate":"2023-10-17","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"147900594","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
