{"title":"Modern Illegal Drug Business in Ukraine: Multidisciplinary Study of the System of Prevention and Countermeasures Against the Legalization of Income (Money Laundering) Obtained by Criminal Means","authors":"Valentyn Shapovalov, O. Veits, Andrii Diachenko","doi":"10.53933/sspmlp.v4i2.145","DOIUrl":"https://doi.org/10.53933/sspmlp.v4i2.145","url":null,"abstract":"Established that the modern illegal drug trade is an integral part of transnational organized crime, involving the laundering of proceeds obtained through criminal activities. A comprehensive multidisciplinary study was conducted to evaluate the effectiveness of Ukraine's efforts to combat the contemporary drug trade and to analyze the international system for preventing and countering the legalization of illicit income (money laundering). This study confirmed the connection between transnational organized crime and the laundering of money derived from the illegal trafficking of banned psychoactive substances. The research emphasized the critical need to enhance the criminal and legal frameworks, improve medical and pharmaceutical support, and expand social and economic assistance. By examining the global experience in combating organized crime and drug-related offenses, the study provided valuable insights into effective strategies. Particular attention was given to forensic pharmaceutical practices related to the detection of prohibited psychoactive substances and the legalization of income from their illicit trade. To address these challenges, the study recommends increasing the criminal liability for members of organized drug trafficking gangs and suggests specific amendments to articles 115, 305, and 307 of the Ukrainian Criminal Code. Furthermore, a detailed analysis of the European Union’s roadmap and international cooperation efforts in combating the illegal circulation of prohibited psychoactive substances and the laundering of illegal profits was conducted. Normative initiatives aimed at amending Article 209 of the Ukrainian Criminal Code were developed and proposed. The study indicated the importance of implementing the EU Roadmap measures in Ukraine to foster cooperation among various private and public institutions. This collaborative approach aims to coordinate joint actions, conduct research, and organize conferences and training sessions based on the EMCDDA European prevention program and UN initiatives. The study underscores the relevance, timeliness, and practical significance of engaging the international community, including scientists, medical professionals, pharmacists, students, the public, legal experts, law enforcement, and government authorities. Understanding labor protection laws helps healthcare professionals recognize their rights and responsibilities, leading to safer work environments. This knowledge is pivotal in preventing occupational hazards, which are prevalent in healthcare settings, including exposure to infectious diseases, chemical substances, and physical strain. Furthermore, legal knowledge in these areas enhances the professional competency of healthcare workers, promoting a comprehensive approach to patient care and facility management. It empowers healthcare professionals to advocate for better working conditions and patient safety, reflecting their commitment to ethical and legal standards in healthcare. The key aspects of the work program under the normative educational component \"Occupational safety and occupational safety in the industry\" in the training of specialists of the second (master's) level of higher education in the specialty 226 \"Pharmacy, industrial pharmacy\", specialization 226.01 \"Pharmacy\" of the field of knowledge 22 \"Health care\" were analyzed I\". The training of future occupational health and safety specialists is aimed at the formation of professional skills and knowledge necessary for effective work in the modern pharmaceutical environment of occupational safety and health. The study determined the priority directions of the educational process: legislative regulation in the field of labor protection, fire safety, and the sanitary-epidemiological regime in pharmacy. The relevance of acquiring legal knowledge of labor protection, fire safety, sanitary and epidemiological regime by future healthcare sector specialists were substantiated. A legal, forensic and pharmaceutical, forensic and chemical, forensic and narcological, forensic and toxicological, forensic and psychiatric, criminal and legal study of the illegal circulation and distribution of amphetamine and its derivatives in an interdisciplinary context was conducted. The classification and legal group of amphetamine has been established. The experience of the international anti-narcotic association on the impact of amphetamine on life, the state of the body, and side effects was studied. Forensic and pharmaceutical analysis of criminal offenses was conducted. The results of a European online survey on the circulation of prohibited psychoactive substances in 21 EU countries, 9 non-EU countries, including Ukraine, were studied. Types of illegal amphetamines were analyzed. Drugs with amphetamine for the pharmacotherapy of narcolepsy were given. Forensic and pharmaceutical practice was summarized. Amendments and additions to Part 3 of Art. 307 of the Criminal Code of Ukraine regarding the strengthening of criminal liability for illegal trafficking of amphetamine were proposed. The peculiarities of the toxicology of amphetamine in the human body were given. This abstract provides an overview of a multidisciplinary study that delves into the various aspects of falsified alcohol, including forensic and pharmaceutical, criminal and legal, clinical and pharmacological