This ruling marks the end of a long and controversial academic discussion on the nature of the solidarity principle. At the same time, the ruling is just the beginning of further legal research on what exactly the content of the obligations and possible conflicts with Member States sovereignty under Article 194(2) TFEU is. The following article analyses the effects of the principle of energy solidarity on the nascent regulatory framework on hydrogen markets in the European Union (EU). It is common sense that those markets shall evolve swiftly to achieve emission reduction goals. There is no European regulation on pure hydrogen markets in force yet, but some EU Member States have already taken legislative action. Against this background, the article will particularly assess the impact of the principle of solidarity on national measures regarding network planning and hydrogen import.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"129 10","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-28","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136231775","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It explores Brazil's transition of nuclear energy policies from a military-centric approach to civilian perspectives following the country’s re-democratization in the 1980s. The article highlights the importance of nuclear energy diversification for stabilization and low-carbon energy generation in Brazil. It discusses the challenges and vulnerabilities of the Brazilian nuclear industry, focusing on the corruption scandal of 2015, revealing improper payments, mismanagement, bribery, and money laundering in constructing the Angra 3 nuclear power plant. The study proposes improvements in the corporate governance of the Brazilian sector to minimize potential corruption cases in future contracts. It analyses the conflict of interest among regulatory institutions, industry agents, and the corporate environment. This article also compares the Brazilian nuclear regulatory framework with international regulations and discusses strategies for combating corruption in nuclear power generation. The concluding remarks emphasize the need for institutional reforms to safeguard and develop the Brazilian nuclear industry.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"42 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-10-14","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135765983","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The various energy crises that have occurred have had major negative impacts on both the economic and social spheres. The current worrying world energy situation, characterized by a constant increase in demand, polluting emissions and rising prices of energy, as well as an inevitable depletion of fossil fuels, has in recent years generated a general awareness of the need to develop sustainable energy solutions. Currently, the high dependence on foreign suppliers for energy imports has put the accessibility and affordability of energy at risk, and States have had to develop numerous initiatives to protect consumers from volatile energy prices. In this framework, widespread energy production through renewable energy sources and the use of Power Purchase Agreements (PPAs) emerge as tools to achieve energy security and mitigate energy vulnerability and poverty. This research aims to contribute to this effort by making an approximation to the Cuban legal and institutional framework of PPAs. Cuba, in line with the current global energy context, is in search of energy sovereignty based on renewable energy sources. Throughout this article, it is intended to substantiate the need to regulate PPAs in the pursuit of sustainable energy development solutions. With the enactment of Decree Law 345 of 2019 for the promotion of renewable energy sources and efficient energy use and its complementary rules, the first regulatory foundations for PPAs have been laid. While the Cuban legal energy system has been making substantial progress regarding PPAs, it must still strive to be further perfected.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"15 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-15","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135394471","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It will focus on long-term take-or-pay natural gas and liquefied natural gas sale and purchase agreements (natural gas and LNG SPAs) that are commonly used in the natural gas sector. These agreements often contain highly restrictive clauses that are designed to ensure stability of supply and demand, which makes them suitable for acquiring the project financing necessary for large capital-intensive energy projects. At the same time, these agreements create an important lock-in effect for the contracting parties. This article will examine the details of gas SPAs from the perspective of this lock-in effect. It will show that current contractual formulations do not provide an adequate solution in the context of the energy transition. Because of this lock-in effect, there is an urgent need to adapt existing contract forms for future use, and to modify the continued application of existing executory contracts to accommodate new realities.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"40 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-09-11","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136070909","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

It scrutinizes the efficacy of current reporting regimes and their capacity to capture the distinct nature of company activities. The study underscores the importance of flexibility tools in customizing disclosure obligations to individual companies, striking a balance between competing informational interests and adhering to principles of reasonableness and proportionality. It highlights the double materiality criteria and the ‘comply or explain’ mechanism as pivotal in tailoring reporting duties. Moreover, the article argues for better integration of fintech and greentech to modernize the disclosure obligation, making the disclosed information digitally tagged and machine-readable. It also investigates the potential for technology to ease the existing negative or preventive approach characterizing enforcement mechanisms, possibly setting the incentive for information disclosure. The conclusions encompass policy recommendations aiming to harness the opportunities offered by technology in the context of CSRD, aligning the reporting duties with contemporary needs.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"20 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-08-29","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"136243306","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The trend in the literature has been to discuss these principles in the context of developed countries, considering, for example, the impact of and significant literature on the polluter-pays principle. This article offers an original review with a contribution in discussing the new Middle Eastern energy and climate ambitions of the Kingdom of Saudi Arabia (KSA). These goals are contained within the promising policy document known as Vision 2030, and this review explores these energy and climate ambitions in the legal context of environmental principles. The study reviews the literature on the environmental principles in the Middle Eastern context of the Kingdom of Saudi Arabia and utilizes doctrinal and socio-legal methods (including expert interviews) to explore the practice of Vision 2030. This article advocates that, with the advent of the Kingdom of Saudi Arabia Vision 2030, the application of these principles can fill an existing lacuna in legal scholarship and advance governance in the areas of energy and climate change.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"75 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-08-25","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"134931514","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Nevertheless, this network is not being utilized to its full potential, indicating the importance of coordinated energy planning. This article examines the disputes over the Yazhong-to-Jiangxi UHV projects and identifies institutional constraints rooted in the regulatory structure, which hinder the effective utilization of the UHV networks under China’s Electricity Law. These constraints include deficiencies in the energy planning framework, inconsistencies in transmission planning authority, non-binding approval system and gaps in relevant laws. This article concludes with recommendations for reforming the transmission planning and approval system, improving regulatory capacity and amending energy laws to optimize the role of UHV transmission systems in renewable energy integration.","PeriodicalId":427865,"journal":{"name":"The Journal of World Energy Law & Business","volume":"18 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-06-27","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135454411","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
