El Pacto Verde de la Unión Europea (UE) es un ejemplo en este sentido. Este artículo propone que la Comunidad Andina (CAN) siga ese ejemplo, estableciendo políticas de precios al carbono dentro del marco normativo comunitario, adaptándolas a su nivel de integración regional y a las necesidades de sus países miembros. Planteamos cinco ideas de políticas de precios al carbono que los países andinos podrían adoptar en el marco de la CAN: eliminar progresivamente los subsidios a los combustibles fósiles, regular ajustes fiscales al carbono en frontera, crear un impuesto regional al carbono, definir un precio social al carbono de referencia y establecer un mercado regional de carbono. Para concretarlas, la CAN puede optar entre establecer legislación comunitaria de uniformización o de armonización. In this regard, article XXI of the General Agreement on Tariffs and Trade (GATT), by enabling the adoption of measures necessary for the protection of the essential security interests of a State «in times of war», must be interpreted in the light of general provisions on aggression. This objective will necessarily lead us to consider whether the bodies of the WTO dispute settlement system (DSS) are competent to understand, in a situation where an act of aggression has been committed and in general terms, what implications —mainly legal, but also institutional and political in nature— the violation of the jus cogens has in a dispute before the DSS. To this end, this investigation explores the content and scope of GATT’s article XXI and its interpretation, in particular, of the meaning of the term «war» in subparagraph b, subsection iii, and then considers the implications of its possible application in the light of international rules on aggression and the jurisdiction of SSD bodies in this regard. For this purpose, 195 sources were analyzed, including articles, books and chapters of books written in Spanish, obtained through the databases and the search managers Scopus, Web of Science, Proquest, Mendeley, Ebsco, Clase, Redalyc, Scielo, Dialnet, Latindex, Academic Record, Researchgate.net and Academia.edu. The inquiries allowed to establish that in the literature produced in Spanish about the rights of children there are three research developments. In the first one, the texts that indicate that children cannot have rights or, in their absence, have to assign their ownership to an adult because of their vulnerability, irrationality and disability. In the second, the writings that replicate the Convention on the Rights of the Child or that reduce the discussion about the rights of children to legal language and its articles. The purpose of this article is to synthesize the main novelties that this norm introduces, highlighting the importance of initially reaching an agreement on the very definition of the informant. In Spain, the lack of regulation of this figure so far has led the doctrine to search for solutions in the general theory of crime, as well as in other disciplines of law, in order to solve the difficulties that have arisen with the use of reporting channels by companies that chosed to incorporate a compliance program. Finally, we will point out some of the problems arising from the transposition of the Directive from the perspective of its compatibility with the system of rights and guarantees that rule the criminal process. Areas such as urban planning or public contracting have been prolix regarding the occurrence of criminal activities that undermine the proper functioning of the Public Administration and business activity based on ethics and mechanisms to improve organizations (public and private ones) by prematurely discovering illicit conduct and, in turn, identifying the individuals responsible for such acts. In the same way, for some companies, the verification of the effectiveness of the complaint channels in court contributes to corporate defenses and in achieving exemption from criminal responsibility. Therefore, from a technical perspective, guidelines and recommendations are offered from different regulations point of view to increase the effectiveness of these channels and to reduce the legal uncertainty that occurs in Spain, given the limited drafting of the Penal Code. This standard applies in cases of publication of false and defamatory statement of facts on issues of public interest. The Constitutional Court ruled that persons involved in matters of public interest have at their disposal the mechanisms of reply and rectification to defend their reputation against the publication of information that they consider false, inaccurate or offensive; and, only if these mechanisms prove to be insufficient, they may file a civil complaint for defamation to claim compensation if they satisfy the actual malice standard. This article analyzes the origin of the actual malice standard in the New York Times Co. vs. Sullivan case to identify its nature and purposes as a stringent scrutiny to protect the right of freedom of speech and the principle that debate on public issues should be uninhibited, robust and wide-open. To do this, it examines the precedents of the United States Supreme Court to determine when the actual malice standard applies and how its configurative elements should be understood, and also outlines the main criticisms of the standard and the practical problems associated with its application. Finally, based on these findings, it examines how the standard of actual malice will be applied in Ecuador, in perspective of Decision N° 282-13-JP/19, issued by the Constitutional Court of Ecuador. Para ello, comienza con una aproximación a la pandemia y sus principales características. Subsecuentemente, aborda el principio de inocuidad en relación a tres aspectos: la integridad personal y patrimonial del consumidor como su fundamento, y sus características principales (concepto indeterminado que da origen a deberes o informa prácticas autónomas e inicialmente preventivas); su ámbito de vigencia en el sistema de consumo chileno; y la noción de consumidor vulnerable como criterio de adecuación. Luego, examina dicha temática tanto de manera general como a propósito de la atención remota y presencial. En ese sentido, este estudio postula que, en todas esas dimensiones, la conducta de proveedores y consumidores debe ajustarse a los imperativos de seguridad que permitan prevenir la generación de un daño para los sujetos intervinientes en la relación de consumo y el resto de la población. Particularly, the article analyzes the recent adoption of the Supreme Decree N° 185-2019-PCM, Regulation that promotes and regulates the voluntary implementation of regulatory compliance programs on consumer protection and advertising. In this sense, the objectives compliance programs seek to achieve are highlighted and the guidelines to be followed are addressed so that their implementation within a corporation is truly effective, particularly in terms of advertising and consumer protection.
