It echoes the official discourse on the legitimization of the criminalization of drugs focusing on the idea of public security and social defense, rather than on public health. The article calls for new interpretations of the phenomenon in order to present the criminal policy on drugs as a continuation of the State of Exception, facilitating a search for new proposals on policies to overcome this paradigm. It departs from the hypothesis that the experience of madness and the narcotization of life are symptoms of the malaise affecting Brazilian civilization, which began building a veritable “prison archipelago” of jails, asylums and shelters for its poor in the nineteenth century, implementing a set of disciplinary proceedings whose effect was to segregate its subjects. The enactment of 2001’s Law 10.216 witnessed a rupture with the asylum model and a consolidation of the psychosocial care model for the treatment of psychological suffering, further revealing a shift in the functioning of the Brazilian state – which had previously served as a tributary of punishment rationale. Despite the dissolution of the asylum model guaranteed by the enforcement of the new law, punitive rationale and its prison archipelago still characterize social ties. However, while holding Africans captive did not perturb the European conscience, the slavery of indigenous peoples instead generated intense debate. The aim of this article is to outline the reasons why blacks and indigenous people were legally segregated in their subjection to colonial law. Neto","doi":"10.15175/1984-2503-20157303","DOIUrl":"https://doi.org/10.15175/1984-2503-20157303","url":null,"abstract":"This article focuses on the conflicts surrounding the approval of the Inter-American Treaty of Reciprocal Assistance (ITRA) at the conference held in Rio de Janeiro in 1947. We analyze the draft treaties sent to the Pan-American Union, which were mainly Brazilian, Mexican and from the United States; the preliminary votes taken before the Meeting in the aim of obtaining a consensus among the countries involved; as well as the final text of the ITRA. Our hypothesis is that the final version of the ITRA failed to materialize complete US control over the other members of the Pan-American Union, instead representing a solution reached by means of negotiation in a period of transition from a policy of good neighborliness to a doctrine for containing communism. In this context, the article analyzes the “bottom up” politics employed in situations of conflict stemming from communal interventions enforced in 1954 across three regions of the province of Buenos Aires presided over by incumbent intendants (Carlos Casares, Bartolome Mitre and Lujan). Using media and government sources, the aim is to study the relationship between the provincial and municipal authorities with an emphasis placed on aspects of the political roles played by the local government. To do so, the article examines the motives and rationale provided for the interventions and focuses on the local governability, both in terms of representation and participation. To what extent did the local conflict and rupture in political alignments contribute to the dynamic the governability acquired in the communes, and ultimately, in the enforcement of the intervention? Miranda","doi":"10.15175/1984-2503-20157305","DOIUrl":"https://doi.org/10.15175/1984-2503-20157305","url":null,"abstract":"This work studies the political, social and legal aspects of Operation Condor, an international integration campaign among the dictatorships of the Southern Cone, which aimed to promote information exchange and the systematic persecution of political militants against the dictatorships in the treaty’s member states. The article aims to identify the political, social and legal consequences for these states, as well as to identify the crimes committed by the dictatorships. It is based on bibliographical research into Operation Condor, as well as a document analysis of the international and internal legislation of the countries involved in the treaty. It concludes that Operation Condor relativized the member states’ sovereignty, creating an illegal persecution bloc legitimized for the execution of reasons of state. Both authors, each in their own way, and true to their style, wrote about immigrants and immigration in a manner which was influenced by their own biographies. This influence reveals itself in their sociological understanding of the stranger as a social type, however both works feature excessively formalist definitions that do not touch upon the wealth of the communication involved in the relationship between the cultural native and the stranger. The potential for cognitive innovation and epistemological advances facilitated by the phenomenon of immigration therefore remain unexplored. A comparative analysis is set up with similar police forces trialed during the colonial period, taking into account the reforms carried out to the intendancy during the critical moments of the Revolution period. Based on this analysis, we outline a series of reflections on the fabric of the political-institutional relations surrounding the intendancy, highlighting the different ideas on police characterizing the politics of the time, all marked by the idea of centralization. The concept of genocide has thus always generated debate. This article moves beyond the simple legal definition of genocide, providing several contributions from the social sciences for an epistemological review of the concept of genocide, in the hope of better preventing the massacres affecting civil populations around the world.
