In Indonesia, Pancasila can be considered the legal basis and the source of all laws. This study aims to analyze Pancasila as a Source of Law to answer the Challenges of Globalization related to Mineral and Coal Mining Laws in Indonesia. Method: The research method used is doctrinal law. The Statute Approach examines all laws and regulations relating to legal matter. Data was collected by studying literature and conducting direct interviews with informants. Result: Generally, the legal development of mineral and coal mining in Indonesia is based on Pancasila. Mining activities must be distinct from foreign investment activities. Regarding investment, the principles of international foreign investment conventions are not under Pancasila. Conclusion: Pancasila, as the nation's basic philosophy, is open without the need to change its fundamental values to be maintained following existing developments. Thus, even though Pancasila may not be in harmony with the legal principles of international investment, as long as the executive, legislative and judicial institutions are based on Pancasila in carrying out their duties, then in the future other ideologies cannot influence Pancasila ideology.","PeriodicalId":41277,"journal":{"name":"McGill International Journal of Sustainable Development Law and Policy","volume":"328 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-11-08","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135392598","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

 Conclusiones: Se corrobora la necesidad de abordar la geopolítica y el desarrollo para situar las condiciones por las cuales históricamente Puerto Tejada ha venido incrementando sus niveles de violencia y despojo en todas sus formas. Las actuales formas de desarrollo no consideran el futuro de los jóvenes y la calidad de vida de la población y menos el trabajo que se pueden abordar con las comunidades y familias del municipio.","PeriodicalId":41277,"journal":{"name":"McGill International Journal of Sustainable Development Law and Policy","volume":"335 6","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-11-08","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135393009","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The study aims to elucidate the mechanisms through which the administrative judiciary exercises oversight over administrative and regulatory authorities and to delineate the legal foundations underpinning administrative liability for environmental damages. Theoretical Framework: The theoretical underpinning of this study is anchored in the jurisprudential doctrines of administrative law and environmental governance. The study explores the intricate relationship between administrative jurisprudence and ecological stewardship, particularly in Jordan's unique environmental challenges and legal landscape. It posits that the administrative judiciary serves not merely as a procedural instrument but as a substantive agent of ecological governance. Method: The methodology employed is a rigorous legal analysis, incorporating a review of Jordan's statutes, regulations, and judicial decisions relevant to environmental protection. The study also draws upon secondary sources, including scholarly articles and commentaries, to comprehensively understand the subject matter. Result and Conclusion: The study reveals that the administrative judiciary in Jordan plays a pivotal role in environmental protection. It serves a dual function: as a guardian of environmental integrity and an oversight body for administrative regulatory authorities. The study also highlights the adoption of the doctrine of strict liability in the Jordanian legal system, emphasizing its significance in holding the administration accountable for environmental harm. Research Implications: The findings of this study have far-reaching implications for the development of environmental policy and legal frameworks in Jordan. They underscore the need for a more integrated approach harmonizing administrative law principles with environmental governance objectives. This necessitates reevaluating and recalibrating existing legal mechanisms to ensure they align with sustainable development principles and ecological justice. Originality/Value: The study offers a novel contribution to the existing body of literature on environmental law in Jordan by focusing on the often-overlooked role of the administrative judiciary. It provides a nuanced understanding of the complexities involved in environmental governance and offers a theoretical framework that could serve as a foundation for future research in this domain.","PeriodicalId":41277,"journal":{"name":"McGill International Journal of Sustainable Development Law and Policy","volume":"328 3","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-11-08","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135392596","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The industry's idea of dynamical properties provided the theoretical foundation for the study.

 Theoretical framework: The theoretical basis is the literature on the impact that two forms of creative competitive advantage — consumer choice and innovative business structure — it has on product quality in the service of fostering long-term growth among micro, small, and medium-sized enterprises (SMEs). Also, it looked at the role that technology adoption may play as a moderator amongst innovative financial strength and customer satisfaction.

 Design/methodology/approach: Data was gathered quantitatively. Using the use of partial least squares structural equation modelling, we studied surveying information from 245 Nigerian SMEs in the manufacturing sector.

 Findings: According to the findings, indicate that consumers' inclinations would not directly impact the quality of items; rather, the introduction of cutting-edge technology moderates the correlation among consumer tastes and superiority in the marketplace. There was a significant and positive relationship found among the corporate business model and product excellence, suggesting that the integration of new technology encouraged this link. In order to grow in a sustainable manner, small and medium-sized enterprises (SMEs) in the industrial sector, as found in this research, would profit from a rise in customer satisfaction achieved via the introduction of innovative competitive supplementary cost approaches and technical progress.

 Research, Practical & Social implications: This research aimed was to investigate how SME' long-term success is affected by factors including consumer preferences and innovative business layout (SMEs). It also looked at how the technological proliferation may affect the correlation amongst innovative capacity and customer satisfaction.

The study aims to understand the meaning, motives, and experiences associated with this construction of jihad, particularly in the context of addressing religious radicalism affecting women in the regions of Garut, Tasikmalaya, and Tasikmalaya City.

 Method: The research methodology employed is constructivist qualitative, utilizing data collection techniques such as interviews, observation, and documentation. Purposive sampling was used to select informants, including female ulama, women leaders and activists, radicalism observers, and members of the Executive Board of the Indonesian Ulama Council in the specified districts. The study focuses on the religious approach taken through da'wah in women's taklim assemblies (Islamic study groups) to construct jihad as a solution to the problem of religious radicalism among women.

 Result: The study reveals several key aspects of the construction of jihad in da’wah against radicalism among female ulama: Meaning of Jihad: The jihad of female clerics involves preaching, contextualization within hijrah (migration), attendance at taklim assemblies, and fostering diversity. Motives for Jihad: Motives include healing women's psychological wounds, providing a dialogue space for congregations, fostering tolerance among congregations, addressing radicalism targeting women, and broadening women's understanding of moderate and humanist Islamic teachings. Experiences of Jihad: Experiences of jihad include participation in taklim assembly studies, engaging in open dialogic spaces, assisting the wives of former terrorist convicts, providing mental health therapy, critiquing da'wah on social media, strengthening national insight, and providing education on the rights and relationships of husbands and wives in the family.

 Conclusion: In conclusion, the study demonstrates that the construction of jihad in da’wah against radicalism among female ulama involves multifaceted meanings, motives, and experiences. The efforts of female ulama in addressing religious radicalism encompass preaching, dialogue, education, and psychological support. By redefining jihad in this manner, female ulama contribute significantly to countering radicalism, fostering tolerance, and promoting a broad, moderate understanding of Islam among congregations, particularly women, in the specified regions of West Java.","PeriodicalId":41277,"journal":{"name":"McGill International Journal of Sustainable Development Law and Policy","volume":"8 4","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-11-06","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"135679518","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