perspectives, with a focus on its circulation and the factors that contribute to its detrimental effects on the human body. Forensic and pharmaceutical analyses play a crucial role in the identification and characterization of falsified alcohol. Additionally, pharmaceutical investigations explore the packaging, labeling, and branding of falsified alcohol, uncovering the intricate web of counterfeit alcohol production and distribution networks. The criminal and legal aspects of falsified alcohol encompass a wide range of issues, including the illicit production, sale, and distribution of counterfeit alcohol, as well as the legal ramifications for those involved in its trade. This study examines the various criminal activities associated with falsified alcohol, such as smuggling, counterfeiting, and fraud, and the legal frameworks in place to combat these activities, including international conventions, regulations, and enforcement strategies. The clinical and pharmacological aspects of falsified alcohol delve into the health consequences of consuming counterfeit alcohol. Falsified alcohol can cause severe adverse effects on the human body, ranging from acute intoxication to long-term health damage, including organ failure, blindness, and even death. This study explores the clinical manifestations of falsified alcohol poisoning, the challenges in diagnosing and treating its victims, and the pharmacological mechanisms underlying its toxic effects. Furthermore, this study researches the circulation of falsified alcohol, including its routes of distribution, the key players involved in its trade, and the socioeconomic factors that contribute to its proliferation. The study also explores the factors that contribute to the destruction of the human body by falsified alcohol, including the chemical composition of counterfeit alcohol, the dose and duration of exposure, and the susceptibility of individuals to its toxic effects based on factors such as age, gender, genetics, and comorbidities. The article examines various aspects of drug smuggling, including the production, transportation, and sale of drugs, as well as their impact on public health during the pandemic. The author also examines the problem of the development of international criminal networks involved in drug smuggling and points to the need for cooperation between countries to combat this phenomenon. Finally, the article discusses the impact of the pandemic on the growth of illegal drug circulation and the need for additional measures to combat this problem. \u0000The article also examines the role of the forensic pharmaceutical case in the fight against drug smuggling. The mechanisms of control over the production and supply of drugs are considered. The authors draw attention to the importance of preventing drug smuggling and provide recommendations to prevent the spread of this problem. \u0000In general, the article provides a holistic overview of the problem of drug smuggling during the COVID-19 pandemic, which is one of the most pressing problems today. The authors show that this phenomenon is a complex problem that requires cooperation between different disciplines and international organizations. The system of standardization and quality control of medicines includes the National System of Standardization of Medicines in Ukraine (1992); The system of state control of the quality of medicinal products (1992); Programs for the development of generic drugs in Ukraine (1995); The school of standardization and quality control of medicinal products; Center for standardization, metrology, and quality control in Ukraine. Ukraine got observer status in the European Pharmacopoeia in 1998. The National Pharmacopoeia of Ukraine (2001) appeared 6-7 years earlier than other countries (Belarus, Kazakhstan, Russian Federation). Two editions of the State Pharmacopoeia of Ukraine, totaling thirteen volumes and 7,208 pages, was developed as of 2022 and put into effect. The State Pharmacopoeia of Ukraine is fully harmonized with the European Pharmacopoeia and is the basis of the entire system of standardization and quality control of medicinal products in Ukraine. A pharmacopeial language (Ukrainian terminological apparatus), which did not exist before, was developed, and implemented. The State Pharmacopoeia of Ukraine is an important reference-informational and educational-methodical material for pharmaceutical enterprises, health care institutions, pharmacies, universities of medical and pharmaceutical profiles. The national system of pharmacopeial standard samples largely meets the needs of national control laboratories, and ranks the 6th in the world in terms of the number of pharmacopeial standard samples. The State Pharmacopoeia of Ukraine is the only pharmacopoeia in the world in which standardized validation procedures have been introduced, which has turned validation into an ordinary routine procedure. Ukraine acquired the status of a full member of the European Pharmacopoeia in 2013. European standards for the quality of medicinal products are in force in Ukraine. The State Pharmacopoeia of Ukraine acquired voting membership in the Pharmacopoeia of the United States in 2010. In order to develop texts that are not in the European Pharmacopoeia (in particular, monographs on ready medicines), the State Pharmacopoeia of Ukraine concluded Agreements with the leading pharmacopoeias of the world – the USA in 2010 and Great Britain in 2013. A powerful market, world- and European-level pharmaceutical industry was created, which was included in the field of health care, which provided the pharmacy network and health care institutions with modern, effective, safe, high-quality, and economically available drugs.
