The oil and gas sector in Peru considers foreign investment crucial for sustaining its development. This article explores how the lack of action attributable to key governmental entities is driving the oil and gas industry in Peru to a critical situation that over time may result in foreign investment walking away from Peru.\u0000 The article presents key governmental actors' roles, regulation and the general framework of Peru's oil and gas scenery. Public sources, statistics and records released by the key governmental actors are also presented for evidencing the negative results obtained in the Peruvian oil and gas industry as a consequence of the current administration's lack of adequate action. Reference is also made to some public specific cases to serve as examples to the reader.\u0000 It is hoped that this article serves to remind the oil and gas community of the relevance of the role of governmental entities not only in attracting new foreign investment to a country for the signing of new licence agreements, but also the important role that said entities have during the execution of the licence agreements. Losekann, Niágara Rodrigues","doi":"10.1093/jwelb/jwz030","DOIUrl":"https://doi.org/10.1093/jwelb/jwz030","url":null,"abstract":"\u0000 The study assesses the relevance of the recent local content policy (LCP) reforms for the oil sector in Brazil on the attractiveness of investments in exploration and production (E&P), and in terms of employment and income generation. For this, a cash flow of a typical E&P project was simulated in the Brazilian pre-salt environment in a field with reserves of 5 billion barrels of oil equivalent, under the regime of production sharing, adopting the assumptions of government participation of the tender protocol of the Libra field. In addition, in order to estimate the impact of the LCP on the generation of employment and income, the methodology of the Input–Output Model (IOM) was applied. The results indicated that high commitments of local content (LC), in contexts of restricted oil prices, compromise the profitability of E&P projects. In addition, the results showed that a greater volume of investments can more than offset the impact of higher levels of LC in generating employment and income for the country. We seek to contribute to decision making based on multicriteria analysis about the options for uninstalling specific equipment in the production chain: subsea equipment. The objective is to demonstrate that there is legal predictability supported by the technical aspect for the options that are possible in each case. The methodology used was the literary revision combined with a national and international legislative analysis that allowed the presentation of the final conclusion. The country already holds 5 billion barrels of proved reserves, which will certainly grow with new discoveries. Exxon leads a consortium of four companies that have the concession of the Stabroek Block (Liza Field), where nine discoveries have been made so far. Five FPSOs will be operating in the future, one of which is due to arrive in Guyana before the end of 2019 and another is due for 2020. By then, the country will be producing 340,000 barrels a day. This production will double and then reach 1 million barrels a day before the end of the next decade. The challenges and opportunities regarding the Guyanese people are dire. The lack of proper infrastructure is certainly one of the biggest challenges. But it is important to stress that the oil proceeds will transform Guyana into the highest GDP per capita of South America. The political stage is also analysed, since political instability might raise concerns for long-term investors. The Venezuela–Guyana differences regarding the sovereignty of the Essequibo Region are again a cause for concern. Brazil is a key player in supporting the geopolitical stability of South America. Presidential elections will be held in 2019/2020: the dispute will probably be between the current President Granger and the Opposition candidate Irfaan Ali. The sweeping changes brought by this change of paradigm for a country with declining conventional natural gas reserves in a gas dependent domestic economy require urgent infrastructure expansion to solve bottlenecks to reach domestic and international, markets, to be achieved only through stable market rules and a robust framework for a further trunk pipeline. In these cases the steps of physical abandonment, dismantling of facilities and restoration must be fulfilled, a situation that can occur in any of the phases of the contract, leading to a variation in the obligations by the concessionaire according to the activities that must be performed in each phase. The Agencia Nacional de Hidrocarburos (ANH by its acronym in Spanish) is the administrator of the hydrocarbon resource in Colombia and within its functions is the concession aire of the areas for the exploration and exploitation of hydrocarbons. This document highlights the role of the ANH as a contractual subject and responsible for compliance with the contractual obligations between the Agency and the concessionaires as well as the rules and regulations established by law. Oil and gas lawyers, and other stakeholders in Egypt, face the same challenge. This article discusses the topic of the decommissioning of oil and gas fields in the context of the legal aspects and the regulatory framework for decommissioning in Egypt, demonstrating the main challenges relating to the legal framework for decommissioning arrangements in the country. At the heart of the legal challenges associated with the decommissioning of oil and gas fields in Egypt lies the most important question: who should pay the associated costs, and when?
